All sums borrowed pursuant to the authority of this by-law, as well as all other sums borrowed in this year and in previous years from the said Bank for any or all of the purposes mentioned in the said Section 329, shall, with interest thereon, be a charge upon the whole of the revenues of the Municipality. for the current year and for all preceding years as and when such revenues are received. 3. The Treasurer is hereby authorized and directed to apply in payment of all sums borrowed as aforesaid, together with interest thereon, all of the moneys hereafter collected or received either on account or realized in respect of taxes levied for the current year and preceding years or from any other source ,which may lawfully be applied for such purpose. WHEREAS by virtue of Section 336 (1) of The Municipal Act, R.S.O. 1970. the Council of this Corporation is empowered to expropriate lands required for the purposes of the Corporation. AND WHEREAS the lands hereinafter more particularly described, being Lots 6 and 7 on the South side of Second Street and the West side of West Street and part of Second Street, all in accordance with Registered Plan 205, are required for the purpose of enlarging the Municipal Road Department Garage and providing ingress and egress to the said Garage by means other than King's Highway No. 19. AND WHEREAS the report of Charles L. Mackenzie, Q.C., Inquiry Officer appointed under the provisions of The Expropriations Act, R.,S.O. 1970, Chapter 154 as amended, has been duly considered by Council pursuant to Section 8 (1) of the said Act, and Council has approved the proposed expropriation. BE IT ENACTED AS BY-LAW NO. 1815 OF THE CORPORATION OF THE TOWNSHIP OF BAYHAM that the lands set out in Schedule "A" hereto be and they are hereby expropriated from Clara Anne Marshall, and that the: Plan of the premises prepared by John B. Dodd, O.L.S. dated August 21, 1973 be forthwith deposited in the Land Registry Office for the Registry Division of Elgin. BETWEEN the Municipal Corporation of the TOWNSHIP OF DERERAM of the first part ASND THE Municipal Corporation of the TOWNSHIP OF BAYHAM of the second part. WHEREAS under the provisions of Chapter 284 R. S. 0. 1970 Section 410, the Corporations of adjoining Municipalities, may enter into an agreesent for the Maintenance and Repair of any Highway forming the Boundary between such Municipalities- whereby each of them undertake for a term of not exceeding Ten Years, to maintain and .keep in repair any portion of such Highway. The Township of Dereham shall build, maintain and repair, and be responsible for that portion,of the Boundary Road between the said Townships, being more particularly described as follows, that is to say: COMMENCING at the westerly limits of the Tenth Concession Road in the Township of Bayham, thence westerly along the said Boundary road to a point where the Deviated Townline between the Townships of Dereham, Bayham and Middleton, intersects the said Boundary road. 2. The Township of Bayham shall build, maintain and repair, &ltd be responsible for that portion of the Boundary Road between the said Townships, being more particularly described as follows:- that is to say: COMMENCING at the Westerly limits of the Tenth Concession Road in the Town- ship of Bayham, thence extending westerly along the said Boundary road, to the point where the boundary road between the Townships of Bayham and Malahide, intersects the said Boundary road between the Townships of Malahide, intersects the said Boundary road between the Townships of Dereham and Bayham. 3. Each Township shall finance and have full control and supervision over all the work undertaken on its respective portion of Boundary Road, and any subsidy which may be allowed by the Ministry of Transportation and Commun- ications of the Province of Ontario on such work, shall belong to the Municipality accounting for the Expenditure. 4. C.G. , declare an emergency to exist and may, for the purpose of this Plan, designate any area within the municipality as an "Emergency Area". in the event of such a declaration, he/she may, also autho- rize any or all of the following actions a. the evacuation of "Emergency Area".blaildings considered danger- ous o: of persons considered to be in danger, b. the dispersal of persons within the "Emergency Area" Vho are considered to be in danger or whose presence impedes emergency operations, c. the disc�,rtinuation of any Service/Utility, without reference to any municipality consumer, where continuation of such Service/ Utility may ccnstitutg a public hazard, within the "Emergency Area", d. provide Welfare Services, on a temporary basis, for any resident regU, rirg assistance due to displacement resultant of the emer- gency, and e. the call-up and 'utilization of any or all Municipal personnel, equipment and material. 5. In addition, the following actions may also be initiated if consi- dered essential: a. request from the Chairman of the St. Thomas -Elgin E.M.Q. , Exe- cutive Con-aittee, the use of all or part of the STEEMO resources, b. request personnel Mn d equipment assistance of voluntary and other agencies not under Municipal control: i.e., St.John, Salvaticn Arty, etc., c. the establishment of an Information Centre factual L f ormation to the news media and tions to the general public, 2 - for the issue of authoritative instruc- -3- d. the establishment of a Reporting and Inquiry Centre to issue information, on all respects of the emergency, .to concerned individuals, and e. institute a system whereby the balanced distribution of casual- ties to area medical facilities, is ensured. b. Should the implementation of the aforementioned actions be insufficient to control the emergency, Provincial government assis- tance may be requested as detailed at ANNEX "C", to this Plan. 7. IMPLEMENTATION OF THE PLAN The plan may be implemented resultant of any real or appre- hended peacetime emergency, by any member of the E.O.C.G., initia ting the "Emergency Alerting System", which assembles the E.O.G.G., and places all essential emergency service in a "State of readi- ness". The -Emergency Alerting System will be activated by authoriz- ing the Fire Service to commence the telephone alerting format. $. EMERGENCY ALERTING SYSTEM The member of the E.O.C.G., activating the Emergency Alerting System shall provide direction to the alerting agency in keeping with the steps detailed at ANNEX "A", attached. 9.0 RESPONSIBILITIES AND FUNCTIONS (i a. The Reeve --will be responsible for the general direction and control of the Emerency Operation. He/she will utilize his/her entire Council in this respect, by the delegation of specific responsibility and authority. He/she will at all times be guided, in the exercisinLunm of his/her responsibilities, by the advice provided by c l and the E.O.C.G. All Council and E.O.C.G., members Will report to the Reeve unless otherwise directed. (ii) a. the Clerk -Treasurer will, in the absence of the STEEMO Co --ordinator, assume his local funtions and responsibi- lities, b. as prime municipal employee, co-ordinate emergency opera- tions, C. advise Council on Government legilation and financial matters, and record all Council proceedings, d. co-ordinate the collection, collation and dissemination of factual information, and e. provide the conveniences and equipment required for the efficient operation of the E.O.C.G. - 3 - a 4 — the Ontario Provincial Police shall be requested to ensure the following: a. movement control of personnel within the Emergency Area, bo traffic control into, with and out of the Emergency Area, C, enforce personnel evacuation when such has been author- ized by the Municipal Council, d* in consort with the County MOH, advise area hospitals of the estimated casualty loads, e. maintain law and order within the Emergency Area and any E.O.C.G. , designated Welfare Facility, f. arrange for additional Police support, if and when such is considered necessary, and g0 arrange for on-site first aid and ambulance service, as required. (iv) the Fire Service will compile and maintain a current tele- phone numbers, listing which will permit that Service to expeditiously implement the Emergency Alerting System as detailed at ANNEX IV. In addition the Fire Service will: a. conduct all npe.rations associated with the fighting of fires, b. activate the Mutual Fire Aid System when necessary, C, alert the County Fire Coordinator, d. determine the need and arrange procurement of, additional equipment and supply requirements, e. provide equipment and manpower for pumping operation, f, provide resuscitation equipment and qualified personnel as required, and go protect local water supplies and watercourses from poll- ution. - 4 - (v) (vi) - 5 - the Onta:10 Hydro Commissions shall be requested to: a. when authorized by the Municipal, Council, discontinue such public utility services that are considered to be a public hazard, b* prc,wide alternate supplies of public utilities where necessary and practicable, and co action, comparable to those outlined in a., above, sh6uld be the subject of separate agreement between private utilities suppliers (Union and Medina Gas), and the municipality. the Roads Denartme t will: 0 a. provide warning flashers and road barricades, when and where required, b, provide municipal equipment, vehicles and qualified personnel, C. obtain information on flood waters as required, d. conduct snow clearing and removal operations, e. anpumping equipment and organize such operations, f* arrange for buildings demolition and evacuation operations where required. (vii) the Building Inspector will a* advise on the structural safety of buildings affected by the incident, and b. conduct tests, in consort with other involved agencies, to determine existing hazards in buildings, resultant of explosive, inflammable or toxic agents. (viii) the Medical Officer of Health (MOH) will arrange, a. inconsort with the Police, on --site first aid treatment or qualified medical attention. b. mass immunization, where necessary, co balanced casualty distribution to area hospital facilities, d. potability of emergency water supplies, and e. essential Public Health proclamations. 1 «. 6 .. (ix) the Welfare Officer will: a. when authorized by the Municipal Council, provide.emer- gency feeding, clothing and housing to any person requir- ing such assistance as a result of the incident, bo arrange for the opening, operation, direction and super - *vision of the required Welfare Centres, and C, arrange for assistance, with their Welfare operatil ns, from volunteer agencies. (x) the STEEMO Co-ordinator will: a. make advance arrangements as directed by the Reeve, to meet the needs of the U.C.G., b. arrange, co-ordination of operations procedures, within the E.O.C.G., C, arrange facilities, municipal offices or incident site, to enable 24 hour operation of the E.O.C.G., d. maintain a current copy of the O.P.P. Vital Services Telephone Directory, which lists sources of supplies and equipment that may be required in an emergency, and e. maintain a current listing of local and Provincial. E.M.O. equipment which could be made available to the municipality. 10. SPECIAL ARRANGFMDTT WITH "OTHER AGENCIES" Where special arrangements are required and .made with "Other Agencies" having an emergency task capability, i.e., Telephone Companies, local Industry, et,.:., such arrangements will be in writ- ing and included in this Plan as an Appendix. ll. It is essential that adequate reliable communications be available to the E,O.C.G., Emergency Services, etc., for Emergency Operations. 2. The Clerk -Treasurer is responsible to ensure that adequate commu- nication facilities are provided, subject to the financial r#stric- ti_ons set by the Muuiicipal Council. He will arrange with the local telephone company, for additional services and m&,* . - , :-.ance to be provided, on a priority basis, in an emergency situation, 3. The E.O.C.G., must have a capability to communicate with: a. Emergency Services, b. Senior levels of Government, C. Members, away from the Group, and d. Sources of Additional Aid, F 4ERGENCY. COMMUNICATIONS - The prime means of emergency communications will be the tel phone, with two-way radio back-up where possible. ` As the normal two--wa�� radio facilities, available within - a munici- pality, a~ e restricted by frequency to specific Services, i.e., roads, utilities, etc.,it w.J.11 be necessary to seek additional two-way rad�.o equipment and operators. This assistance may be arranged through the STENO Co-ordinator OR the Police, from the following sources: a. Elgin Amateur Radio Societ�J, RS_J This organization while operatn mainly base stations has a limited Mobile radio ca.- pabtlity and has volunteered their services, within their ca- pability, to assist the Municipality in an emergency. b. General Radio Association GRA) - This association has an ex--- tensive mobi'e radio capability and has volunteered their ser- vices, within their capability, to assist the Municipality in an emergency. Radio communications beyond the County boundaries will be arranged by the STEEMO Co-ordina�'or. 5. Standard Broadcast Stations - The SB stations normally listened to by County residents provide the best means of reaching the Public enmasse, as quickly and frequently as necessary. With the prior approval of Lhe Reeve, the Clerk -Treasurer will ensure that only P and comprehensive information is passed to SB stations for } broadcast to the Public. - 10 - 1? - ANNEX "C" to T OWN SH IP OF B AYHAM Peacetime Emergency Plan ADDITIONAL AID 1. Paragraphs 5., and 6., of the Plan detail the circumstances under which Additional Aid may be sought. 2. LOCAL AID A. Individuals (Directed OR Volunteer) Where additional manpower is required; a. Police - The Police Chief may call out auxiliary .members of the force to perform police duties when an emergency exists. Such members of the auxiliary who have been regu- larly appointed and approved by the Ontario Police P Commission are covered under the Workmen's Compensation Act. b• Fire - The Municipal Act, (Municipal Act (RSO), Section 354 (i), 25, RSO 1970) Paragraph 43), provides that By. may be passed by the Councils of individual munici- palities "for regulating the. conduct and enforcing the assis ante of persons present and the preservation of property at fires". When theappropriate By -Law has been enacted, the Fire Chief may call out bystanderx to assist in an emergency and such persons so directed are covered by the Workmen s Compensation Act. c . WHEREAS Section 39, Subsection 1, of the Game & Fish Act, Chapter 186 R.S.O. 1970 provides that any municipality may pass by-laws for issuing and fixing the maximum number of licenses to hunt, during the open season, pheasants, rabbits and foxes and for charging such fees therefor as may be authorized by the Minister; NOW THEREFORE the Council of the Corporation of the Township of Bayham enacts as follows: 1. That no person shall hunt pheasants, rabbits or fox within the Township of Bayham in the County of Elgin until a licence for that purpose has been obtained and such licence to be in addition to any other licence or permit required by law of the Federal or Provincial Governments. 2. The Clerk of the Township of Bayham or other person or persons appointed from time to time by the Council shall issue and sell the following; a) During open pheasant season - For Non -Residents of the Municipality, a license fee not greater than four dollars and seventy cents ($4.70) with an issuing fee not greater than trirt cents (30¢) for a total not greater than five doll&rs 05.00) . b) After open pheasant season - For Non -Residents of tRe Munici ality, a license fee not greater than three dollars ($3.00, with an issuing fee not greater than thirty cents (30¢) for a total not greater than three dollars and thirty cents ($3.30)• 3. The license issuer is hereby authorized to charge the following fees for reident licenses: a) During and after the open pheasant season - For any resident of the Municipality, a fee not greater than one dollar and eighty cents ($1.�0) with an issuing fee not greater than twenty cents(200) for a total not greater than two dollars ($2.00). 4. The fee prescribed shall be paid for each licence as and when same is issued. N 5. That for the purpose of this By -Law all Township licences issued within the County of Elgin are non -reciprocal during the pheasant season, but are reciprocal for rabbits and fox upon closing of the pheasant season. 6. In this By-law, the words "Resident of the Township" means any person who is a resident within the Township of Bayham and Villages of Vienna and Port Burwell. I 7. In this By -Law, the words "Non -Resident of the Township" means any person who does not reside within the Township of Bayham or the Villages of Vienna and Port Burwell. 8. A minimum of 200 licences must be available for use of non- residents of which 30 are available to non-residents of Canada; with no restrictions on the number of resident licences. 9. That all previous By -Laws passed by the Townshv of Bayham, which are inconsistent herewith, be and the sam6 are hereby repealed. 10. This by-law shall come into force upon approval by the Minister. WHEREAS by virtue of The Cemeteries Act, R.S.O. 1970, Section 65, Subsection 1 (e), councils of local municipalities may pass by-laws for the maintenance, management, regulation and control of a cemetery; AND WHEREAS it is deemed necessary that such action be taken in respect to the Light Cemetery, situated in the south west corner of Lot 14, Concession 4, Township of Bayham; THEREFORE BE IT ENACTED by the Municipal Council of the Township of Bayham: 1. That a Board of Trustees for the management and operation of the Light Cemetery be appointed. 2. That the said Board shall consist of six members. In 1974 two members shall be appointed for a three year term, two members shall be appointed for a two year term and two members shall be appointed for a one year term. In 1975 and each succeeding year, two members shall be appointed for a three years, term. 3. That Board of Trustees appointed under authority of this by-law shall have all the powers conferred under the Cemeteries Act for the said Light Cemetery, together with authority to receive _. monies from any source for the maintenance of the said cemetery and for perpetual care fund. 4. After the passing of this by-law, the Board of Trustees of the said Light Cemetery shall deposit with the Township Treasurer, funds for perpetual care of the said cemetery. Such funds shall be included in the Township of Bayham Cemetery Perpetual Care Fund and invested in accordance with investments authorized under The Trustee Act. The interest arising from the investment shall be paid annually by resolution of council to the said Board of Trustees. No part of the principal amount of such investment shall be used for purposes other than investment or re -investment. AND WHEREAS it is provided by The Drainage Act, that such excess funds shall be deducted in pro rata proportions from the assessments contained in the original By-law each year during which the debentures have to run. AND WHEREAS the interest rate specified for the debentures in the said By-law was eight per cent, which rate in light of market conditions today is unrealistic. With your letter of April 6th, 1976 you forwarded $100.00 and Mr. Petrie was advised in a subsequent telephone communication that the balance of monies would be forwarded in due course. However nothing further has been received and you have now indicated to the Township that the3,should proceed against Mr. and Mrs. Marreel. In our opinion the entire circumstances, particularly Mr. Petrie's letter of December 12th, 1974, amounted to a trust or escrow arrangement and you were duty bound either to forward the funds or not use the deed. These should be sufficient for your discussion of the general principles involved. If you agree to this closing, we will proceed to complete the reference plan required by regulations, and to register it. The description of the land will then be ------- shown as Part Three on Reference plan 11R Mr. Petrie mentioned the possibility of closing all the road allowance between Lots 113 and 114 which is not now being used as a public road. This would be difficult, time consuming and expensive because of the rough terrain across the valley of the Otter Creek, and because the "given roads" wander back and forth across the origin*&l road allowance. All these "given" or "travelled" roads in Lots 113 & 114 could be surveyed at the same time without greatly increasing the total cost. Yours tru f John F. WHEREAS the'..'Township has acquired certain lands in the Hamlet of Straf- fordville between Main Street and the portion of Lot 125 South of Talbot Road owned by the Board; 0 AND WHEREAS the Township proposes to establish a public highway over such lands which include Lot 4 as shown on Registered Plan 205; AND WHEREAS the Board proposes to establish a private driveway leading from its parking lot at the Straffordville Public School to such pro- posed highway; AND WHEREAS the parties have agreed on the matters hereinafter set forth; N NOW THEREFORE THIS AGREEMENT WITNESSETH that in consideration of the cov- enants contained herein, the parties hereto covenant and agree as follows: 1. The Board COVENANTS AND AGREES with the Township as follows: (a) On the execution of this agreement by both parties, to pay to the Township Ten Thousand Dollars ($10,000.00). (b) Upon the Township completing the works referred to in 2(a), to grade its lands from the said parking lot to the southerly limit of the proposed public highway and to fill and grade the proposed site of the public highway on the Township's lands with any extra fill which may be available on the Board's lands. (c) following the construction of the private roadway upon its lands, to maintain the same. 0 2. 3. (2) The Township COVENANTS AND AGREES with the Board as follows: (a) to remove the house or structure located on said Lot 4 and to level the foundation and to fill any basement excavation to the present grade of the adjacent lands. (b) Upon the Board completing the grading referred to in 1(b) above, to gravel the proposed public highway and the Board's private driveway as may be necessary to establish a road base at least thirty feet in width to the standards of the Ministry of Transportation and Communications and thereafter to tar and chip to the said Ministry's standards at least twenty-two feet of such road base. (c) to enact a by-law to assume the lands lying between Main Stre,pt and the Board's lands as a public highway and to register such by-law,, Each of the parties agree to proceed expeditiously with the fulfillment of their respective covenants, it being their intention to complete all the works contemplated herein by November 1, 1974.
