Whereas provision is made for the eadablishment of a Community Centre in Ontario under the Community Centre's Act 1961, and, '.Whereas it is desired to establish a Community Centre at Vienna, Therefore the Council of the Municipality of Vienna enacts as follows: That a Community centre defined as a Community Fall under the Community Centre's Act, 1961, and the recg-ulations thereunder and that the said. Community Centre be administered by the following board duly appointed for the ensuing year. Y. C . Hartmann Being a by-law to appoint an Assessment Commissioner Whereas by-law 610 designated the appointment of `.tr . Clifford Soper as assessor for the Village of Vienna, and, Whereas the Village of Vienna is disirous of appointing Mr. Clifford roper as assessment commissioner for the said Village. Therefore be it enacted that that portion of by-law 610 appointing Mr . Clifford roper as assessor be repealed and 'T . Hartmann Being a by-law to establish a Centennial nark under the Confederation Centennial Act- ch 19- statutes of Ontario, 1962-63 whereas the Village of Vienna is nesirous of participating in the coTmeration of Confederation L.entennial of 1967, and, Whereas the Village of Vienna is desirous of constructing a park under the terms of the Confederation Centennial Act. Therefore be it enacted that the i.ouncil of the Village of Vienna make application to the Secretary, Centennial Advisory Committee, subject to the hereinafter named conditions: 1. The Council of the Village of Vienna agree to construct a park on parts of lots 6 and 7 north of r'ulton Street; part of lot 12 west of Snow street; and part of lot 12 east of pine Street; all according to registered plan 54 of the Village of Vienna. 2. The Council of the Village of Vienna will expend an amount not exceeding $$400.00 for the proposed. Centennial project. 3. The Council of the Village of Vienna agree that Canadian labour and materials will be used to the extent that is procurable. 4. The Council of the Village of Vienna will commence the proposed project by 1st. of '.Say 1965 and complete by 1st. of December 1965. 5. The Council of the Village of Vienna agree to maintain the proposed park as such upon completion. 6. A. Petrie, Municipal Clerk, P. O. Box 79, Vienna, Ontario. Dear Sir: This refers to your letter of April 9th, with which you enclosed copies of By-law Number 616 of the Village of Vienna. On reviewing the by-law, we find that it would not appear to be entirely in order for approval , the reasons for this being: 1. The definition of "village streets" in section 1 should be replaced by a definition of the term "highway". 2. In section 2, the definition of "motor vehicle" should be replaced by a definition of "vehicle" . A definition of the latter term is considered to be preferable in a traffic by-law since it covers all vehicles except those running upon rails. 3. The definition of "park" in section 3 should be replaced by the definition of that term recommended for inclusion in traffic by-laws. 4. In the paragraph setting forth the parking regulations, the words "no motor vehicle shall be parked on a village street" should be replaced by "no person shall park a vehicle on a highway" . Our solicitors inform us that if the former wording is used, no offence is created. • - 2 - Mr. J. A. I MODEL NUMBER 2 DEPARTMENT OF TRANSPORT A BY-LAW REGULATING PARKING 111 Under pection 108 of The Highway Traffic Act (R.S.O. 1960, Chapter 172) all by-laws providing for the regulation of traffic on highways are required to be submitted to the Department of Transport for approval. In the interests of uniformity, and for the guidance of municipal clerks, the Department has drafted a number of model forms of by-laws. One of these, model number 2, a copy of which is attached, provides for the regulation of parking. Please note: 1. After final passage by Council, duplicate certified copies should be submitted for approval. 2. By-laws should be forwarded to the Department of Transport, Parliament Buildings, Toronto 2. 3. Photostatic copies are not acceptable for Departmental purposes. 0 c APIMINNIMI • MUNICIPALITY OF BY-LAW NUMBER REGULATING PARKING The Council of the Corporation of the Municipality of enacts as follows: DEFINITIONS All For the purpose of this by-law:- Park means the standing of a vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while actually engaged in loading or unloading. Street or highway includes a common or public highway, street, avenue, parkway, driveway, square, place, bridge, viaduct or trestle, designed and intended for, or used by, the general public for the passage of vehicles. Vehicle includes a motor vehicle, trailer, traction engine, farm tractor, roadbuilding machine and any vehicle drawn, propelled or driven by any kind of power, including muscular power, but not including the cars of electric or steam railways running only upon rails. METHOD OF PARKING No person shall park a vehicle on any street other than a one-way street unless on the right hand side of the street having regard for the direction in which the vehicle had been proceeding and unless the right front and right rear wheels or runners of the vehicle are parallel to and distant respectively not more than six inches from the edge of the roadway. PARKING REGULATIONS .. _.iakr PENALTIES Any person violating any of the provisions of this by-law shall be subject to a penalty of not more than Ten Dollars for the first offence and not more than Fifty Dollars for every subsequent offence, exclusive of costs, and all such penalties shall be recoverable • under the Ontario Summary Convictions Act.
