HomeMy WebLinkAboutZoning By-law No. Z394-1998 CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NUMBER Z394-98 BEING A BY-LAW TO AMEND BY-LAW NO. 2387 (Terrence &Elizabeth Evanitski) WHEREAS the Council of the Corporation of the Municipality of Bayham deems it necessary to amend Township of Bayham Zoning By-law No. 2387; THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS: 1. THAT By-law No. 2387, as amended, is hereby further amended by amending Schedule"A", Map No. 10 by deleting from the Agricultural(A1)Zone and adding to the Special Rural Residential(RR-28)Zone,those lands outlined in heavy solid lines and marked RR-28 on Schedule "A"to this By-law, which schedule is attached to and forms part of this By-law. 2. THAT By-law No. 2387, as amended,is hereby further amended by amending Section 7, Rural Residential(RR)Zone Regulations by adding a new subsection to Section 7.13, EXCEPTIONS as follows: "7.13.28 7.13.28.1 Defined Area RR-28 as shown on Schedule"A", Map No. 10 to this By-law. 7.13.28.2 Minimum Lot Area 0.38 hectare(0.94 acres)" 3. THAT this By-law No. 2387, as amended, is hereby further amended by amending Schedule"A",Map No. 10 by deleting from the Agricultural(Al) Zone and adding to the Special Agricultural(A1-69)Zone,those lands outlined in heavy solid lines and marked A1-69 on Schedule"A"to this By-law, which schedule is attached to and forms part of this By-law. 4. THAT By-law No. 2387, as amended, is hereby further amended by amending Section 5,Agricultural (Al)Zone Regulations by adding a new subsection to Section 5.11, EXCEPTIONS—Al Zone, as follows: "5.11.69 5.11.69.1 Defined Area Al-69 as shown on Schedule"A",Map No. 10 to this By-law. 5.11.69.2 Minimum Lot Area 19.6 hectares(48.4 acres)" 5. THIS By-law comes into force: a) where no notice of objection has been filed with the Municipal Clerk within the time prescribed by the Planning Act and regulations pursuant thereto, upon the expiration of the prescribed time; or CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NUMBER Z394-98 Page 2 b) where notice of objection has been filed with the Municipal Clerk within the time prescribed by the Planning Act and regulations pursuant thereto, upon the approval of the Ontario Municipal Board. Z394-98 EXPLANATORY NOTE (Terrence & Elizabeth Evanitski) The purpose of this By-law is to change the zoning on a parcel of land comprising approximately 0.38 hectares (1 acre) situated on the south side of Best Line, east of the Hamlet of Corinth, in Part Lot 7, Concession 9, in the Municipality of Bayham from the Agricultural (Al) Zone to the Rural Residential(RR-28)Zone. The effect of this By-law will be to facilitate the creation of one new residential building lot for retirement purposes through the process of severance and conveyance. I also certify that the 20 day objection period expired on the 27th day of July, 1998 and to this date, no notice of objection has been filed by any person in the office of the Clerk.
