HomeMy WebLinkAboutZoning By-law No. Z497-2005 MUNICIPALITY OF BAYHAM CLERK'S CERTIFICATE °J`°O'tu�ity Section 34(22) of the Planning Act, R.S.O. 1990, Chapter P. 13 I,Margaret Underhill, Planning Coordinator and Deputy Clerk hereby certify that the notice for By-law No. Z497-2005 of the Corporation of the Municipality of Bayham passed by the Council of the Corporation on the 3rd day of March 2005 was given in the manner and form and to the persons prescribed by regulations made by the Lieutenant Governor-in-Council under Section 34(18) of the Planning Act. I also certify that the 20 day objection period expired on the 29th day of March 2005 and to this date, no notice of objection has been filed by any person in the office of the Clerk. "Anal /- Al fC, ,� 'hen ing Coordinator/Deputy Clerk File: D14.MART THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO.Z497-2005 BEING A BY-LAW TO AMEND BY-LAW No.Z456-2003,AS AMENDED WHEREAS the Council of the Corporation of the Municipality of Bayham deems it necessary to amend Zoning By-law No.Z456-2003,as amended; THEREFORE,the Council of the Corporation of the Municipalityof Bayham enacts as follows: 1) THAT By-law No.Z456-2003,as amended,is hereby further amended by amending Schedule"A", Map No.9,by removing from the Agricultural(Al)Zone,and adding to the site-specific Agricultural (Al-18)Zone,those lands that are outlined in heavy solid lines and marked Al-1S on Schedule"A"to this By-law,which schedule is attached to and forms part of this By-law. 2) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Section 5 — Agricultural(Al)Zone,by adding the following new subsection: "5.11.18 5.11.18.1 Defined Area Al-18 as shown on Schedule"A",Map No. 9 to this by-law 5.11.18.2 Minimum Lot Area 5.5 hectares 5.11.18.3 Permitted Uses Animal kennel with a maximum number of dogs not exceeding ten(10)in the first year of operation and not exceeding twenty(20)dogs in the second year of operation and beyond; All other uses permitted in the Al Zone 5.11.18.4 Supplemental Reeulations Any building or structure associated with an animal kennel shall be setback a minimum of 150 metres from the nearest neighbours dwelling." 3) THIS By-law comes into force: a) Where no notice of objection has been filed with the Municipal Clerk within the time prescribed by the Planning Act and regulations pursuant thereto upon the expiration of the prescribed time; or b) Where notice of objection has been filed with the Municipal Clerk within the time prescribed by the Planning Act and regulations pursuant thereto, upon the approval of the Ontario Municipal Board.
