HomeMy WebLinkAboutBy-law No. 2017-082 THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO. 2017-082 BEING A BY-LAW TO FURTHER AMEND BY-LAW 2016-014 A BY-LAW TO REGULATE TRAFFIC AND PARKING ON HIGHWAYS, PRIVATE PROPERTY AND MUNICIPAL PROPERTY WITHIN THE MUNICIPALITY OF BAYHAM WHEREAS the Council of the Municipality of Bayham on the 3rd day of March, 2016 enacted By-Law 2016-014, being a by-law to regulate traffic and parking on highways, private property and municipal property within the Municipality of Bayham; WHEREAS By-Law 2016-014 was amended by By-Law 2016-038 on the 5th day of May 2016 and further amended by By-Law 2016-075 on the 18th day of August 2016; AND WHEREAS Council is desirous of further amending By-Law 2016-014; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS: 1. THAT Section 1 "Definitions" be amended to include the following definitions: 1.32 "Residential Zone" shall mean any residential zone as designated under any zoning by-law in effect within the Municipality at a specific date and time and as enacted pursuant to the provisions of the Planning Act, R.S.O. 1990, chapter P.13, as amended, or any successor legislation thereto; 1.33 "Rural Residential (RR)Zone" shall mean any rural residential zone as designated under any zoning by-law in effect within the Municipality at a specific date and time and as and acted pursuant to the provisions of the Planning Act, R.S.O. 1990, chapter P.13, as amended, or any successor legislation thereto; 2. THAT Section 1 numbering be adjusted to incorporate the above mentioned definitions; 3. THAT Sections 3.9, 3.10 and 3.11 be amended as follows: 3.9 No person shall park or store a motor vehicle in any residential zone other than a private passenger automobile, motor home, travel trailer, truck camper, school bus or commercial motor vehicle as provided for in sections 3.10 and 3.11 below; 3.10 No person shall park or store a commercial motor vehicle having a gross vehicle weight of greater than four thousand (4000) kilograms in any residential zone unless such commercial motor vehicle is parked or stored in a private garage or an accessory building; 3.11 No person shall park a commercial motor vehicle having a gross vehicle weight of greater than four thousand (4000) kilograms with its engine or other associated mechanical system running and/or operational for a period of time in excess of fifteen (15) minutes in any residential zone other than a Rural Residential (RR)Zone; By-Law 2017-082 4 THAT in all other respects By-Law 2016-014 is hereby confirmed and remains unchanged; 5 AND THAT this by-law shall come into force and take effect upon final passing. READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED THIS 17th DAY OF AUGUST 2017. f MAY
