HomeMy WebLinkAboutZoning By-law No. Z253-1991 FORM 1 PLANNING ACT, 1983 NOTICE OF THE PASSING OF A ZONING BY-LAW BY THE CORPORATION OF THE TOWNSHIP OF BAYHAM TAKE NOTICE that the Council of the Corporation of the Township of Bayham passed By-Law No. Z253-91 on the 17th day of January, 1991 under Section 34 of THE PLANNING ACT, 1983. AND TAKE NOTICE that any person or agency may appeal to the Ontario Municipal Board in respect of the By-law by filing with the Clerk of the Township of Bayham not later than the 12th day of February, 1991, a notice of appeal setting out the objection to the By-law and the reasons in support of the objection. An explanation of the purpose and effect of the By-law, describing the lands to which the By-law applies, and a Key Map showing the location of the lands to which the By-law applies (or, alternatively an explanation as to why a key map is not provided) are attached. William Bogue Clerk Township of Bayham Box 160 STRAFFORDVILLE, Ontario NOJ 1Y0 EXPLANATORY NOTE The purpose of By-law No. Z253-91 is to effect a series of changes to the Township's Comprehensive Zoning By-law No. 2387 . Specifically, this by-law will incorporate mobile and modular home definitions in the Township's Zoning By-law. Furthermore, the by-law will regulate the placement of mobile and modular homes within the Township as well as incorporate a minimum building width for all residential structures within the Township. The effect of this By-law will be to improve the level of interpretation and implementation of the Township's Zoning By- law. A key map is not attached because this By-law will apply to all lands within the Township of Bayham. THE CORPORATION OF THE TOWNSHIP OF BAYHAM BY-LAW NO. Z253-91 BEING A BY-LAW TO AMEND BY-LAW NO. 2387 WHEREAS the Council of the Corporation of the Township of Bayham deems it necessary to amend its Zoning By-law No. 2387; THEREFORE, the Council of the Corporation of the Township of Bayham enacts as follows: 1. THAT By-law No. 2387, as amended, is hereby further amended by amending Section 2, Definitions by adding new subsections after subsection 2 . 144 as follows : "2. 145 Modular Home shall mean a house that is intended for residential purposes and that is constructed by assembling manufactured modular units each of which comprises at least one room or living area, has been manufactured to comply with the A277 series of standards prescribed by the Canadian Standards Association, and bears the seal of that Association attesting to such compliance. 2. 146 Mobile/Modular Home, Single-Wide shall mean a mobile home unit or modular home unit designed to be towed in one load which does not exceed 6 . 0 metres in width. The layout of the rooms is linear. 2 . 147 Mobile/Modular Home, Double-Wide shall mean a mobile home unit or modular home unit consisting of two sections, separately towable, but designed to be joined together into one integral unit. Double-wide units shall be defined as a unit greater than 6 . 0 metres in width. 2 . 148 Mobile Home, Expandable shall mean a single-wide mobile home which is transported in one load but incorporates parts which may be folded, collapsed or telescoped inside the unit during transportation and extended on-site to provide additional living space. " 2 . THAT By-law No. 2387, as amended, is hereby further amended by deleting Section 4 .8 c) in its entirety and replacing it with the following: "c) The location and use of a single-wide mobile home, single-wide modular home or expandable mobile home for the purposes of residential, commercial, industrial or institutional uses . " 3. THAT By-law No. 2387, as amended is hereby further amended by adding to new section after Section 4 .8 c) as follows: "d) Notwithstanding Section 4 .8 c) the use of a single-wide mobile home or single-wide modular home may be used as a supplementary farm dwelling unit within the Agricultural (Al) Zone. " 4 . THAT By-law No. 2387, as amended is hereby further amended by adding a new section after Section 4 . 31 as follows : "4.32 Minimum Width of Residential Dwelling Units The minimum building width for all residential dwellings units shall be 6 . 0 metres and in no case shall the building length to width ratio exceed 3: 1. The width shall be defined as the least horizontal distance between parallel exterior main walls of the building, whereas length shall be defined as the longer horizontal distance between parallel main walls of the building. " 5 . THIS By-law comes into force: a) where no notice of objection has been filed with the Township's Clerk within the time prescribed by the Planning Act, 1983 and regulations pursuant thereto, upon the expiration of the prescribed time; or b) where notice of objection has been filed with the Township's Clerk within the time prescribed by the Planning Act, 1983 and regulations pursuant thereto, upon the approval of the Ontario Municipal Board.
