BY-LAW NO. 2018-067
BEING A BY-LAW TO AUTHORIZE THE EXECUTION OF AN AGREEMENT
BETWEEN THE MUNICIPALITY OF BAYHAM AND VANBREE DRAINAGE
AND BULLDOZING LIMITED FOR THE PROVISION OF DRAINAGE WORKS
FOR THE FERNLEY DRAIN IMPROVEMENTS IN THE MUNICIPALITY OF
BAYHAM PURSUANT TO PROVISIONS OF THE DRAINAGE ACT, CHAPTER
D.17, R.S.O. 1990 AS AMENDED.
WHEREAS the Council of the Municipality of Bayham deems it expedient to authorize
the Mayor and Clerk to enter into and execute a contract on behalf of the Municipality,
for the provision of drainage works of the Fernley Drain Improvements based on and in
accordance with the terms and conditions of the tender accepted;
AND WHEREAS the Corporation of the Municipality of Bayham (the "Municipality")
desires to enter into an agreement with VanBree Drainage and Bulldozing Limited for
construction of the Fernley Drain Improvements in accordance with the Contract as
prepared by Spriet Associates;
THEREFORE, the Council of the Corporation of the Municipality of Bayham enacts as
follows:
1. THAT the Municipality enter into and execute an agreement with VanBree
Drainage and Bulldozing Limited for construction of the Fernley Drain
Improvements in accordance with the Contract attached hereto as Schedule "A"
and forming part of this By-Law;
2. THAT the Mayor and the Clerk of the Municipality are hereby authorized and
directed on behalf of the Municipality to execute all documents as may be
required to give effect to these presents;
3. THAT this by-law shall come into full force and effect upon final passing.
READ A FIRST SECOND AND THIRD TIME AND FINALLY PASSED THIS 7th DAY
OF JUNE, 2018.
