Z154-87 BEING A BY-LAW TO AMEND BY-LAW NO. 2040 WHEREAS the Council of the Corporation of the Township of Bayham enacts as follows : 1 . THAT By-law No. 2040, as amended, is hereby further amended by amending Section 9, Hamlet Commercial (HC) Zone Regulations by adding a new subsection to 9. 9 Exceptions - HC Zone after subsection 9. 9. 1 as follows "9.9.2 9. 9. 2. 1 Defined Area HC-2 as shown on Schedule "A" to this By-law. 9. 9. 2. 2 Minimum Lot Area 1300 square metres 9. 9. 2. 3 Minimum Lot Frontage 26. 5 metres. 9. 9. 2.4 Minimum Setbacks From Arterial Streets or Arterial Roads Existing building line along Highway No . 19 and First Street 2. THAT By-law No. 2040, as amended, is hereby further amended by amending Section 12, Rural Industrial (M2 Zone Regulations by adding a new subsection to 12. 10 Exceptions - M2 Zone after subsection 12. 10. 5 as follows : "12 .10.6 12. 10.6. 1 Defined Area M2-6 as shown on Schedule "A" to this By-law. 12. 10. 6. 2 Permitted Uses Manufacture and assembly of pre-fabricated agricultural buildings and structures. - 2 - 12. 10.6. 3 Permitted Buildings and Structures Existing buildings and structures for the permitted uses. Accessory buildings and structures for the permitted uses. 12. 10. 6.4 Minimum Lot Area 2815. 0 square metres 12. 10.6.5 Minimum Lot Frontage 19 metres. " 3. THAT Schedule "D" to By-law No. 2040, as amended, is hereby further amended by deleting from the Future Development (FD) Zone and adding to the Special Hamlet Commercial (HC-2) Zone those lands enclosed in heavy solid lines and designated HC-2 on Schedule "A" to this By-law, which schedule is attached to and forms part of this By-law. 4. THAT Schedule "D" to By-law No. 2040, as amended, is hereby further amended by deleting from the Hamlet Commercial (HC) Zone and the Agricultural (Al) Zone and adding to the Special Rural Industrial (M2-6) Zone those lands enclosed in heavy solid lines and designated M2-6 on Schedule "A" to this By-law, which schedule is attached to and forms part of this By-law. 5. This By-law comes into force: a) where no notice of objection has been filed with the Township' s Clerk within the time prescribed by the Planning Act 1983 and regulations pursuant thereto, upon the expiration of the prescribed time; or FORM 1 PLANNING ACT, 1983 NOTICE OF THE PASSING OF A ZONING BY-LAW BY THE CORPORATION OF THE TOWNSHIP OF BAYHAM TAKE NOTICE THAT THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF BAYHAM PASSED BY-LAW #Z154-87 ON THE 6TH. DAY OF AUGUST, 1987 UNDER SECTION 34 OF THE PLANNING ACT, 1983. AND TAKE NOTICE THAT ANY PERSON OR AGENCY MAY APPEAL TO THE ONTARIO MUNICIPAL BOARD IN RESPECT OF THE BY-LAW BY FILING WITH THE CLERK OF THE TOWNSHIP OF BAYHAM NOT LATER THAN THE 10TH. DAY OF SEPTEMBER, 1987, A NOTICE OF APPEAL SETTING OUT THE OBJECTION TO THE BY-LAW AND THE REASONS IN SUPPORT OF THE OBJECTION. AN EXPLANATION OF THE PURPOSE AND EFFECT OF THE BY-LAW, DESCRIBING THE LANDS TO WHICH THE BY-LAW APPLIES, AND A KEY MAP SHOWING THE LOCATION OF THE LANDS TO WHICH THE BY-LAW APPLIES ' (OR, ALTERNATIVELY AN EXPLANATION AS TO WHY A KEY MAP IS NOT PROVIDED) ARE ATTACHED. PETRIE CLERK OF THE TOWNSHIP OF BAYHAM BOX 160 STRAFFORDVILLE, NOJ 1YO EXPLANATORY NOTE The purpose of By-law No. 2154-87 is to change the zoning on two separate parcels of land in the hamlet of Eden. One of the parcels is located at the north-east corner of Highway No. 19 and County Road No. 44 and is presently vacant. The second property is located along the west side of Highway 19 and is occupied by an existing barn and a garage. The effect of this amendment will be to permit the establish- ment of a service station and variety store on the vacant parcel of land at the intersection, and , to ,permit the estab- lishment of a manufacturing business related to pre-fabricated agricultural buildings and structures at the site located on the west side of Highway No. 19.
