WHEREAS Section 363 of the Municipal Act , R . S . O . 1990 2pterM . 45 , provides that Councils of municipa ties may pass by-laws placing limits on the amount of increases and decreases in taxation arising from a general assessment on a basis different from that for the previous year ' s taxes . * -- NOW THSRSii'ORB the Council of the corporation of the r village of Vienna enacts as follows : 1 . This by-law shall apply to each separately assessed parcel of rateable property in the Village in Cldsa " 2 " ( multi-residential ) for which taxes have increased in respect to that parcel , by at least 10 percent , as a result of the county-wide reassessment h implemented for purposes of taxation in 1993 . 2 . Except for the tax adjustments specified under clauses 3 , 4 , and 5 , the taxes payable on each parcel . of rateable property in Class " 2 " ( multi - residential ) , for the years 1993 to 1996 inclusive , shall be based on the application of .all mill rates for Village , County and school purposes applied to the assessment upon each property as contained in the last returned assessment roll each year . • � 3 . The taxes payable in 1993 on each property specified � in clause 1 . shall be adjusted by deducting 75 per cent of the total increase in taxes solely, attributable to the reassessment undertaken in 1992 . 4 . The . taxes payable in 1994 on each property specified in clause 1 . shall be adjusted by deducting 50 per cent of the total increase in taxes solely attributable to the reassessment undertaken in 1992 . 5 . The taxes payable in 1995 on each property specified in clause 1 . shall be adjusted by deducting 25 per �cent of the total increase in taxes solely attributable to the reassessment undertakes in 1992 . 6 . There shall be . no tax adjustment applied in respect to the properties spAoifie!l .in clause 1 . in 1996 , and thereby the full amount of the increase attributable � to the county-wide reassessment shall be payable in 1996 . . 7 . NOTWITHSTANDING the provisions of Clause 1 of this By- law , any additional taxes payable as a result of additions to the roll pursuant to section 83 of the Assessment Act , P . S . The Collector is hereby authorized to mail , deliver or cause to be mailed or delivered , the notice of taxes _ clue to the address of the residence or place of husinesi of the person to whom such notice is required to be given . 5 . Taxes shall be payable at par to the Corporation of the Village of Vienna at the Clerk ' s Office or by mail. to p . 0 . • Box 133 , Vienna , Ont . NOJ 1Z0 . • 6 . There shall be imposed as a penalty for nonn+paytent of taxes or any class or instalment thereof on tbn due date as specified in Clause 3 of this By- law , as the case may be a percentage charge of one and one quarter percent ( 3 . 25 % ) i • en the first day next after the appropriate due date , which shall be the first day of default and an additional penalty of one arid one quarter percent ( 1 . 25 % ) shall be added on the first• day of each calendar month thereafter in which said default continues , but not after December 31 in the year in which the said taxes are levied . WHEREAS it is deemed expedient in the interest of the Corporation of the Village of Vienna , hereinafter called 'E o - the Corporation , that the original road allowance set out and described as the portion of the alley between Union Street and Pine Street , Registered Plan 54 , designated as Parts 3 and 4 , Reference Plan 11115413 „ • I Village of Vienna , County of Elgin , be stopped up and closed and the lands sold to the adjoining land owners AND WHEREAS notice of this by- law has been posted up for • at least one month in six of the most public places in the 4 immediate neighbourhood of the said road allowance AND WHEREAS the Council of the said Corporation has heard in person or by his counsel , solicitor or agent , all persons claiming that their land will prejudicially he affected by this by- law , and who has applied to be heard NOW THEREFORE the Council of the Village of Vienna enacts as follows : 1 . That upon and after the passing of this by- law , all that portion of the road allowance for the alley set out and described above , be and is hereby stopped up 10 and closed . f }a 2 .
