HomeMy WebLinkAboutZoning By-law No. Z156-1987 THE CORPORATION OF THE TOWNSHIP OF BAYHAM BY-LAW NO. 2156-87 BEING A BY-LAW TO AMEND BY-LAW NO. 2040 WHEREAS the Council of the Corporation of the Township of Bayham deems it necessary to amend its Zoning By-law No. 2040; THEREFORE, the Council of the Corporation of the Township of Bayham enacts as follows : 1 . THAT By-law No. 2040, as amended, is hereby further amended by amending By-Law No. Z143-86 by deleting Section 1 and replacing it with the following: "1. THAT By-law No. 2040, as amended , is hereby further amended by amending Section 5, Agricultural Zone Regulations by adding two new subsections after subsection 5. 12. 9 as follows: 5.12 .10 5. 12. 10. 1 Defined Area A1-10 as shown on Schedule "A" to this By-law 5. 12. 10. 2 Permitted Uses One single-family detached dwelling 5. 12. 10.3 Permitted Buildings and Structures Buildings and structures for the permitted uses. Accessory buildings and structures for the permitted uses. 5. 12. 10. 4 Minimum Lot Area 3. 5 hectares 5. 12. 10. 5 Minimum Lot Frontage 68 . 0 metres 5. 12. 10. 6 Minimum Front Yard Depth 35. 0 metres - 2 5.12.11 5. 12. 11. 1 Defined Area Al-11 as shown on Schedule "A" to this By-law 5. 12. 11. 2 Permitted Uses One single-family detached dwelling 5. 12. 11. 3 Permitted Buildings and Structures Buildings and structures for the permitted uses Accessory buildings and structures for the permitted uses 5. 12. 11.4 Minimum Lot Area 1. 1 hectare 5. 12. 11.5 Minimum Lot Frontage 120. 0 metres 5. 12. 11. 6 Minimum Front Yard Depth 35. 0 metres" 2. THAT By-law No. 2040, as amended, is hereby further amended by amending Map 59, by deleting from the Rural Residential (RR) Zone and adding to the Special Agricultural (A1-10) Zone and the Special Agricultural (A1-11) Zone those lands outlined in heavy solid lines and designated A1-10 and Al-11 on Schedule "A" to this By-law which schedule is attached to and forms part of this By-law. 3. This By-law comes into force: a) where no notice of objection has been filed with the Township' s Clerk within the time prescribed by the Planning Act 1983 and regulations pursuant thereto, upon the expiration of the prescribed time; or - 3 - b) where notice of objection has been filed with the Township' s Clerk within the time prescribed by the Planning Act 1983 and regulations pursuant thereto, upon the approval of the Ontario Municipal Board . READ a FIRST time this 20th day of August, 1987. READ a SECOND time this 20th day of August, 1987. DAY OF AUGUST, 1987 UNDER SECTION 34 OF THE PLANNING ACT, 1983. AND TAKE NOTICE THAT ANY PERSON OR AGENCY MAY APPEAL TO THE ONTARIO MUNICIPAL BOARD IN RESPECT OF THE BY-LAW BY FILING WITH THE CLERK OF THE TOWNSHIP OF BAYHAM NOT LATER THAN THE 24TH. DAY OF SEPTEMBER, 1987, A NOTICE OF APPEAL SETTING OUT THE OBJECTION TO THE BY-LAW AND THE REASONS IN SUPPORT OF THE OBJECTION. PETRIE CLERK OF THE TOWNSHIP OF BAYHAM BOX 160 STRAFFORDVILLE, NOJ 1Y0 EXPLANATORY NOTE The purpose of By-law No. Z156-87 is to change the zoning of two lots from the Rural Residential (RR) Zone to the Special Agricultural (A1-10) and the Special Agricultural (A1-11) Zones. The subject properties are situated on the south west side of Bayham Drive in Part of Lot 20, Concession XI in the Township of Bayham. The northernmost portion of the subject lands is approximately one hectare in size and is heavily wooded. The southern portion of the subject lands (3. 5 hectares) is occupied by a single family residence and is also heavily wooded. The effect of this By-law will he to establisha set of site- specific t,specific zoning regulations which will recognize an existing single family detached dwelling on one lot, and to permit the establishment of a second single family detached dwelling on the second lot pursuant to the process of severance and conveyance. In each case the dwellings will be subject to appropriate setbacks from lands zoned for industrial purposes in the Town of Tillsonburg. Further subdivision of the subject lands cannot take place without an amendment to By-law No.2156-87.
