HomeMy WebLinkAboutZoning By-law No. Z407-1999 MUNICIPALITY OF BAYHAM CLERK'S CERTIFICATE Section 34(2) of the Planning Act,R.S.O. 1990, Chapter P.13 I, Maureen Beatty, Co-ordinator of Planning and Community Services hereby certify on behalf of the Clerk, that the notice for By-law No. Z407-99 of the Corporation of the Municipality of Bayham passed by the Council of the Corporation on the 6th day of May, 1999 was given in the manner and form and to the persons prescribed by regulations made by the Lieutenant Governor- in-Council under Section 34(18) of the Planning Act. I also certify that the 20 day appeal period expired on the 28th day of May, 1999 and to this date, no notice of objection has been filed by any person in the office of the Clerk. Dated at the Municipality of Bayham this 31st day of May, 1999. 41/raw Co-ordinator of anning & Community Services File: D1.4 Julia Cus Cert407 THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO.Z407-99 (Julia Cus) BEING A BY-LAW TO AMEND BY-LAW NO. 2387 WHEREAS the Council of the Corporation of the Municipality of Bayham deems it necessary to amend its Zoning By-law No. 2387; THEREFORE, the Council of the Corporation of the Municipality of Bayham enacts as follows: 1. THAT By-law No. 2387, as amended, is hereby further amended by amending Schedule "A", Map No. 6 by deleting from the Agricultural (Al)Zone and adding to the Special Rural Residential (RR)Zone, those lands outlined in heavy solid lines and marked RR-30 on Schedule "A" to this By-law, which schedule is attached to and forms part of this By-law. 2. THAT By-law No. 2387, as amended, is hereby further amended by amending Section 7, "Rural Residential" (RR)Zone Regulations by adding a new subsection to Section 7.13,EXCEPTIONS as follows: "7.13.30 7.13.30.1 Defined Area RR 30 as shown on Schedule"A", Map No. 6 to this By-law. 7.13.30.2 Minimum Lot Frontage 46 metres (151 feet)." 3. THAT By-law No. 2387, as amended, is hereby further amended by amending Schedule"A", Map No. 6 by deleting from the Agricultural (Al) Zone, the Special Rural Commercial (RC-1)Zone, and the Rural Residential (RR) Zone, and adding to the Special Agricultural (A1-72)Zone those lands outlined in heavy solid lines and marked A1-72 on Schedule"A" to this By-law, which schedule is attached to and forms part of this By-law. 4. THAT By-law No. 2387, as amended, is hereby further amended by amending Section 5, Agricultural (A1)Zone Regulations by adding a new subsection to Section 5.11,EXCEPTIONS, as follows: "5.11.72 5.11.72.1 Defined Area A1-72 as shown on Schedule"A", Map No. 6 to this By-law. 5.11.72.2 Minimum Lot Area 5.6 hectares (14 acres) 5.11.72.3 Minimum Lot Frontage 150 metres (492 feet) BY-LAW NO. THIS By-law comes into force: a) where no notice of objection has been filed with the Municipal Clerk within the time prescribed by the Planning Act and regulations pursuant thereto, upon the expiration of the prescribed time; or b) where notice of objection has been filed with the Municipal Clerk, within the time prescribed by the Planning Act and regulations pursuant thereto, upon the approval of the Ontario Municipal Board. READ A THIRD TIME AND FINALLY PASSED THIS 6th day of May, 1999. � , ,�� . 4 1 R LERK BY-LAW NUMBER Z407-99 EXPLANATORY NOTE The purpose of this By-law is to: 1) Change the zoning on a parcel of land comprising approximately 2.28 hectares (5.43 acres) situated on the west side of Elliott Line, south of Green Line, in Part Lot 15, Concession 10 in the Municipality of Bayham from the Agricultural (A1) Zone and the Rural Residential(RR)Zone to a Special Rural Residential (RR-30) 2) Change the zoning on a parcel of land comprising approximately 5.84 hectares (14.43 acres) situated on the west side of Elliott Line, south of Green Line, in Part Lot 15, Concession 10 in the Municipality of Bayham from the Agricultural(Al) Zone, the Rural Residential(RR)Zone and the Special Rural Commercial (RC-1) Zone to a Special Agricultural (A1-72)Zone. The effect of this by-law will be to fulfil the condition of severance imposed by a Decision of the County of Elgin Land Division Committee for the severance of a residential lot with an existing residential dwelling.
