HomeMy WebLinkAboutBy-law No. 2016-085 AMENDMENT NUMBER 17 TO THE OFFICIAL PLAN OF THE MUNICIPALITY OF BAYHAM SUBJECT: Municipality of Bayham 31 Elizabeth Street, Port Burwell The following text and map schedule constitute Amendment Number 17 to the Official Plan of the Municipality of Bayham OFFICIAL PLAN OF THE MUNICIPALITY OF BAYHAM THE attached text and map schedule constituting Amendment No. 17 to the Official Plan of the Municipality of Bayham was prepared upon the recommendation of the Council of the Municipality of Bayham after evaluation of public input pursuant to the provisions of the PLANNING ACT. THIS Amendment was adopted by the Council of the Corporation of the Municipality of Bayham by By-law No. 2016-085, in accordance with Section 17 of the PLANNING ACT, on the 6th day of October 2016. 41111.1 MAYOR CLERK MUNICIPALITY OF BAYHAM BY-LAW NO. 2016-085 THE Council of the Corporation of the Municipality of Bayham, in accordance with the provisions of the PLANNING ACT, hereby enacts as follows: 1) THAT Amendment No. 17 to the Official Plan of the Municipality of Bayham consisting of the attached map schedule is hereby adopted. 2) THAT the Clerk is hereby authorized and directed to make application to the County of Elgin for approval of the aforementioned Amendment No. 17 to the Official Plan of the Municipality of Bayham. 3) THAT no part of this By-law shall come into force and take effect until approved by Elgin County. CLERK OFFICIAL PLAN OF THE MUNICIPALITY OF BAYHAM AMENDMENT NO. 17 1. PURPOSE The purpose of the official plan amendment is to change the land use designation on approximately 2023.4m2 (21775ft2) of land from the "Institutional" designation to the "Industrial" designation in the Official Plan of the Municipality of Bayham, which would facilitate a change in zoning on the same lands from the Institutional (I) Zone to the Urban Industrial (M4-5) Zone. The intended land use is the outdoor storage of recreational vehicles, boats and rental of large outdoor storage containers and repair\maintenance of boats and equipment. 2. LOCATION The area affected by this amendment is a rectangular parcel of land located on the west side of Elizabeth Street, north of Wellington Street and known municipally as 31 Elizabeth Street in the Village of Port Burwell. 3. BASIS OF THE AMENDMENT The subject lands are characterized as an underutilized institutional use,formerly used as a municipal works yard. Due to the lands being surplus to the needs of the Municipality of Bayham, they are considering selling the lands for private industrial uses. The proposed redesignation of the subject lands would meet the intent of Section 4.2.1.3 and 4.2.3.3 of the Official Plan to encourage new industrial uses in areas with full municipal services, and by creating alternative employment opportunities in the Municipality. In addition, infilling, intensification and redevelopment are supported by provincial and county policy. Section 1.1.3.1 and 1.1.3.4 of the Provincial Policy Statement 2014 states that settlement areas shall be the focus of growth and development,and that regeneration within these areas shall be promoted. Section C1.1.3 of the County of Elgin Official Plan states that that the County objective to encourage and promote development in locations that combine a mix of employment uses to facilitate more efficient use of urban land. Given that the lands are located within an area designated "Village", with full municipal services, the application meets the general intent of the policies of the Municipality of Bayham Official Plan, Elgin County Official Plan, and Provincial Policy Statement 2014, insomuch that it promotes redevelopment, intensification and the use of existing municipal services. 4. DETAILS OF THE AMENDMENT a) Schedule "D" Municipality of Bayham: Land Use of the Official Plan of the Municipality of Bayham is hereby amended by changing from "Institutional" to "Industrial" those lands outlined and marked as changed to "Industrial" on the attached Schedule "A", which shall constitute part of this amendment. b) The lands subject to this Amendment and designated "Industrial" may be used, developed and zoned in accordance with the "Industrial" designation policies of Section 4.5.6 of the Official Plan, as amended.
