Z389-98 (Roman Catholic Episcopal Corporation of the Diocese of London) BEING A BY-LAW TO AMEND BY-LAW NO. 2387 WHEREAS the Council of the Corporation of the Municipality of Bayham deems it necessary to amend its Zoning By-law No. 2387; THEREFORE,the Council of the Corporation of the Municipality of Bayham enacts as follows: 1. THAT By-law No. 2387, as amended, is hereby further amended by amending Schedule "A", Map No. 79, by deleting from the Agricultural(Al)Zone and adding to the Special Institutional (1-2)Zone,those lands outlined in heavy solid lines and marked 1-2 on Schedule "A"to this By-law, which schedule is attached to and forms part of this By-law. 2. THAT By-law No. 2387, as amended, is hereby further amended by amending Section 14, Institutional(I)Zone Regulations by adding a new subsection to Section 14.10 Exceptions (I)Institutional Zone: "14.10.2 14.10.2.1 Defined Area I-2 as shown on Schedule "A", Map No. 79 to this By-law. 14.10.2.2 Minimum Lot Frontage Notwithstanding subsections 2.65, 4.16, and 14.3 of by-law No. 2387,no frontage shall be required on a public road. Access to the subject lands shall be provided via an existing private right of way which extends south from Nova Scotia Line,through Part Lot 7, Concession 1 to the subject site. 14.10.2.3 Permitted Buildings and Structures Buildings and structure for the existing uses." 3. THAT this By-law comes into force: a) where no notice of objection has been filed with the Municipal Clerk within the time prescribed by the Planning Act and regulations pursuant thereto, upon the expiration of the prescribed time, or b) where notice of objection has been filed with the Municipal Clerk within the time prescribed by the Planning Act and regulations pursuant thereto, upon the approval of the Ontario Municipal Board. Z389-98 EXPLANATORY NOTE The purpose of this By-law is to change the zoning on a property comprising approximately 2.3 hectares (5.7 acres) situated northwest of Port Burwell in Part Lot 7, Concession 1 in the Municipality of Bayham, from the Agricultural (Al) Zone to a Special Institutional (I) zone. The effect of this by-law will be to allow a Minor Lot Adjustment as permitted under Section 4.2.10 of the Official Plan and to recognize a vehicular right-of-way in the absence of lot frontage for the subject property on a public road. The proposed by-law would also consolidate the zoning on the existing Institutional use of the Roman Catholic Episcopal Corporation of London, Ontario. I also certify that the 20 day objection period expired on 30th day of March, 1998 and to this date,no notice of objection has been filed by any person in the office of the Clerk.
