HomeMy WebLinkAboutPort Burwell By-Laws 1980 Port Burwell BY rd Laws 4. 4 '.. t } By-Laws # 330- 374 1980 - - 1981 go-by BY-LAW # 330 CORPORATION OF THE VILLAGE OF PORT BURWELL THE COUNCIL OF THE CORPORATION OF THE VILLAGE OF PORT BURWELL ENACTS AS FOLLOWS: 11111 1. that, effective January 1st, 1980, the following rates shall be paid per Council Meeting to Council Members, to include REGULAR AND SPECIAL COUNCIL MEETINGS, held in the Village of Port Burwell, and to exclude Committee Meetings: REEVE $50.00 COUNCILLORS $35.00 2. that, effective January 1st, 1980, the following rates shall be paid to Council Members for attendance at out-of-town meetings: Reeve: $50.00 per day, plus receipted expenses Council: $35.00 per day, plus receipted expenses 3. that effective January 1st, 1980, Council Members who drive their own automobiles to out-of-town meetings be paid a mileage allowance of $.202 per mile. 4. that one-third of such payments to Council Members, plus mile- age allowance be deemed to be for expenses, incident to the " discharge of their duties. 5. that all former By-Laws and Resolutions of the Village of Port Burwell Council, respecting remuneration to Council Members, be and are hereby repealed. Qit ' Reeve 41/ . Ai CORPORATION OF THE VILiJAGE Or PORT BURWELL HARBOUR COMMITTEE GUIDELINESS I. Regular Meetings of the Harbour Committee will be held each month, with all seven members present. (Reeve, Ex-Officio, one Councillor, 5 Members) 1. A quorum shall consist of four members, one of whom must be a mem- ber of Council. 1111/ 2. The Agenda for the meeting will be in each member's hands, one week prior to the meeting. 3. Each item on the Agenda shall be fully discussed and resolved, if possible. If not, the item will'be tabled for the next meeting and brought up at each successive meeting, until such time as a decision • has been reached. 4. Any member who is required to make a report to the Committee, who finds he cannot attend the meeting, shall either ask for a postpone- ment of the meeting, or, present a written report to the Chairman, prior to the meeting, in order that it may be read. 5. The Harbour Committee shall present to the Council, a copy of the Minutes, containing all decisions and suggestions made in business of the meetings. II. The Harbour Committee shall assist, whenever required, in dredging opera- tions and Harbour Development. 1. The Committee shall accept the physical, but not the financial res- ponsibility of the dredge and work boat, keeping Council aware of all related requirements. 2. No debt or obligation shall be incurred by the Harbour Committee and no payments shall be made. by or on behalf of the Committee, unless duly authorized by resolution of Council. 3. The Harbour Committee may solicit, or assist Council in obtaining funding for ongoing dredging and Harbour maintenance. The Committee may receive gifts, or bequests, on behalf of the Village, to be applied to the furtherance of harbour development. III. The Harbour Committee shall watch over all harbour activity and advise Council of any problems that arise, giving estions as to any required action. 1. The Committee shall assist the Wharfinger in the pursuit of his duties. 2. The Committee shall keep in close contact with the Fishermen to ensure that any problems that they have to be discussed, are, if not resolved, at least brought to Council's attention. IV. The Harbour Committee shall actively support and promote harbour activities, working in conjunction with the Recreational Board,when so required. V. The Harbour Committee shall foster and gather as much information as pos- sible, to promote any harbour-related commercial or recreational enterprise, thus acting as a minor type of "Chamber 'of Commerce", for the Village. VI'. In carrying out their duties, the Harbour Committee shall, at all times, be the agent of the Municipal Corporation and while acting on the Committee, no member shall incur any liability by reason of anything done or left undone by the Committee. THE CORPORATION OF THE VILLAGE OF PORT BURWELL BY-LAW NO. 3.L9 3 'S A BY-LAW to close part of Wellington Street, in the Village of Port Burwell. WHEREAS under The Municipal Act, R.S.O. 1970, Chapter 284, the Council of every municipality may pass by-laws to close or stop-up any.highway within the municipality. AND WHEREAS it is deemed expedient to close and stop-up a certain part of Wellington Street according to Registered Plan No. 12 for the Village of Port Burwell. AND WHEREAS the effect of this By-Law will not deprive any person of means of engress and egress to and from his lands. AND WHEREAS notice of intention to pass this by-law was duly advertised in the Tillsonburg News, being a newspaper with general circulation in the community, once a week for four successive weeks, commencing November 2nd, 1979. BE IT THEREFORE ENACTED by the Council of the Corporation of the Village of Port Burwell as follows: 1. WHEREAS Sections 8, 12, and 27 of the Public Utilities Act, R.S.O. 1970, Chapter 390, authorizes the Corporation to pass by—laws to regulate the supply of water and to fix the price to be paid therefore; 11110 AND WHEREAS The Corporation of the Village of Port Burwell on 16 September 1969 entered into an Agreement with Her Majesty the Queen in Right of Ontario as represented by the former Ontario Water Resources Commission, by the Minister of the Environment for the supply of water to the Municipality; AND WHEREAS the Council of the Corporation of the Village of Port Burwell on 11 November- 1971 passed By—Law No. 259 which was subsequently approved by the Ontario Municipal Board and which imposes water rates on all users of the water system to raise funds for purposes of making payments to the Treasurer of Ontario under the agreement; AND WHEREAS it is deemed expedient by the Council of the Corporation of the Village of Port Burwell that a new By—Law be passed establishing increased water rates to be imposed against each user of the system provided with water service; NOW THEREFORE, Pursuant to Sections 8, 12, and 27 of the Public Utilities Act, the Council of the Corporation of the Village of Port Burwell enacts as follows: 1) A water rate is hereby imposed upon the owners or occupants of lands which are supplied with water as a consequence of the entering into the above mentioned water service agreement by the Corporation of the Village of Port Burwell. 2) The water rate shall be charged as follows: (a) A flat water rate of $ 126.00 per year, with a charge of $ 10.50 per month, billed bi—monthly, to each user (including cottagers) in respect to lands which are used for purposes other than Commercial and Industrial, and (b) A water rate of $ 2.82 per 1000 gallons of metered water consumption to each user in respect of land which is used for Commercial or Industrial purposes; with a minimum charge of $ 12.00 per month, billed monthly. 3) This By—Law rescinds and supercedes all other By—Laws, which contravene the above rates, and comes into effect on the repeal by the Council of the Corporation of the Village of Port Burwell of By—Law # 259 passed 11 November 1971. THE VILLAGE OF PORT BUR JELL BY LAW # Being a By Law with respect to the appointment of a Wharfinger for the Village of Port Burwell • WHEREAS it is expedient that the Council of the Village of Port Burwell initiate the appointment of a person to be responsible for the collection of Harbour and Dockage fees, for water craft using the Port Burwell Harbour; and WHEREAS the Village of Port Burwell has assumed the responsibility for same through a sub—lease agreement with the Ministry of Fisheries and Environment Canada, Fisheries and Marine — Small Craft Harbours Branch; and WHEREAS the Port Burwell Harbour Committee, by resolution dated 15 May 1980, has recommended that Mr. Phil Bucheski be appointed as Village Wharfinger; THEREFORE, the Council of the Village of Port Burwell enacts as follows: THAT Mr. Phil Bucheski is hereby appointed Wharfinger for the Village of Port Burwell. THAT Mr. Phil Bucheski's duties will be to enforce the general rules and regulations regarding the Harbour, and collect Wharfage in accordance with the Fishing and Recreational Harbours Regulations. THAT Mr. Phil Bucheski's appointment shall remain in effect from year to year unless repealed or otherwise amended by Council. Constructed so that the shortest dimension of any opening in the fence does not exceed 4 inches. c. Constructed so that any fence—post or other structural member of the fence to which any wire, boards or other materials are attached, are on the pool side of such wire, boards or other material. d. Constructed so that it cannot be used in a manner similar to a ladder. e. Constructed so that the only means of ingress and egress from the area enclosed by the fence shall be through doors or gates constructed in accordance with paragraph 3 below. 3. Every gate included in a fence required by this by law shall be: a. Constructed in accordance with paragraphs 1 and 2 above. b. Constructed so that any structural member of the gates to which wire, boards or other materials are attached are on the pool side of such material. c. Equipped with self—closing and latching devices so that, when not in use, the gate is at all times closed and latched. Such latching device shall be located at the top of the gate on the pool side. Property fences shall not be considered a pool fence unless, in the opinion on the building inspector, the fence is close enough to the pool to serve the same purpose. 5. Cases of dispute may be referred to the Council. 6. Fences shall be completely erected as follows: a. In the case of swimming or other pools constructed after the passing of this by law, at the time the pool is installed, or not later than seven days thereafter. b.
