The Head and the Treasurer are hereby authorized on behalf of the Municipality to borrow from Gime to time by way of promissory note from CANADIAN IMPERIAL BANK or CommERcfi a sum or sums not exceeding in the aggregate = 3 50 t OOO • to meet until the taxes are collected the current expenditures of the Municipality for they tar, including the amounts required for the purposes mentioned in subsection (1) of Section 329 of the Municipal Act, and to give on behalf of the Municipality to the Bank a promissory note or notes staled with the Corporate Seal and signed by the Hebd and Treasurer for the moneys so borrowed, with interest at Bch rate as mAy be agreed upon from time to time with the Bank. . < . 2. All sums borrowed pursuant to the authority of this by-lart,. as well as all other sums borroovd in- this year and in previous years from the said Bank for any or all of the purppm mentioned in the said Section 329. shall, with interest thereon, be a charge upon the whott of the revenues of the Municipality for the current year and for all preceding years as and when such revenues are received. 3. The Treasurer is hereby authorised and directed to apply in payment of all sums borrowed as aforesaid, together with interest thereon, all of the moneys hereafter collected or received either on account or realised in respect of taxes levied for the current year and preceding years or from any other source which -may lawfully be applied for such purpose. WHEREAS provision is made for the establishment of a Community Centre under the Community Centres Act, R.S.O. 1970, Section 4. AND WHEREAS the Corporation of the Township of Bayham in - the owner of premises situated -in the Hamlet of Straffordville being Part of Lot 124, Concession 6, Township of Bayham and containing 8.200 acres more or less and known as the bayham Township Park. AND WHEREAS there is presently situated on the above premises a building known as the Bayham. Township Hall. AND WHEREAS it is desirous that for reasons of safety that the bayham Township Hall be demolished and replaced. THEIWORE BE IT ENACTED BY THE COUNCIL OF THE QORPURATION OF TKA` • TOWNSHIP OF BAYHAX 1. That a Community Centre be erected on or near the site of the Bayham Township Hall as demolished, under the provisions of the Community Centres Act, R.S.U. 1970 and the Regulations thereunder. 3. That the Community Centre shall be maintained permanently under the management of the Bayham Parks, Recreation and Community Centres Board as from time to time appointed by the Municipal Council of the Corporation of the Township of Bayham-in conformity with the provisions of the Community Centres Act and Regulations. AND WHEREAS the Straffordvil.le Lions Club has volunteered to assist the Council of this Municipality financially and otherwise. The uattrials obtained in the demolition of the existing unity centre by the Club will belong exclusively to the Club and the Club shall be at liberty to sell the said materials or to use the said materials in its sole and absolute discretion. 0 0 v 3. After the demolition of the existing coummity centre, a new commrmity centre will be erected by the Township with the assistance of the Club. The Club shall prepare all requisite plans and specificatixms for the building and shall submit then to the Township for approval.. The Township shall enter into the requisite building contract or contracts and the work shall be carried out under the primary supervision and con- trol of the Club, with the advice and direction of the Township where necessary. The now community centre shall be completed within one year after the commencement of demolition of the exist- ing centre. 4. The Club shall undertake whatever fund raising pro- jects are necessary to pay for the new community centre in full, subject to the grant under The Commnity Centres Act ,hereinafter r refierred to and the Township shad not be required to otherwise contribute to the construction of the centre. S. The Township shall apply as quickly as possible for the maxinnaa grant under the provisions of The Community Centres Act, to assist in the financing of the project. 6. Upon completion of the work and payment of the full cost thereof, the full control and management of the centre shall be assumed by the Township. WHEREAS Section 527 (5) of The Municipal Act, Chapter 284, R. S. O. 1970, provides that a Council may by by-law authorize the Treasurer or Collector to receive in any year payments on account of taxes for that year in advance of the day that may be fixed by by-law for the payment of any instalment of such taxes and to allow a discount on any taxes so paid in advance not exceeding six Per Centum per annum (6%) notwithstanding that the taxes for such year have not been levied; AND WHEREAS the date of Interim demand will'rbe March 1, 1973; . ti AND.WHEREAS the date of final demand will be September 1, 1973, NOW THEREFORE the Municipal Council of the Corporation of the Township of Bayham ENACTS AS FOLLOWS: 1. WHEREAS the Council of the Township of Bayham deems it expedient to :make a levy in the year 1973 and each succeeding year before the adoption of the estimates. THEREFORE the Council of the Township of Hayham ENACTS AS FOLLOWS 1. The rate to be levied under the provisions of paragraphs 1 and 2 Of this by-law to produce the amounts set out in paragraph Yto this by-law is forty-five ( 45) miles. 5. The dates of payment of taxes under this by is* shall be as follows: Due Date of 1st. Instalment: March 15 Dual Date of 2nd. Instalment: Jane 15 o. In default of payment of the first instalment of taxes or any part thereof by the day nowd therein for the payment thereof, the remaining instalment or instalwents shall forthwith become payable. no 2 7. A percentage charge of :one per centun (1%) shall be imposed as a penalty for non-payment of and shall be added to every tax instalment, or part thereof remaining unpaid on the first day following the last day of payment of each such instalment and thereafter -an additional" N. charge of one per centum (lit) shall be imposed and shall be added to every such tax instalment or part thereof remaining unpaid on the first day of each calendar month in which default continues up to and including December of this year. It shall be the duty of the Tax Collector immediately after the seversl dates named in Section 5 to collect at once by distress or otherwise under the provisions of the statutes in that behalf all such tax in stalm'ents or parts thereof as shall not have been paid on or before the respective dates provided, aforesaid, together with the said percentage charges as they are incurred. 9. The tax collector not later than 14 days prior to the date that the first instalment is due shall mail or cause to be mailed to the address- of the 'residence or puce. of business of . +each- person a notice setting out the tax payments'required to be mane pursuant to this by-law, the respective dates by which they are to be paid to avoid penalty and the particulars of the penalties imposed by this by-law for late payment, 10. Taxes shall be payable to the Corporation of the Township of Bayham and shall be paid to the Collector at the Municipal Office, 11. The Collector and Treasurer be and,are hereby authorized to accept part payment from time to time on account of any takes due and to give a receipt for such payment, provided that acceptance of any such payment shall not affect the collection of any percentage charge imposed and collectable under section 5 in resp*ct to non-payment of taxes or of any instalment thereof. 12. When tenants of lands owned by the Crown or in which the Crown has an interest are liable for payment of takes and where any such tenant has been employed either within - or outside the municipality by the sane employer for not less than thirty days,bh employer shall pay over to the Collector or Treasurer on demand out of any wages, salary or other remuneration due to such employee the amount then payable for taxes under this by-law and such payment shall relieve the employer from any liability to the eMloyee for the amount so paid.
