Hartmann Seconded by: H. Ferris Being a by-law for Village Council to appoint Municipal Officers for the year 1968 through authority vested in Municipal Councils by the Municipal Act. Whereas the Council of the Bnnioipality of the Village of Vienna (hereinafter called the "Municipality") deems it necessary to borrow the sum of $ 12.000. to meet, until the taxes are collected, the current expenditures of the Municipality for the year; Non.—Ede. The Head and the Treasurer are hereby authorized on behalf of the Municipality to borrow from time to time by way of promissory note from CANADIMiiMP6ML. BANE OF COMMERCE a sum or sums not exceeding in the aggregate $ to meet until the taxes are collected the current expenditures of the Municipality for the year,including the amounts required for the purposes mentioned in subsection (1) of Section 329 of the Municipal Act, and to give on behalf of the Municipality to the Bank a promissory note or notes sealed with the Corporate Seal and signed by the Head and Treasurer for the moneys so borrowed, with interest,which may be paid in advance or otherwise,at a rate not exceeding per centum per annum. 2. All sums borrowed pursuant to the authority of this by-law,as well as all other sums borrowed in this year and in previous years from the said Bank for any or all of the purposes mentioned in the said Section 329, shall, with interest thereon, be a charge upon the whole of the revenues of the Municipality for the current year and for all preceding years as and when such revenues are received. 3. The Treasurer is hereby authorized and directed to apply in payment of all sums borrowed as aforesaid, together with interest thereon, all of the moneys hereafter collected or received either on account or realized in respect of taxes levied for the current year and preceding years or from any other source which may lawfully be applied for such purpose. 68 Passed this 2nd• day of January 19 4... This permit to be issued at the discretion of Council for a fee of $20.00 per annum to be renewed annually by January 1st. 3. Any lands used for the above mentioned purposes prior to the passing of this by-law are subject to the provisions of this by-law. 4. Any lands used for the above mentioned purposes shall be enclosed by an upright well supported 8 foot solid wooden fence. . Any person violating this by-law shall be subject to a penalty of 10.00 for the first offence and not more than $300.00 for each subsequent offence, exclusive of costs, and all such penalties shall be recoverable under the Summary Convictions Act. CORPORATION OF THE MUNICIPALITY OF VIENNA By-law 658 A by-law to provide for the registration of dogs, the collection of a licence fee from the owners thereof and for regulating the running at large of dogs in the Village of Vienna. WHEREAS it is deemed necessary to pass a by-law to provide for the registration of dogs and the payment of a licence fee by every owner of a dog and to regulate the running at large of dogs in the Village of Vienna. THEREFORE the Council of the Corporation of the Municipality of • Vienna ENACTS AS FOLLOWS: 1. In this by-law and schedule thereto: I (a) "Dog" shall mean any dog, male or female; (b) "Kennel" shall mean a kennel of pure-bred dogs registered in the registrar of the Canadian Kennel Club, Incorporated; h (c) "Owner" of a dog includes any person who possesses or harbours a dog, and "owns" and "owned" have a corresponding meaning; { (d) "Poundkeeper" shall mean the person appointed under the 1' provisions of this by-law as poundkeeper; (e) "Municipality" shall mean the Municipality of the Village of Vienna; (f) "Clerk" shall mean the Clerk of the Municipality. 2. (a) Every owner of one or more dogs shall register on or before the • ' first day of April in each year each dog owned, possessed or harboured by him in the Municipality with the Clerk, or other 11 person designated for that purpose, and at that time pay to i! the Clerk. or such other person, the licence fee prescribed il in schedule 1 to this by-law and the Clerk, or other such 1person designated, shall issue to such owner a receipt w- a acknowledging registration of the dog and the payment of the re'. (b) Every person who becomes the owner of a dog on or after the first day of April in each year shall register the same and pay the licence fee therefore as provide+ in subsection (1) 1 1 within fifteen days after acquiring or otherwise becoming the 1 owner or in possession or commencing to harbour the same. 3. (a) A tag shall be supplied by the Animal Control Officer for each dog with respect to which a licence is issued hereunder, and I1I; the owner shall keep the tag securely fixed on the dog at all times during the year and until he procures a tag for the following year. (b) The said tag shall bear a serial number and the year for which it was issued and a record shall be kept by the Animal Control Officer for the purpose of showing the name and address of the owner and the serial number of the dog. f�i (c) No person shall put upon or fix to a dog a tag unless the same was issued for use upon such dog. ! I 4. (a) The running at large of dogs within the Municipality is prohibited during the months of January to December inclusive 1 yearly, and the owner of any dogs so found running at large shall be guilty of a breach of this by-law and liable on o conviction to the penalty provided in Section 7 hereof. 1, (b) For the purposes of this section a dog shall be deemed to be running at large when found an a highway or other public place and not under the control of any person. (e) TO PROVIDE that dogs when at large shall be restrained upon a leash. Every dog within the Municipality when not visibly confined , : or restrained to the dwelling or property of its' owner or of the person having care and custody of the same, shall at all times be restrained upon leash of some person. By-law 658 -2- 5. (a) The person appointed by the Council as hereinafter provided and hereinafter referred to as the Animal Control Officer, may seize and impound every dog running at large contrary to the provisions of Section 4 hereof. (b) It shall be the duty of the Poundkeeper to provide suitable quarters as may be approved by thy Council in which to keep in a humane manner all the dogs that may be brought to him by the Animal Control Officer for disposal under the provisions hereof. The Poundkeeper shall, in a book to be furnished him by the Clerk, keep an accurate record of all dogs placed in the pound and giving any particulars that the Council may deem advisable. • (0) Every dog seized by the Animal Control Officer under the provisions of subsection (1) hereof and delivered to the Poundkeeper shall by the latter be confined in the pound for forte-eight (48) hours and at the end of such period may, if not redeemed or sold as hereinafter provided, be destroyed by the Poundkeeper and the carcass shall be disposed of to the satis- faction of the Medical Officer of Health for the Municipality. (d) The owner of any dog impounded under the provisions of this by-law may redeem the same within forty-eight (48) hours after its' delivery to the Poundkeeper by paying into the hands of the said officer, for the use of the Municipality unless other- wise provided, the sum of Five dollars ($5.00). If the same is not redeemed by the owner, the Poundkeeper may sell or other- wise dispose of any impounded animal. 6. The Council shall by resolution provide for the appointment of an Animal Control Officer and a Poundkeeper and shall provide for the terms of such appointment. 7. Any person who contravenes any provisions of this by-law or any part thereof shall, upon conviction, be liable to a penalty not exceeding Fifty dollars ($50.00) , exclusive of costs, recoverable under the provisions of the Summary Convictions Act. 8. All by-laws or parts of by-laws heretofore passed inconsistent with the provisions hereof and respecting the registration of dogs and the collection of licence fees, the securing of dog tags, and the running at large of dogs are hereby repealed. SCHEDULE 1 Showing the amount of the fee payable as provided in Section 2 of By-law No. 658 of the municipality of Vienna.
