HomeMy WebLinkAboutZoning By-law No. Z402-1999 MUNICIPALITY OF BAYIIAM CLERK'S CERTIFICATE Section 34(2) of the Planning Act, R.S.O. 1990, Chapter P.13 I, Maureen Beatty, Co-ordinator of Planning and Deputy Clerk hereby certify that the notice for By-law No. Z402-99 of the Corporation of the Municipality of Bayham passed by the Council of the Corporation on the 18th day of March, 1999 was given in the manner and form and to the persons prescribed by regulations made by the Lieutenant Governor-in-Council under Section 34(18) of the Planning Act. I also certify that the 20 day appeal period expired on the 8th day of April, 1999 and to this date, no notice of objection had been filed by any person in the office of the Clerk. Z402-99 (Danny MacDonald—MacDonald Marine) BEING A BY-LAW TO AMEND BY-LAW NO.2387 WHEREAS the Council of the Corporation of the Municipality of Bayham deems it necessary to amend its Zoning By-law No. 2387; IHEREFORE, the Council of the Corporation of the Municipality of Bayham enacts as follows: 1. THAT By-law No. 2387, as amended, is hereby further amended by amending Schedule "A", Map No. 7 by deleting from the Rural Commercial (RC) Zone and adding to the Rural Residential (RR) Zone,those lands outlined in heavy solid lines and marked RR, and by deleting from the Special Rural Industrial (M2-8)Zone and adding to the Rural Commercial (RC) Zone those lands outlined in heavy solid lines and marked RC on Schedule"A"to this By-law, which schedule is attached to and forms part of this By-law. 3. THIS By-law comes into force: a) where no notice of objection has been filed with the Municipal Clerk within the time prescribed by the Planning Act and regulations pursuant thereto, upon the expiration of the prescribed time; or b) where notice of objection has been filed with the Municipal Clerk, within the time prescribed by the Planning Act and regulations pursuant thereto, upon the approval of the Ontario Municipal Board. The first parcel will comprise approximately 0.59 ha(15 acres) of land and will be rezoned from the rural Commercial(RC)Zone to the Rural Residential(RR)Zone;the second parcel will comprise 1.5 hectares(3.8 acres) and will be rezoned from the Special rural Industrial (M2-8)Zone to the Rural Commercial (RC)Zone. The effect of this By-law will be two-fold. First, it will recognize an existing residential use on the smaller 0.59 ha(1.5 acres)parcel, and secondly, it will permit the establishment of a commercial business for the sales and service of pleasure water craft on the larger 1.5 ha(3.8 acre) parcel.
