HomeMy WebLinkAboutZoning By-law No. Z403-1999 MUNICIPALITY OF BAYHAM CLERK'S CERTIFICATE Section 34(2) of the Planning Act, R.S.O. 1990, Chapter P.13 I, Maureen Beatty, Co-ordinator of Planning and Deputy Clerk hereby certify that the notice for By-law No. Z403-99 of the Corporation of the Municipality of Bayham passed by the Council of the Corporation on the 18th day of March, 1999 was given in the manner and form and to the persons prescribed by regulations made by the Lieutenant Governor-in-Council under Section 34(18) of the Planning Act. I also certify that the 20 day appeal period expired on the 15th day of April, 1999 and to this date, no notice of objection had been filed by any person in the office of the Clerk. Co-ordinator of Pia ing & Deputy Clerk File: D1.4 Bruce & Patsy Ketchabaw Cert403 THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO,Z403-99 (Bruce and Patsy Ketchabaw) BEING A BY-LAW TO AMEND BY-LAW NO.2387 WHEREAS the Council of the Corporation of the Municipality of Bayham deems it necessary to amend its Zoning By-law No. 2387; THEREFORE, the Council of the Corporation of the Municipality of Bayham enacts as follows: 1. THAT By-law No. 2387, as amended, is hereby further amended by amending Schedule "A",Map No. 36 by deleting from the Agricultural (Al)Zone and adding to the Special Rural Residential (RR-29) Zone, those lands outlined in heavy solid lines and marked RR-29 on Schedule "A" to this By-law, which schedule is attached to and forms part of this By-law. 2. THAT By-law 2387, as amended, is hereby further amended by amending Section 7, Rural Residential (RR) Zone Regulations by adding a new subsection to Section 7.13, EXCEPTIONS, as follows: "7.13.29 7.13.29.1 Defined Area RR-29 as shown on Schedule"A",Map No.36 to this By-law. 7.13.29.2 Minimum Lot Area 0.29 hectares(0.7 acres" 3. THAT By-law No. 2387, as amended, is hereby further amended by amending Section 5, Agricultural (Al) Zone Regulations by adding a new subsection to Section 5.11, EXCEPTIONS as follows: "5.11.71 5.11.71.1 Defined Area A1-71 as shown on Schedule "A",Map No. 36 to this By-law. 5.11.71.2 Minimum Lot Area 19.8 hectares (48.9 acres)" 3. THIS By-law comes into force: a) where no notice of objection has been filed with the Municipal Clerk within the time prescribed by the Planning Act and regulations pursuant thereto, upon the expiration of the prescribed time; or b) where notice of objection has been filed with the Municipal Clerk, within the time prescribed by the Planning Act and regulations pursuant thereto, upon the approval of the Ontario Municipal Board. MUNICIPALITY OF BAYHAM o 250rn 5000 SCHEDULE 'A' Scale 1 l 12,500 A [Vs . 36 c BY-LAW NUMBER Z403-99 EXPLANATORY NOTE The purpose of this By-law is to change the zoning on a parcel of land comprising approximately 2,927 squared metres (9,603 sq. feet) situated on the north side of Heritage Line(County Road No. 38) east of Tollgate Road, in Part Lot 129, North Side Talbot Road in the Municipality of Bayham from the Agricultural (Al)Zone to a Special Rural Residential(RR-29)Zone. The effect of this By-law will be to facilitate the severance and conveyance of a residential lot for retirement purposes.
