WHEREAS Sub-Section 2 of Section 4 •f the Emergency Measures Act states that each municipality is responsible to formulate a plan for the continued functioning of Municipal Government and the necessary services of the municipality in the event of an emergency. NOW THEREFORE IT IS HEREBY ENACTED by the Council of the Village of Port Burwell as follows; 1. The Peacetime Emergency Plan with Annexes A, B and C, is hereby adopted as the Peacetime Emergency Plan for the Village of Port Burwell. AND WHEREAS for the purpose aforesaid it is now expedient to issue debentures in the amount of $51,000 pay- able in lawful money of Canada on the terms hereinafter set forth; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE VILLAGE OF PORT BURWELL ENACTS AS FOLLOWS: 1. For the purpose aforesaid, there shall be borrowed upon the credit of the Corporation at large the sum of $51,000 in lawful money of Canada, and the Corporation shall issue debentures therefor in denominations of not less than $50 each. 2. The debentures shall be dated the 15th day of July, 1975, shall be issued at one time and shall be payable in ten annual instalments of principal on the 15th of July in each of the years 1976 to 1985, both inclusive, and shall bear interest payable semi-annually. The debentures maturing in the years 1976 to 1980, both inclusive, shall bear interest at the rate of 9-1/2% per annum and the debentures maturing in the years 1981 to 1985, both inclusive, shall bear interest at the rate of 9-3/4% per annum. The debentures shall have coupons attached for the payment of such interest on January 15 and July 15 in each year. The respective amounts of principal and interest payable in each of such years shall be as set forth in Schedule "A" hereto annexed and forming part of this by-law. 3. The debentures shall be payable as to both principal and interest in lawful money of Canada at the Canadian Imperial Bank of Commerce in the Village of Port Burwell or at the principal office of the said Bank in either of the cities of Toronto or MOntreal, at the holder's option. 4. The debentures shall be sealed with the seal of the Corporation and signed by the head of the Council or by some other person authorized by by-law to sign them and by the Treasurer, and the interest coupons attached thereto shall be signed by the Treasurer. The signature of the head of the Council to the debentures and the signature of the Treasurer on the interest coupons may be written or engraved, litho- graphed, printed or otherwise mechanically reproduced. 5. Commencing in the year 1976, and thereafter in each . year during the currency of the said debentures, there shall be levied and raised by a special rate sufficient therefor, over and above all other rates, on all the rateable property in the municipality, the amount of the instalment of principal and interest payable in that year as set forth in Schedule "A" hereunto annexed; but no greater rate shall be levied in any year for such purpose than is required to pay the instalment after taking into account receipts from any other source in respect of the said work. - 2 - 6. The debentures may contain any provision for their registration authorized by law. 7. Pending the sale of the said debentures, the head of the Council and the Treasurer may raise for the purposes aforesaid by way of loan on such debentures any sum or sums of money not exceeding in all the sum hereby authorized to be borrowed and may hypothecate such debentures for such loan. 1110 8. The holder of any debenture of the denomination of more than $1,000 issued under the authority of this by-law may exchange such debenture for debentures of the denomination of $1,000 upon surrender of such debenture to the Treasurer of the Corporation. Debentures issued in substitution for any such debenture surrendered shall bear the same interest rate and maturity date and be the same in every respect except in denomination to such debenture surrendered. Only one such exchange shall be permitted with respect to each debenture of the denomination of more than $1,000 issued hereunder and the cost of such exchange including printing of the new denomina- tions of debentures shall be borne by the Corporation. WHEREAS The Municipal Act, R.S.O. 1970,Chapter 284, Section 354 (1) 39, authorized the councils of local munici_alities to require buildings and 11111 yards to be put in a safe condition to guard against fire or other dangerous risk or accident. AND WHEREAS it .is deemed advisable to exercise the authority conferred by the said section within-the municipality. NOW THEREFORE the Corporation of the .4/4.4(4506 of ...l:O.i ...844,YH/L JJ EI ACTS AS rULLGWS:- 1. In this by-law "person" means every natural person, firm, co-partnership, association or corporation. 2. Igo person shall allow or permit any building or yard to be or remain in an unsafe condition by feiline to guard against fire or other dangerous risk or accident. 3. For purposes of this by-law, the creation, presence or existence of any of the following conditions in or upon any yard, lot or grounds shall be deemed to create an unsafe condition from fire or other dangerous risk or accident hereunder:- a) Inflammable refuse, long grass or untrimmed underbrush. b) Timber, lumber, and uncovered or unbleached firewood or other wood products. c) An unfenced or unprotected excavation. d) A building, part or all of which is liable to collapse from snow, wind, human occupancy or other causes. e) Machinery, automotive er.iipment or the like in disuse which is not properly enclosed and protected. f) Any other circumstance whatever that creates or is likely to create an unsafe condition from fire or other dangerous risk or accident. 4. Any person violating this by-law shall be subject to a penalty of S....5 2O... for the first offence and not more than sq 0 D Q... for each subsequent offence, exclusive of costs, and all such penalties shall be recoverable under the Summary Convictions Act. . That Council on the recommendation of the h:edical Officer of Health, and/or the Fire Chief, Shall by prepaid registered post notify the owner of any grounds, yards, and vacant lots to drain, fill up, clean, or clear such grounds as required.. 6. If are' building, yard, lot or grounds is or remains in an unsafe condition ten (10) days after the mailing of the said notice thereof, then the Corporation itself may remedy the condition in such manner as it sees fit and charge the cost thereof to the owner. If the owner fails to pay the cost thereof to the Corporation within thirty (30) days of the mailing of account therefor, the.Corporation may add the cost to the municipal taxes to be levied against the property on the next tax roll of the Corporation and the same shall be recoverable in the same manner as municipal taxes.
