HomeMy WebLinkAboutZoning By-law No. Z318-1994 CORPORATION OF THE TOWNSHIP OF BAYHAM BY-LAW NO. Z318-94 BEING A BY-LAW TO AMEND BY-LAW NO. 2387 WHEREAS the Council of the Corporation of the Township of Bayham deems it necessary to amend its Zoning By-law No. 2387; THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF BAYHAM ENACTS AS FOLLOWS: 1. THAT By-law No. 2387, as amended, is hereby further amended by amending Section 4 - General Provisions, by adding a new subsection as follows: "4.33 MINIMUM SETBACKS FROM OBNOXIOUS USES Notwithstanding any other provision of this By-law or the requirements which may be prescribed by the Province of Ontario, the following minimum setbacks shall be maintained from existing or proposed sensitive land uses including residential uses which are not accessory or related to the following uses: MINIMUM SETBACK TO OR FROM SENSITIVE LAND USES INCLUDING NON-FARM, NON- RESIDENTIAL OR ACCESSORY OBNOXIOUS USES USES i) commercial or custom grain handling or drying operation 305 metres ii) former and active waste sites including landfill sites a) where a methane gas/leachate study has determined the need for technical controls for gas and leachate 30 metres b) where a methane gas/leachate studies have not been undertaken 300 metres iii) sewage lagoons 400 metres iv) solid waste transfer sites and/or waste recycling depots 200 metres 4. THIS By-law comes into force: a) where no notice of objection has been filed with the Township's Clerk within the time prescribed by the Planning Act, 1990 and regulations pursuant thereto, upon the expirations of the prescribed time; or By-law No. Z318-94 2 b) where notice of objection has been filed with the Township's Clerk within the time prescribed by the Planning Act, 1990 and regulations pursuant thereto, upon the approval of the Ontario Municipal Board. READ A FIRST AND SECOND TIME this 3rd day of November, 1994 READ A THIRD TIME AND FINALLY PASSED this 3rd day of November, 1994. � t REEVE CLERK EXPLANATORY NOTE The purpose of this By-law is to add a new series of setback regulations to the General Provisions of the Zoning By-law of the Township of Bayham. The effect of the By-law will be to prescribe minimum setbacks or separation distances between sensitive land uses including residential uses and various obnoxious uses including: commercial and custom grain handling or drying operations; waste sites; waste transfer sites; waste recycling depots; and sewage lagoons. A key map is not attached to this By-law because the By-law will apply to all lands within the Township of Bayham.
