HomeMy WebLinkAboutZoning By-law No. Z257-1991 FORM 1 PLANNING ACT, 1983 NOTICE OF THE PASSING OF A ZONING BY-LAW BY THE CORPORATION OF THE TOWNSHIP OF BAYHAM TAKE NOTICE that the Council of the Corporation of the Township of Bayham passed By-Law No. Z257-91 on the 18th day of July, 1991 under Section 34 of THE PLANNING ACT, 1983. AND TAKE NOTICE that any person or agency may appeal to the Ontario Municipal Board in respect of the By-law by filing with the Clerk of the Township of Bayham not later than the 1Sth day of August, 1991, a notice of appeal setting out the objection to the By-law and the reasons in support of the objection. An explanation of the purpose and effect of the By-law, describing the lands to which the By-law applies, and a Key Map showing the location of the lands to which the By-law applies (or, alternatively an explanation as to why a key map is not provided) are attached. William Bogue Clerk Township of Bayham Box 160 STRAFFORDVILLE, Ontario NO.1 1Y0 EXPLANATORY NOTE The purpose of By-law No. Z257-91 is to effect a series of technical changes and revisions to the Township's Comprehensive Zoning By-Law No. 2387. These changes are intended to implement Official Plan Amendment No. 87 which had the effect of revising the Rural Policy Section of the Official Plan. Firstly, this zoning by-law will zone all non farm related residential lots that have been approved by OPA #87 "Estate Residential" in the Comprehensive Zoning By-law of the Township of Bayham. Secondly, this zoning by-law will zone lands located on Part Lot 20 Concession 11 "Rural Industrial" to recognize an industrial park which has been designated "Industrial" pursuant to Official Plan Amendment 87. The effect of this By-law will be to improve the level of conformity with the Official Plan of the Township of Bayham and to facilitate an improved level of interpretation and implementation to the Township's Zoning By-law. A key map is not attached because this By-law will apply to all lands within the Township of Bayham. THE CORPORATION OF THE TOWNSHIP OF BAYHAM BY-LAW NO. 7157-91 BEING A BY-LAW TO AMEND BY-LAW NO. 2387 WHEREAS the Council of the Corporation of the Township of Bayham deems it necessary to amend its Zoning By-law No. 2387; THEREFORE, the Council of the Corporation of the Township of Bayham enacts as follows: 1. THAT By-law No. 2387, as amended, is hereby further amended by amending Schedule 'A', Map 2, by deleting from the Agricultural (Al) Zone and adding to the Rural Industrial (M2) Zone, these lands enclosed in heavy solid lines and marked (M2) on Schedule 'A', Map 2, to this By-law, which schedule is attached to and forms part of this By-law. 2. THAT By-law No. 2387, as amended, is hereby further amended by amending Section 7, Rural Residential (RR) Zone Regulations by deleting subsections 7.11.14, 7.11.15, 7.11.16 and 7.11.18 in their entirety. 3. THAT By-law No. 2387, as amended, is hereby further amended by amending Schedule 'A', Map 60, by deleting from the Special Rural Residential (RR-14) Zone and adding to the Estate Residential (ER) Zone, these lands enclosed in heavy solid lines and marked (ER) on Schedule 'A', Map 60, to this By-law, which schedule is attached to and forms part of this By-law. 4. THAT By-law No. 2387, as amended, is hereby further amended by amending Schedule 'A', Maps 20 and 21, by deleting from the Special Rural Residential (RR-15) and (RR-16) Zones and adding to the Estate Residential (ER) Zone, these lands enclosed in heavy solid lines and marked (ER) on Schedule 'A', Map 20 and 21, to this By-law, which schedule is attached to and forms part of this By- law. 5. THAT By-law No. 2387, as amended, is hereby further amended by amending Schedule 'A', Map 35, by deleting from the Rural Residential (RR) Zone and adding to the Estate Residential (ER) Zone, these Iands enclosed in heavy solid lines and marked (ER) on Schedule 'A', Map 35, to this By-law, which schedule is attached to and forms part of this By-law. 6. THAT By-law No. 2387, as amended, is hereby further amended by amending Schedule 'A', Map 62, by deleting from the Rural Residential (RR) Zone and adding to the Estate Residential (ER) Zone, these lands enclosed in heavy solid lines and marked (ER) on Schedule 'A', Map 62, to this By-law, which schedule is attached to and forms part of this By-law. -2- 7. THAT By-law No. 2387, as amended, is hereby further amended by amending Schedule 'A', Map 62, by deleting from the Rural Residential (RR) Zone and adding to the Agricultural (A1) Zone, these lands enclosed in heavy solid lines and marked (AI) on Schedule 'A', Map 62, to this By-law, which schedule is attached to and forms part of this By-law. 8. THAT By-law No. 2387, as amended, is hereby further amended by amending Section 8 Estate Residential (ER) Zone Regulations by adding new subsections to Section 8.13 Exceptions (ER) Zone as follows: "8.13.2 8.13.2.1 Defined Area ER-2 as shown on Schedule 'A', Map 62 to this By-law. 8.13.2.2 Minimum Lot Frontage 36.0 metres. 8.13.2.3 Rear Yard Setback from the 212.5 Metre Contour Elevation 0.0 metres. 8.13.2.4 Building, Structure and Grading Regulations No buildings or structures shall be constructed or regrading of land occur below the 212.5 metre contour elevation." 8.13.3 8.13.3.1 Defined Area ER-3 as shown on Schedule 'A', Map 31 to this By-law. 8.13.3.2 Minimum Lot Frontage 75.0 metres. 8.13.33 Side Yard Setback from the 210.0 Metre Contour Elevation 0.0 metres. 8.13.3.4 Budding, Structure and Grading Regulations No buildings or structures shall be constructed or regrading of land occur below the 210.0 metre contour elevation." 9. THAT By-law No. 2387, as amended, is hereby further amended by amending Schedule 'A', Map 62, by deleting from the Special Rural Residential (RR-18) Zone and adding to the Special Estate Residential (ER-2) Zone and the Hazard Lands (HL) Zone, these lands enclosed in heavy solid lines and marked (ER-2) and (HL) on Schedule 'A', Map 62, to this By-law, which schedule is attached to and forms part of this By-law. -3- 10. THAT By-law No. 2387, as amended, is hereby further amended by amending Schedule 'A', Map 31, by deleting from the Rural Residential (RR) Zone and adding to the Special Estate Residential (ER-3) Zone and Hazard Lands (I-IL) Zone, these lands enclosed in heavy solid lines and marked (ER-3) and (HL) on Schedule 'A', Map 31, to this By-law, which schedule is attached to and forms part of this By-law. 11. THAT By-law No. 2387, as amended, is hereby further amended by amending Schedule 'A', Map 54 by deleting from the Rural Residential (RR) Zone and adding to the Estate Residential (ER) Zone, these lands enclosed in heavy solid lines and marked (ER) on Schedule 'A' Map 54 to this By-law, which schedule is attached to and forms part of this By-law. 12. THIS By-law comes into force: a) where no notice of objection has been filed with the Township's Clerk within the time prescribed by the Planning Act, 1983 and regulations pursuant thereto, upon the expiration of the prescribed time; or b) where notice of objection has been filed with the Township's Clerk within the time prescribed by the Planning Act, 1983 and regulations pursuant thereto, upon the approval of the Ontario Municipal Board.
