Vienna_ IN rue OP X1gin WHEREAS under The Highway Improvement Act a by-law to provide for ex- penditures on roads or streets may be submitted annually to the Minister of High- ways for approval. THEREFORE the Council of the Corporation of the said Town/Village enacts as follows: • (1) The sum of $ 3.000• _ ... is hereby estimated as the expenditure upon the construction and maintenance of the roads and bridges under its jurisdic- tion during the year 19 as follows: Construction Maintenance Total ROADS $ $ 3,000.00 $ 3,000.00 BRIDGES & CULVERTS S $ $ ENGINEERING & OVERHEADi— TOTALS $ $ 3,000.00/ 3,000.00 (2) The said monies shall be expended on work performed in accordance with The Highway Improvement Act. (3) The clerk shall transmit duplicate copies of this by-law to the district office of the Municipal Roads Branch, Department of Highways Ontario, not later than March 31st, of the said year. (4) The approval of the Ontario Municipal Board shall be obtained before any expenditure is authorized or work commenced which will be financed by the issue of debentures or monies raised in a subsequent year. Clerk • .. • 411 • THE CORPORATION OF THE VILLAGE OF VIENNA BY-LAW No. 602 A By-Law to authorize the acquisition of certain lands from The Vienna and Bayham 1 School Area Board, and to authorize the execution of an agreement with The Vienna and Bayham School Area Board with respect 411 to the use of said lands , and to authorize the construction of a community centre on said lands and the borrowing of funds for the erection thereof. WHEREAS by virtue of Section 333, Sub- Section 1 of The Municipal Act, Revised Statutes of Ontario, 1960, Chap. 249, the Corporation is empowered to acquire land required for the purposes of the Corporation. AND WHEREAS by virtue of Section 377, Sub- Section 69 of the said Municipal Act and I amendments thereto, the Corporation is em- powered to erect a community centre and to borrow money for this purpose. Now therefore be it enacted as By-Law No. 602 of The Corporation of the Village • of Vienna: 1. That the lands set forth in Schedule "A" attached hereto, being parts of Lots 6 and 7 north of Fulton Street, part of Lot 12 west of Snow Street and part of Lot 12 east of Pine Street according to Plan 54 for the Village of Vienna be acquired from The Vienna and Bayham School Area Board without consideration other than the consideration contained fn the agreement between the Corporation and the said Board attached hereto, as Schedule "B". 2. That the said agreement with The Vienna and Bayham School Area Board be approved and the Reeve and Clerk are hereby authorized and directed to execute same on behalf of the Corporation and to affix the Corporate seal thereto. 3. That the Corporation erect on said land a community centre. 4. That to finance the construction of the said community centre the Corporation borrow from the Canadian Imperial Bank of Commerce the sum of $15,000.00, to be repaid in full on or before the 6th day of April, 1967. • • - 2 - 5. This By-Law shall not come into force until the approval of The Ontario Municipal Board and The Department of Municipal Affairs have been obtained. D. 1964. BETWEEN: The Vienna and Bayham School Area Board, hereinafter called the "School Board" OF THE FIRST PART AND The Corporation of the Village of Vienna, hereinafter called the "Village" OF THE SECOND PART WHEREAS the School Board has agreed to convey to the Village parts of Lots 6 and 7 north of Fulton Street, part of Lot 12 West of Snow Street and part of Lot 12 east of Pine Street according to Plan 54 for the Village of Vienna being a parcel of land 66 feet in frontage with a depth of 180 feet. AND WHEREAS the Village plans to erect thereon a community centre for the use of the citizens of the area. AND WHEREAS it has been agreed that the School Board shall have certain rights and privileges in respect to the said community centre as hereinafter set forth. NOW THEREFORE, this Agreement witnesseth that the parties hereto agree as follows: 1. The School Board shall convey to the Village parts of Lots 6 and 7north of Fulton Street, part of Lot 12 west of Snow Street and part of Lot 12 east of Pine Street according to Plan 54 for the village of Vienna more particularly described in conveyance dated April 6th, 1964. 2. The Village shall erect a community centre on said lands. 3. Whereas under the provisions of section 379 of the Municipal tet, the councils of cities, towns , villages, police villages and townships may pass by-laws prohibiting heavy traffic on highways under thlir jurisdiction; And whereas the council of the Corporation of the Municipality of i Vienna deems it expedient to prohibit heavy traffic on certain highways; Now therefore the council of the corporation of the Municipality f. of Vienna enacts as follows . " 1. In this by-law heavy traffic means the use of a highway by a vehicle , object or contrivance for moving loads having a gross weight , including the vehicle , object or contrivance or load in excess of eleven tons. ii 2.
