Z146-86 BEING A BY-LAW TO AMEND BY-LAW NO. 2040 WHEREAS the Council of the Corporation of the Township of Bayham deems it necessary to amend its Zoning By-law No. 2040; THEREFORE, the Council of the Corporation of the Township of Bayham enacts as follows: 1. THAT By-law No. 2040, as amended, is hereby further amended by amending Section 7, Rural Residential (RR) Zone Regulations by adding a new subsection 7.11.3 after subsection 7.11.2 as follows: "7.11.3 7.11.3.1 Defined Area RR-3 as shown on Schedule "A" to this By-law 7.11.3.2 Minimum Lot Area 1600.0 square metres 7.11.3.3 Permitted Buildings and Structures Existing buildings and structures for the permitted uses Accessory buildings and structures." 2. THAT Schedule "A" to By-law No. 2040, as amended, is hereby further amended by deleting from the Agricultural (A1) Zone and adding to the Special Rural Residential (RR-3) Zone those lands enclosed in heavy solid lines and designated RR-3 on Schedule "A" to this By-law, which schedule is attached to and forms part of this By-law and which schedule shall be deemed to be known as Schedule "A", Map 60 to By-law No. 2040. 3. THIS By-law comes into force: a) where no notice of objection has been filed with the Township's Clerk within the time prescribed by the Planning Act 1983 and regulations pursuant thereto, upon the expiration of the prescribed time; or b) where notice of objection has been filed with the Township's Clerk within the time prescribed by the Planning Act 1983 and regulations pursuant thereto, upon the approval of the Ontario Municipal Board. READ a FIRST time this 4th day of December 1986. READ a SECOND time this 4th day of December 1986. READ a THIRD time and FINALLY PASSED this 4th day of December 1986. DAY OF DECEMBER, 1986 UNDER SECTION 34 OF THE PLANNING ACT, 1983. AND TAKE NOTICE THAT ANY PERSON OR AGENCY MAY APPEAL TO THE ONTARIO MUNICIPAL BOARD IN RESPECT OF THE BY-LAW BY FILING WITH THE CLERK OF THE TOWNSHIP OF BAYHAM NOT LATER THAN THE 8TH. DAY OF JANUARY, 1987, A NOTICE OF APPEAL SETTING OUT THE OBJECTION TO THE BY-LAW AND THE REASONS IN SUPPORT OF THE OBJECTION. AN EXPLANATION OF THE PURPOSE AND EFFECT OF THE BY-LAW, DESCRIBING THE LANDS TO WHICH THE BY-LAW APPLIES, AND A KEY MAP SHOWING THE LOCATION OF THE LANDS TO WHICH THE BY-LAW APPLIES (OR, ALTERNATIVELY AN EXPLANATION AS TO WHY A KEY MAP IS NOT PROVIDED) ARE ATTACHED. PETRIE CLERK OF THE TOWNSHIP OF BAYHAM BOX 160 STRAFFORDVILLE, ONTARIO NOJ 1YO EXPLANATORY NOTE The purpose of By-law No. Z146-86 is to change the zoning on a parcel of land located on the north side of County Road 45 in part of Lot 26, Concession V from the Agricultural (Al) Zone to the Special Rural Residential (RR-3) Zone. The subject lands are comprised of approximately 1,633 square metres and are occupied by a residential dwelling unit and a kiln. The effect of this by-law will be to recognize the establish- ment of a new lot which has been separated from an adjacent farm operation through the process of severance and conveyance. The lot is occupied by a surplus farm dwelling. This by-law is also intended to implement the policies of Official Plan Amendment No. 6 which designates the subject lands as "Rural Residential".
