HomeMy WebLinkAboutZoning By-law No. Z413-1999 MUNICIPALITY OF BAYHAM CLERK'S CERTIFICATE Section 34(2) of the Planning Act,R.S.O. 1990, Chapter P.13 I, Maureen Beatty, Co-ordinator of Planning and Deputy Clerk hereby certify that the notice for By-law No. Z413-99 of the Corporation of the Municipality of Bayham passed by the Council of the Corporation on the 19th day of August, 1999 was given in the manner and form and to the persons prescribed by regulations made by the Lieutenant Governor-in-Council under Section 34(18) of the Planning Act. 1 also certify that the 20 day appeal period expired on the 12th day of September, 1999 and to this date, no notice of objection has been filed by any person in the office of the Clerk. By-law No. Z413-99 is in full force and effect. Dated at the Municipality of Bayham this 1a day of October, 1999. i✓cacueti, Co-ordinator of Pia ning & Deputy Clerk File: D1.4 Paul& Mary DeCloet Cert413 THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO.Z413-99 (Paul and Mary DeCloet) BEING A BY-LAW TO AMEND BY-LAW NO. 2387 WHEREAS the Council of the Corporation of the Municipality of Bayham deems it necessary to amend its Zoning By-law No. 2387; THEREFORE, the Council of the Corporation of the Municipality of Bayham enacts as follows: 1. THAT By-law No. 2387, as amended, is hereby further amended by amending Schedule "D", Map No. 1 by deleting from the Future Development (FD)Zone and adding to the Hamlet Residential (HR)Zone, those lands outlined in heavy solid lines and marked HR on Schedule "A" to this By-law, which schedule is attached hereto and forms part of this By-law. 2. THAT By-law No. 2387, as amended, is hereby further amended by amending Schedule "D", Map No. 1 by adding a holding symbol "h"to the Hamlet Residential (HR) Zone, applying to those lands outlined in heavy solid lines and marked HR(h) on Schedule "A" to this By-law, which schedule is attached hereto and forms part of this By-law. 3. THAT By-law No. 2387, as amended, is hereby further amended by amending Schedule "D", Map No. 1 by deleting from the Future Development (FD)Zone and adding to the Special Future Development (FD-1) Zone, those lands outlined in heavy solid lines and marked FD-1 on Schedule "A" to this By-law, which schedule is attached hereto and forms part of this by-law. 4. THAT By-law No. 2387, as amended, is hereby further amended by amending Section 16, Future Development (FD)Zone Regulations by adding a new subsection to Section 16.3, EXCEPTIONS as follows: "16.3.1 16.3.1.1 Defined Area FD-1 as shown on Schedule "D", Map No. 1 to this By-law 16.3.1.2 Minimum Lot Area 1.1 hectares (2.75 acres) 16.3.1.3 Minimum Lot Frontage 163 metres (534 feet)" BY-LAW NO. Z413-99 Page 2 2. THIS By-law comes into force: a) where no notice of objection has been filed with the Municipal Clerk within the time prescribed by the Planning Act and regulations pursuant thereto, upon the expiration of the prescribed time; or b) where notice of objection has been filed with the Municipal Clerk, within the time prescribed by the Planning Act and regulations pursuant thereto, upon the approval of the Ontario Municipal Board. READ A FIRST AND SECOND TIME this 190'day of August, 1999. READ A THIRD TIME AND FINALLY PASSED this 19th day of August, 1999. .�,. 11//,":„ 1 'irj ` C ERK BY-LAW NUMBER Z413-99 EXPLANATORY NOTE The purpose of this amendment is to change the zoning on a parcel of land comprising approximately 1.6 hectares (4.0 acres) situated on the north side of Eden Line (County Road No. 44), west of Plank Road (County Road No. 19)in part Lot 22, Concession 9 in the Municipality of Bayham, from the Future Development (FD)Zone to the Hamlet Residential (FIR and HR[h])Zone. The effect of this By-law will be to facilitate the creation of two (2)new residential lots to be situated within the Hamlet of Eden.
