C-07 / D13.WELLS Roll # 3401-000-004-06401 SUBJECT: Rezoning Application —Wells BACKGROUND: Teresa Wells submitted a rezoning application to rezone her property located on Part Lot 131, Concession 6, on the south side of Heritage Line, east of Toll Gate Road and known municipally as 57329 Heritage Line. A statutory planning public meeting was held on December 17, 2015 at 7:30pm to consider the rezoning. No comments received at the public meeting. At the time of this report, there are no public comments received. THE PURPOSE of this By-law is to change the zoning on a 0.42 hectare (1.03 acre) parcel of land, from the Rural Industrial (M2) Zone to a site-specific Rural Residential (RR-##) Zone in Zoning By-law Z456-2003. The subject lands are located on Lot 131, Concession 6, on the south side of Heritage Line, east of Toll Gate Road and known municipally as 57329 Heritage Line. THE EFFECT of this By-law will be to permit the existing single detached residential dwelling and accessory uses; and recognize the existing lot frontage of 44 m whereas 50 m is required and the existing accessory building setback on the westerly lot line of 0.9 metres whereas 3.0 metres is required in the Rural Residential (RR) Zone. DISCUSSION The owner wished to rezone the property from Industrial to Rural Residential as the existing zoning applied to a business established in 1973 that no longer operates. As the planner's memorandum dated December 4, 2015 states, the proposed zoning is better suited to its primary purpose and to the agricultural surroundings. Wells-Application for Zoning By-law Amendment Concession 6 Part Lot 131 57329 Heritage Line 1. We have completed our review of the Zoning By-law amendment submitted by Teresa R. Wells for property located at Concession Part Lot 131 on the south side of Heritage Line. The applicant is requesting a change in the zoning from Rural Industrial (M2) to site-specific Rural Residential (RR-4#) zone in Zoning By-law Z456-2003. The site specific zone regulations would recognize the existing lot frontage of 44 m instead of 50 required and an existing setback of 0.9 m instead of 3.0 m required for the an accessory building in the Rural Residential (RR)Zone. The site is designated"Agriculture"on Schedule"Al" Land Use of the Official Plan. Heritage Line is designated a county road on the same schedule. The lands are zoned Rural Industrial (M2) in Zoning By-law Z456-2003. 2. Lot has frontage or 44.4 m and lot depth of 105.6 m for an area of 0.46 ha. The rear part of the lot is bounded by a drainage ditch. The site is relatively flat with no topographic constraints to development. Existing buildings include a dwelling; manufacturing shop; storage areas and a barn. No new buildings are proposed. Servicing is provided through a private well and private septic system. No change is proposed to the existing servicing systems. The lot has one access to Heritage line. The change in land use will likely reduce the volume of traffic with the removal of the industrial land uses. Safe access does not appear to be a concern. 3. The existing zoning established in 1973, allows Industrial Use, General and Industrial Use, Light, an accessory Commercial use and an accessory single detached dwelling. The existing zoning allows a broad range of industrial uses which may impact surrounding agricultural uses through emissions, traffic, noise and related matters. The existing dwelling is accessory to the main industrial use. The requested zoning change is more in keeping with the surrounding agricultural land use. The retained buildings will become accessory to the residential land uses. 4. The existing lot frontage of 44.4 m is less than the required lot frontage of 50 m in the Rural Residential zone. The difference is 5.6 m and will not affect the safety or access function of the lot width. It is appropriate to recognize the existing lot frontage. Secondly, an existing building has a side yard setback of 0.9 m instead of 3.0 m required in Section 7.11. The existing building does not appear to impact the property to the west as there are no buildings on the abutting property. It is appropriate to recognize the existing structure. Any new accessory buildings should meet the minimum setback requirements. 5. The Official Plan designates these land Agriculture. The primary intent is to protect the long term use for agricultural purposes. The requested change in use will reduce the potential impact on the surrounding agricultural land uses. As per Section 2.1.8 the lot existing at the date of adoption of the Official Plan may be recognized for residential use. No building permit IBI Group is a group of firms providing professional services and is affiliated with IBI Group Architects IBI GROUP MEMORANDUM 2 Municipality of Bayham—December 04,2015 is required and the existing dwelling has water and septic services. No change is proposed to the residential land use. The zoning amendment conforms to the intent of the Official Plan policies. 6. Provincial Policy Statement 2014 is intended to protect agricultural areas for long term agricultural land use. The requested zoning by-law amendment to recognize the existing dwelling unit and remove the permitted industrial zoning is consistent with this policy. There will be less potential impact from the single detached dwelling than from the permitted industrial land uses. 7. Conclusion: a. The zoning by-law amendment is appropriate for the development of the lot to recognize a single detached dwelling as the primary land use; the reduced lot frontage; and the existing location of an accessory building. b. The zoning by-law amendment conforms to the intent and purpose of the Official Plan to protect the existing agricultural land uses by not expanding the range of permitted uses. c. The amendment is consistent with the Provincial Policy Statement 2014.
