HomeMy WebLinkAboutBy-law No. 2015-009 THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW 2015-009 BEING A BY-LAW TO STOP UP AND CLOSE PART OF THE UNOPENED ROAD ALLOWANCE BETWEEN LOTS 15 & 16 CONCESSION 1, NORTH AND SOUTH OF LAKESHORE LINE, IN THE MUNICIPALITY OF BAYHAM, IN THE COUNTY OF ELGIN, DESIGNATED AS PARTS 1 &2 ON REGISTERED PLAN 11 R-9732. WHEREAS Section 11 of the Municipal Act, 2001, S.O. 2001, c. 25 as amended provides that a lower tier municipality may pass by-laws respecting Highways, including parking and traffic on highways; AND WHEREAS Section 8 of the said Municipal Act provides that a municipality has the capacity, rights, powers, and privileges of a natural person for the purpose of exercising its authority under this or any other Act; AND WHEREAS the Township of Bayham By-law 318 passed on September 7, 1874, being a by- law to amend and prepare for registration By-law No. 307 of the Township of Bayham for the purpose of conveying the road allowance between lots 15 and 16 in Concession 1 was for conveying and not closing and stopping up public highway; AND WHEREAS the Notice of Intention to Pass a By-law to stop up and close the road allowance was published in the Aylmer Express on January 7, 2015 and posted on the municipal website on January 5, 2015; AND WHEREAS the Council of the Corporation of the Municipality of Bayham deems it expedient to complete the historical transaction by closing and stopping up public highway described as the road allowance between Lots 15 & 16 Concession 1 designated as Parts 1 &2 on Registered Plan 11 R-9732 of the Municipality of Bayham, formerly Township of Bayham, in the County of Elgin; THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS: 1. THAT upon and after the passing of this By-law those portions of the unopened road allowance between Lots 15 & 16 Concession 1 according to Registered Plan 11R9732 of the Municipality of Bayham, formerly Township of Bayham, in the County of Elgin, designated as Parts 1 &2 be and are hereby closed and stopped up. 2. THAT this by-law shall take effect upon the date of its registration in the Land Titles Division for the County of Elgin (No. 11). 3. THAT the Clerk or designate is hereby authorized to amend the parcel designation noted in this By-law, if necessary, upon registration of this By-law. READ A FIRST AND SECOND TIME this 22nd day of January 2015. READ A THIRD TIME AND FINALLY PASSED this 22"d day of January 2015. MAYOR CLERK
