Being a by-law to appoint certain officers in and for the
Municipality of the Township of Bayham for the year 1965.
BE IT THEREFOR ENAC ED by the municipal council of the
Township of Bayham in regular session assembled: -
1. That Robt. C. Jackson and Wilfred Harper shall be

By -Law No. 1514
Being a by-law to appoint Fence -viewers and Pound -keepers
in and for the Township of Bayham for the year 1965.
WHEREAS Section 377, Sub -section 58 of the Municipal Act,
R.S.O. 1960, provides that these appointments be made;
BE IT THEREFORE ENACTED by the Municipal Council of the
Corporation of the Township of Bayham, in regular session
assembled, that the following, be and are hereby appointed
to act as the following officers for the year 1965. -

Therefore the Council of the Township of Bayham
hereby enacts as follows -
1.

1. The Head and the Treasurer are hereby authorized on behalf of the Municipality to
borrow from time to time by way of promissory note from CANADIAN IMPERIAL BANK
OF COMMERCE a sum or sums not exceeding in the aggregate $ 2 5 0 ) 000.00
to meet until the taxes are collected the current expenditures of the Municipality
for the year, including the amounts required for the purposes mentioned in subsection
(1) of Section 329 of the Municipal Act, and to give on behalf of the Municipality
to the Bank a promissory note or notes sealed with the Corporate Seal and signed by
the Head and Treasurer for the moneys so borrowed, with interest, which may be
paid in advance or otherwise, at a rate not exceeding 54 per centum per annum.
2. All sums borrowed pursuant to the authority of this by-law, as well as all other sums
borrowed in this year and in previous years from the said Bank for any or all of the
purposes mentioned in the said Section 329, shall, with interest thereon, be a charge
upon the whole of the revenues of the Municipality for the current year and for all
preceding years as and when such revenues are received.
J. The Treasurer is hereby authorized and directed to apply in payment of all sums
borrowed as aforesaid, together with interest thereon, all of the moneys hereafter
collected or received either ,on account or realized in respect of taxes levied for the
current year and preceding years or from any other source which may lawfully be
applied for such purpose.

Federation of Agriculture.
WHEREAS paragraph 5 (a) of Section 394 of The Municipal Act,
1960, provides that Township Councils may pass by-laws for
making this grant;
AND WHEREAS it is considered necessary and expedient that
this grant be made;
THEREFORE BE IT ENACTED BY THE MUNICIPAL COUNCIL OF THE
TOWNSHIP OF BAYHA14 AS FOLLOWS,,, --
1. That a grant of Three Hundred Dollars ($300.00)

Being; a by-law to amend Group Annuity Plan for employees
of the Township of Bayham in accordance with the
Regulations under the Pension Benefits Act 1962-63 and
amendments.
THEREFORE be it enacted by the Council of the Township of
Bayham as follows: -
That the Group Annuity Plan for employees of the
Township of Bayham, be and is hereby amended a s follows: -
In accordance with attached sheet dated Jan. 4th.,
1965.

The Corporation of the Tovmship of Bayham.
Being a by-law to authorize participation in the Ontario Municipal*
Employees Retirement System.
WHEREAS pursuant to section 15 of The Ontario Municipal Employees
Retirement System Act, 1961-62, a municipality or local board may
by by-law or resolution elect to participate in the Ontario iviunicipal
Employees Retirement System and may pay to the fund the total of the.
employer and employee contributions, and has all the powers necess-
ary and incidental thereto:
NOW THEREFORE BE IT ENACTED as a by-law of the Corporation of the
Township of Bayham (hereinafter called the Employer) as follows:
1. The Employer hereby elects to participate in the Ontario
Municipal Employees Retirement System as of the first Day of
March 1965 (herein called the effective date) and authorizes
the Clerk -Treasurer to submit this election in writing (by
provision of a certified copy of this by-law) to the Secretary -
Treasurer of the Ontario Municipal Employees Retirement Board,
2. Every employee who, before the effective date, was an employee
of the Employer is entitled to become a member of the System if
he is employed on a continuous full-time basis and at least 75%
of the employees sd employed become members.
3. Every person who becomes an employee of the Employer on or
after the effective date,shall, as a condition of his employ-
ment, become a member of the System, or if he is already a
member resume his contributions to the System, on the complet-
ion of six months of service on a continuous full-time basis,
provided however, that if he is already a member of the System,
contributions by and on his behalf may, on the election of the
employee, commence on any date during the first six months of
his service.
4. The Clerk -Treasurer of The Corporation of the Township of
bayham is hereby authorized to arrange for the deductione
fro". the earnings of each employee who is a members of the
System, the contributions required to be made by the member,
and to remit such contributions together with the amounts required
under the Act to be paid by the Employer, to the Secretary -
Treasurer of the Ontario Municipal Employees petirement Board,
and to execute all necessary documents and to do such thffings
as are necessary to carry out the intent of this by-law

ways, has authorized the approval of the above cited by-law to a
limit of

for Construction
$ 50,400 for Maintenance, and
$ 7 V , 000
Total
Please be advised that expenditures in excess of either
the construction or maintenance limits will not be eligible for sub-
sidy unless covered by a supplementary by-law approved by the
Minister. Supplementary by-laws must be in the hands of the
District Engineer not later than July 31, 1965.
This approval is given subject to the approval of each
individual work of road and bridge construction, each contract for
maintenance and the purchase of each unit of equipment. The
District Engineer must be advised and his consent obtained before
such works or purchases are advertised or tenders called or any
commitment made by the county with- respect to them.
In the event that any portion of the cost of the proposed
work or purchase is 'to 'be raised in a subsequent year or financed
by the issue of debentures, the approval of the Ontario Municipal
Board must be obtained before the work or purchase is authorized
or any commitment made with respect thereto.
One copy of the by-law as approved is returned herewith.

Special Capital Projects in the Department's estimates for
the current fiscal year.
The Honourable C. S. TlacNaunhton, 1-Uni st er of
Highways, has approved of the proposed expenditure, for sub-
sidy Purposes, to a limit of
$ 35,000.00 for Construction,
SUBJECT TO THE FOLLO:J:ING CONDITIONS:
1. That the expenditure(s) shall be made only for the
purposes set out in the by-law and supporting pro-
,-ramme and shall not be diverted, either in whole
or in na rt , to any other purpose without the. prior
consent in writing; of the Municipal Engineer.
2. That the individual works of road and bri die con-
struction and the ' purchase of each unit of equip-
ment and the award of contracts for same shall be
subject to the approval of an engineer of the
Municipal Roads Division.
3. That the District Muni.cinal Engineer shall be
informed and his consent obtained before tenders
are called for the proposed work or purchase and
before .any commitment is made by the Municinality.

'T'ownship of Bayham
Being a by-law to adopt the assessment on which the taxes shall be levied
for the year 1965, to levy taxes for the year 1965 and to provide for the
collecti:^,n thereof.
WHEREAS by By -Law No. 1067 and amendments thereto, the Council of the
Township of Bayham provided for the making; of the assessment of the
municipality prior to the lst. day of Sept. 1964, as the assessment on
which the rate of taxation for the year 1965 should be levied; and extended
to Sept. 30, 1964 by By -Law No. 1503.
AND WHEREAS the assessment roll containini; the assessment made as aforesaid
was revised, corrected and passed by the Court of Revision of the said
Township on the 15th. day of Dec., 1961.
AND WHEREAS some revisions I -b-e- made by the County Judge on Jan. 29,1965.
AND WHEREAS it is expedient to adopt the said assessment as the assessment
on which the rate of taxation for the year 1965 shall be levied;
AvD '4HEHEAS it is necessary and expedient to levy on the whole rateable
property according to the last revised assessment roll of the said
Township the sum of, 2 �,9' for the general purposes of the said
Township for the current year, for the payment of the County rate for the
current year, and for the purpose of defraying part of the expenses of
Public, Separate and High School educut4on, and other purposes;

the rate of taxation for the year 1965 shall be levied.
2.That the said assessment roll be and the swine is hereby adopte� and
confirmed as the last revised assessment roll for the said Township.

.general purposes of the Corporation, including the amount required for
County purposes and other purposes for the current year, a rate of
27.0'82m-illsin the dollar be and the same is hereby levied for the year

Tax Collector or Treasurer of the Township of Bayhan, or into the Branches
of the Canadian imperial Bank of Commerce at Straffordville, Vienna, Port
Burwell or Till sonbur:7.
8. Taxes shall become due and payable one-half on or before July 20th.
1965 and one-i:alf on or before December 20th., 1965. Penalties for non-
payment when due and discounts for pre -payment of taxes shall be as
provided for in By -Law 'No. 1393 aid amendments thereto of the said
Township of Bayham.
9. The Collector shall have the privilege of mailing the tax notices to
the several taxpayers of the Township at their last known address.
10. After fourteen days notice, the Collector or his Bailiff may seize
any goods and chattels for unpaid taxes.

Township of Bayham.
Being a by-law to regulate the location of buildings and structures
on lands adjacent to Township Roads and on the Bayham Township side
of ,all boundary roads.
dHERLn3 it is deemed adviseable that the above action be taken;
AND WHEREnS authority is granted under Section 30 of The Planning
Act, lli.S.O. .1960, subject to the approval of The Ontario 1viunicipal
Board, to exercise such restrictions;
I O'd THEREFORE the Council of the Corporation of the Township of
Bayham enacts as follows; -
1. In this by-law, the word t1person" shall mean any person, firm
or corporation;
the word "Highway" shall mean a 'Township of Bayham road includ-
ing a boundary road;
the word "Council" shall mean the duly elected council of the
Township of Bayham;
"Road Superintendent" shall mean the Township Road Superintendent
of Bayham;
"Frontage's shall mean lineal measurement taken paralell to the
boundary of the road or highway;

"Built-up Area's shall mean the territory contiguous to.a highway
not within a city, town, village or police village where: -
(1) not less than 50 per cent of the frontage upon one side
of the hi,;hway for a distance of not less than 600 feet
is occupied by dwellings; buildings used for business
purposes, schools or churches, or
(2) not less than 50 per cent of the frontage upon both sides
of the highway for a distance of not less than 300 feet
is occupied by dwellings, buildings used for business
purposes, schools or churches, or
(3) not more than 600 feet of the highway separates any
territory described in sub -clause (1) or (2).
2. This By -Law shall apply to those Roads within the Tovmship of
Bayham under the jurisdiction of the said Township of Bayham and
to the Bayham movmship side of all boundary roads.

3. No person sha 11 erect any building or structure or clam or dig or
drill a well, alter or modify any building or structure or dig a
pond, any part of which is located closer to the centre line of
the ori7inal Road Allowance than 85 feet or within 35 feet of
the nearest limit of any highway whichever case is further
distance from the present centre line; save and except any
highway in a police villae or Built-up tirea.
4. In order to provide a daylight triangle no person shall erect

any building or structure, alter or modify any structure, any
part of which is at a c1cser distance than as shown on Schedule
"All as attached, from a Road intersecting a highway or a rail-
road right-of-way intersecting a highway.
5. In a police village or Built-up :area no person shall erect any
building or structure or dam, or drill or dig a well or dig a
pond or alter or modify any structure, at a closer distance to
the limit of any highway than;
(1) where the new building, structure, dam,well or pond is
erected between two existing buildings not more than
300 clear feet mart the distance from the limit of any
hi hway shall not be less than the average setback of
each of the two adjoining buildings, but in no case need
the setback be more than -15-feet from the nearest limit
of any hi hway.
(2) where a new building, structure, darn, well or pond is
erected between two existing buildings more than 300
clear feet apart, the regulations of Section 3 shall apply.
6. (a) This By -Law shall not prohibi-` the alteration or the
Modifying once only of any structure or building closer
to any limit of the highway as defined in Sections 3 or
distance to the nearest limit of the highway is not
diminished and (2) that the cost of alterations is not
greater than 1%2 of the market value of the present
building.
( b ) This By -Law shall not prohibit the drilling or di �.--ing of
a well vri thin_ 20 feet of a residence that is closer to
any limit of the highway as defined in Sections 3 to 5
orovided the distance to the nearest limit of the highway
is not less than the distance of the residence to the
nearest limit of the highway.

6. (c) This By-law shall not prohibit the replacement of a
Tobacco Kiln destroyed by fire or wind where it is one
of a line or series of 2 or more; even though the
distance to the nearest limit of the hiLrhway is less than
is required in Sections 3 to 5. However, the distance to
the nearest limit of the highway shall not be less than
any other adjacent kiln.
7. No junk or automobile wrecking yard may be located within 150
feet of a hi ghwa5, .
8. Every person who violates any of the above provisions of this
By-law shall be guilty of an offence and upon Summary Conviction
shall be liable to a penalty of not more than $300.00 for each
offence.
9. This By-law shall come into effect the day that it is passed by
the Council subject to the approval of the Ontario Municipal
Board.

A By-law authorizing Union Gas Company of Canada, Limited, to lay down,
maintain and use pipes and other necessary works for the transmission and distribu-
tion of gas on, in, under, along and across any highway under the jurisdiction of
the Council of The Corporation of the To,.-.nship of Beyham

WHEREAS Union Gas Company of Canada, Limited (hereinafter referred to as
"the Company", and which term shall include its successors and assigns), is engaged
in the business of producing, purchasing, transmitting, distributing, supplying and
selling gas.
AMD WHEREAS the Company has requested the Council of The Corporation of the
Township of Beyhsm to grant it a franchise or right to lay dotNn, maintain
and use pipes and other necessary works for the transmission and distribution of
gas on, in, under, along and across any highway located within the Township of
BByhsLm
(hereinafter referred to as "the i,iuni.cipality") together with the
right to transmit gas in and'through the 1,1unicipality and to bring in, produce,
distribute, supply and sell gas to residents of the i,,iur..Lcipality.
AND 4"HEREAS the Council deems.it advisable to grant the said request sub-
ject to terms and conditions hereinafter set forth.

BE, IT THEREFORE ENACTED by the Council of The Corporation of the Township
Bayham
as follows: -
Full right, power, permission, consent and authority of the 1,1unicipality -
are hereby given, granted, conferred and assured unto the Company, its successors
and assigns, to lay down, maintain, and use pipes and other necessary works for the
transmission and distribution of gas on) in, under, along or across any highway
under the jurisdiction of the Council of the Municipality, including therein the
right from time to time and at any time, to survey, construct, lay, maintain, in-
spect, alter, repair, renew, remove, abandon, replace, reconstruct, extend, use
and operate in, through, upon, under, along and across the same or any of them or
any part or parts of them, such transmission and distribution mains, pipes, lines,
services and works (with any and all necessary or incidental apparatus, attachments,

appliances, arrangements for cathodic protection, regulators, valves, curb -boxes
safety appliances and other suchlike appurtenances) which the Company may desire
from time to time and at any time for the transmission of gas in and through the
Municipality and for a gas distribution system and any extension or extensions
from time to time thereto and together with the further right from time to time
and at any time to enter upon, open up, dig, trench, use and occupy such highways
or any part or parts of them for any of the purposes aforesaid and further together
with the right from time to time and at all times to use and operate a gas trans-
mission and distribution system in the Municipality and to transmit gas in and
through the Municipality and to provide gas service to any resident or residents
of the Municipality, and to bring in, transmit, produce, distribute, supply and
sell gas in and through the Municipality for fuel, heat and power.
2. All new (or renewal) mains, pipes, lines and works installed by the Com-
pany under this By-law shall be constructed and laid in accordance with good en-
gineering and construction practices. Except in case of emergency,
(a) no excavation, opening or work (exclusive of service connections
from the street main to the property line) which will disturb or
interfere with the travelled surface of any highway shall be
undertaken or commenced by the Company without written notice to
such officer of the Municipality as may from time to time be ap-
pointed by the Council of the Municipality for the purpose of
general supervision over its highways (hereinafter referred to
as "the said officer of the Municipality", which term shall in-
clude the^person acting in his stead in the event of his absence
from duty), such notice to be given at least 24,hours.in advance
of commencing such work unless otherwise agreed to by the said
officer of the Municipality, and
(b) before laying or installing any new (or renewal) mains, pipes,
lines and works (exclusive of service connections from the street
main to the property line), the Company shall first file with the
said officer of the Municipality a preliminary map or plan showing
what it proposes to lay or install and the proposed location there-
of and shall also check with and obtain the written approval of the
said officer of the Municipality as to such proposed location.
Not later than three months after the close of each of its fiscal years the Company
shall file with the Clerk of the Municipality, maps or plans showing the location and
size of all mains, pipes, lines and works laid or installed by the Company in the high-
ways during its previous fiscal year, exclusive however of service connections from the
street main to the property line.
3. In so far as is reasonably practicable, all lines and works constructed or
installed by the Company shall be placed underground, and, except where it shall be
necessary to cross a highway, along the sides of the highway. All lines and works
constructed by the Company shall be so constructed as when completed not to obstruct
or interfere with or render more difficult or dangerous the use of the highway or any
municipal sewers, water -pipes, drains, bridges, culverts or ditches thereon or therein,

or other municipal works or improvements thereon or therein or the improvement or
repair thereof, or with the roads or bridges to property fronting thereon, and
wherever any such line shall be carried across an open drainage ditch, it shall be
carried either wholly under the bottom thereof or above the top thereof, so as not
in any way to interfere with the carrying capacity of such ditch.
4. Upon the laying down of any lines or works or the taking up of any lines
or works, or the moving of any lines or works from place to place in any highway,
the Company shall, at its own expense and with all reasonable expedition, restore
the highway at the point of entry as close as reasonably practicable to the con-
dition in which it existed immediately prior to such entry and leave the same in
as safe and good a state of repair as it was before it was entered upon or opened.
The Company shall further make good any settling or subsidence thereafter caused
by any excavation made by it, to the satisfaction of the Reeve or other officer
of the Municipality above mentioned.
5. In the event that the Municipality in pursuance of its statutory powers
shall deem it expedient to alter the construction of any highway or of any muni-
cipal drain, ditch, bridge, culvert or other municipal works or improvements there-
on or therein and in the course thereof it shall become reasonably necessary that
the location of a main, line, pipe or works of the Company laid or operated under
this By-law should'be altered at a specified point to facilitate the work of the
Municipality, then upon receipt of reasonable notice in writing from*the Clerk of
the Municipality specifying the alteration desired, the Company shall, at its owl
expense, alter or re -locate its main, pipe, line or works at the point specified.
6. The Company shall make no charge for tapping its main or laying service
lines in the highways.
7. The Company shall and does hereby at all times indemnify and save harm-
less the Municipality from and against all loss, damage, injury or expense which
the Municipality may bear, suffer or be put to by reason of any damage to property
or injury to persons caused by the construction, repair, maintenance, removal or
operation by the Company of any of its mains, pipes, lines or works in the Munici-
pality unless such loss, damage, injury or expense is occasioned by Act of God or
by the act, neglect or default of some person, firm or corporation other than the
Company, its servants, contractors, sub -contractors, agents or employees.
8. The rates to be charged and paid for gas sold by the Company in the Muni-
cipality and the meter rentals and other charges, if any, to be paid by ultimate
consumers of gas in the Municipality, shall be such as shall from time..to time be t

fixed by Order of the Ontario Energy Board or other rate -fixing Body having juris-
diction in such matters.
9. The rights and privileges, duties and obligations arising out of this
By-law and the .Agreement hereinafter referred to shall be subject to any applicable
statute, regulation, laws, order and direction of any governmental authority having
jurisdiction in the premises and now or hereafter in effect during the term of this
By-law.
10. The rights and privileges hereby granted shall continue and remain in force
for a period of thirty (30) years from the date when this By-law takes effect.
U. In this By-law,
"Gas" means natural gas, manufactured gas or any liquified petroleum gas,
and includes any mixture of natural gas, manufactured gas or liquified petroleum
gas, but does not include a liquified petroleum gas that is distributed by a means
other than a pipeline.
"Highway" or"Highways" mean and include a common and public highway,
street, avenue, boulevard, parkway, drive -nay, lane, alley, square, place, side-
walk,
ide-
walk, bridge, viaduct or trestle and any other structure incidental thereto, now
or at any time during the term of this By-law under the jurisdiction of the Muni-
cipality.
Municipality" means the Township of Bayham
as constituted on
the date when this By-law takes effect or as it may from time to.time be constituted
during the term of this By-law.
12. It is recognized that gas is a public utility, the use of which may be es-
sential to the proper development of any new area of sub -division. The Municipa: ity
`
therefore agrees to notify the Company of each new plan of sub -division before the
same has been approved by the Council and to take any reasonable steps to ensure'
that in each new plan of sub -division adequate provision is made for the reservation
of landsfor gas regulator sites. In so far as is reasonably practicable, the Com -
pang shall endeavour to construct its mains in new areas of sub -division at the same
time as the Municipality is constructing its public services therein.
13. Unless the assent of the Municipal Electors is dispensed with by the
Ontario Energy Board, this By-law shall not take effect unless and until it has been
assented to 'by the Municipal Electors of the Municipality as provided for by The
Municipal Act with respect to By-laws requiring the assent of the Electors or as
may be provided for by special legislation providing for the obtaining of the said
assent at a time other than the day fixed for taking the poll at the annual murni.ai-

pal election. Upon the assent of the Municipal Electors having been obtained or
dispensed with as above, this By-law and the powers and privileges hereby granted
shall still not take effect and be binding unless and until formally accepted by

the Company in an Agreement which will legally bind the Company to perform, ob-
serve and comply with all the agreements, obligations, terms and conditions here-
in contained and unless and until such Agreement_, when so accepted shall have
been executed under the corporate seal of The Corporation of the Township of
Sayhm by the Reeve and Clerk who are hereby authorized and empowered so to do.
Upon the aforesaid provisions having been complied with, this By-law shall come
into force and take effect.

WHEREAS the Corporation on the 5th day of July , 19 65 duly
passed its By-le;t Number 1516 , which By-law grants to the Company authority to
lay down, maintain and use pipes and other necessary works for the transmission
and distribution of gas on, in, under, along or across any highway under the juris-
diction of the Council of the Corporation, together with the right to bring in,
produce, distribute, supply and sell gas to residents within the limits of the
Corporation, a copy of which By-law is annexed hereto as Schedule "A" to this
Agreement.
AND WHEREAS the terms End conditions upon which and the period for
which the said By. -law grants such rights to the Company were approved by Order of
the Ontario Energy Board dated the 9th day of J7u1e
, 1965.
AND WHEREAS the Ontario Energy Board, pursuant to Subsection 4 of Sec-
tion 9 of The Municipal Franchises Act, R.S.O. 1960, Chapter 255, did by Order
dated the 9th day of June , 1965 declare and direct that the assent
of the Municipal Electors of the Corporation of the said By-law is not necessary.
AND WHEREAS it is provided in the said By-law that the same shall not
take effect unless and until formally accepted by the Company in an Agreement to
be executed by the Company and the Corporation and the Reeve and Clerk of the
Corporation have been authorized in the said By-law to execute such Agreement under
the corporate seal of the Corporation.
AND WHEREAS the Company now wishes to formally accept the powers and
privileges granted by the said By-law and agrees to be bound by and to perform,

WHEREAS Union Gas Company of Canada, Limited (hereinafter referred to as
"the Company", and which term shall include its successors and assigns), is engaged
in the business of producing, purchasing, transmitting, distributing, supplying and
selling gas.
AZ WHEREAS the Company has requested the Council of The Corporation of the
Township of Bayham to grant it a franchise or right to lay down, maintain
and use pipes and other necessary works for the transmission and distribution of
gas on, in, under, along and across any highway located lvithin the Township of
Bayham (hereinafter referred to as "the municipality") together with the
right to transmit gas -in and"through the Aiunicipalit'y and to bring in, produce,
distribute, supply 'and sell gas to residents' of the Municipality.
Ai\ID WHEREAS the Council deems it advisable to grant the said request sub-
ject to terms and conditions hereinafter set forth.
BE IT THEREFORE ENACTED by the Council of The Corporation of the Township
of Bayham
as follows: -
1. Full right, powerf permission, consent and authority of the Municipality
are hereby given, granted, conferred and assured unto the Company, its successors
and assigns, to day down$ maintain, and use pipes and other necessary works for the
transmission and distribution of gas on, in, under, along or across any highway
under the jurisdiction of the Council of the Municipality, including therein the
right from time to time and at any time, to survey, construct, lay, maintain, in-
spect, alter, repair, renew, remove, abandon, replace, reconstruct, extend, use
and operate in, through, upon, under, along and across the same or any of them or
any part or parts of them, such transmission and distribution mains, pipes, lines,
services and works (with any and all necessary or incidental apparatus, attachments$

appliances, arrangements for cathodic protection, regulators, valves, curb -boxes
safety appliances and other suchlike appurtenances) which the Company may desire
from time to time and at any time for the transmission of gas in and through the
Municipality and for a gas distribution system and any extension or extensions
from time to time thereto and together with the further right from time to time
and at any time to enter upon, open up, dig, trench, use and occupy such highways
or any part or parts of them for any of the purposes aforesaid and further together
with the right from time to time and at all times to use and operate a gas trans-
mission and distribution system in the Municipality and to transmit gas in and
through the Municipality and to provide gas service to any resident or residents
of the Municipality, and to bring in, transmit, produce, distribute, supply and
sell gas in and through the Municipality for fuel, heat and power.
2. All new (or renewal) mains, pipes, lines and works installed by the Com-
pany under this By-law shall be constructed and laid in accordance with good en-
gineering and construction practices. Except in case of emergency,
(a) no excavation, opening or work (exclusive of service connections
from the street main to the property line) which will disturb or
interfere with the travelled surface of any highway shall be
undertaken or commenced by the Company without written notice to
such officer of the Municipality as may from time to time be ap-
pointed by the Council of the Municipality for the purpose of
general supervision over its highways (hereinafter, referred to
as "the said officer of the Municipality", which term shall in -
elude the persoe acting'in his stead in the event of his absence
from duty), such notice to be given at least 24 hours in advance
of commencing such work unless otherwise agreed to by the said
officer of the Municipality, and
(b) before laying or installing any new (or renewal) mains, pipes,
lines and works (exclusive of service connections from the street
main to the property line), the Company shall first file with the
said officer of the Municipality a preliminary map or plan showing
what it proposes to lay or install and the proposed location there-
of and shall also check with and obtain the written approval of the
said officer of the Municipality as to such proposed location.
Not later than three months after the close of each of its fiscal years the Company
shall file with the Clerk of the Municipality, maps or plans showing the location and
size of all mains, pipes, lines and works laid or installed by the Company in the high-
ways during its previous fiscal year, exclusive however of service connections from the
street main to the property line.
3. In so far as is reasonably practicable, all lines and works constructed or
installed by the Company shall be placed underground, and, except where it shall be
necessary to cross a highway, along the sides of the highway. All lines and works
constructed by the Company shall be so constructed as when completed not to obstruct
or interfere with or render more difficult or dangerous the use of the highway or any
municipal sewers, water -pipes, drains, bridges, culverts or ditches thereon or therein,

or other municipal works or improvements thereon or therein or the improvement or
repair thereof, or with the roads or bridges to property fronting thereon, and
wherever any such line shall be carried across an open drainage ditch, it shall be
carried either wholly under the bottom thereof or above the top thereof, so as not
in any way to interfere with the carrying capacity of such ditch.
Upon the laying down of any lines or works or the taking up of any lines
or works, or the moving of any lines or works from place to place in any highway,
the Company shall, at its own expense and with all reasonable expedition, restore

the highway at the point of entry as close as reasonably practicable to the con-
dition in which it existed immediately prior to such entry and leave the same in
as safe and good a state of repair as it was before it was entered upon or opened.
The Company shall further make good any settling or subsidence thereafter caused
by any excavation made by it, to the satisfaction of the Reeve or other officer
of the Municipality above mentioned.
5. In the event that the Municipality in pursuance of its statutory powers
shall deem it expedient to alter the construction of any highway or of any muni-
cipal drain, ditch, bridge, culvert or other municipal works or improvements there-
on or therein and in the course thereof it shall become reasonably necessary that
the location of a main, line, pipe or works of the Company laid or operated under
this By-law should be altered at a -specified point to facilitate the work of the
Municipality, then upon receipt of.reasonable notice in writing from the Clerk of
the Municipality specifying the alteration desired, the Company shall, at its own
expense, alter or re -locate its main, pipe, line or works at the point specified.
6. The Company shall make no charge for tapping its main or laying service
lines in the highways.
7. The Company shall and does hereby at all times indemnify and save harm --
less the Municipality from and against all loss, damage, injury or expense which
the Municipality may bear, suffer or be put to by reason of any damage to property
or injury to persons caused by the construction, repair, maintenance, removal or
operation by the Company of any of its mains, pipes, lines or works in the Munici-
pality unless such loss, damage, injury or expense is occasioned by Act of God or
by the act, neglect or default of some person, firm or corporation other than the
Company, its servants, contractors, sub -contractors, agents or employees.
8. The rates to be charged and paid for gas sold by the Company in the Muni-
cipality and the meter rentals and other charges, if any, to be paid by ultimate
consumers of gas in the Municipality, shall be such as shall from time to time be

.fixed by Order of the Ontario Energy Board or other rate -fixing Body having juris-
diction in such matters.
9. The rights and privileges, duties and obligations arising out of this
By-law and the Agreement hereinafter referred to shall be subject to any applicable
statute, regulation, laws, order and direction of any governmental authority having
jurisdiction in the premises and now or hereafter in effect during the term of this
By-law.
10, The rights and privileges hereby granted shall continue and remain in force
for a period of thirty (30) years from the date when this -By-law takes effect.
11. In this By-law,
"Gas" means natural gas, manufactured gas or any liquified petroleum gas,
and includes any mixture of natural gas, manufactured gas or liquified petroleum
gas, but does not include a liquified petroleum gas that is distributed by a means
other than a pipeline.
"Highway" or"Highways" mean and include a common and public highway,
street, avenue, boulevard, parkway, drive -way, lane, alley, square, place, side-
walk, bridge, viaduct or trestle and any other structure incidental thereto, now
or at any time during the term of this By-law under the jurisdiction of the Muni-
cipality.
"Municipality" means the Township of Bayham
as constituted on
the date whew this By-law takes effect or as it may from time to time be constituted
'during the' term of this By-law.
12, It is recognized that gas is a public utility, the use of which may be es-
sential to the proper development of any new area of sub -division, The Muni.cipality
therefore agrees to notify the Company of each new plan of sub -division before the
same has been approved,by the Council and to take any reasonable steps to ensure
that in each new plan of sub -division adequate provision is made for the reservation
of landsfor gas regulator sites. In so far as is reasonably practicable, the Com-
pany shall endeavour to construct its mains in new areas of sub -division at the same
time as the Municipality is constructing its public services therein.
13. Unless the assent of the Municipal Electors is dispensed with by the
Ontario Energy Board, this By-law shall not take effect unless and until it has been
assented to by the Municipal Electors of the Municipality as provided for by The
Municipal Act with respect to By-laws requiring the assent of the Electors or as
may be provided for by special legislation providing for the obtaining of the said
assent at a time other than the day fixed for taking the poll at the annual munici-

pal election. Upon the assent of the Municipal Electors having been obtained or
dispensed with as above, this By-law and the powers and privileges hereby granted
shall still not take effect and be binding unless and until formally accepted by
the Company in an Agreement which will legally bind the Company to perform, ob-
serve and comply 'aith all the agreements, obligations, terms and conditions here-
in contained and unless and until such Agreement, when so accepted shall have
been executed under the corporate seal of The Corporation of the Township of
DaYb" by the Reeve and Clerk who are hereby authorized and empowered so to do.
Upon the aforesaid provisions having been complied with, this By-law shall come
into force and take effect.

Reeve and Clerk on behalf of the Township of Bayham and by the
Minister of Highways for the Province of Ontario;
AND WHERLAS by Dept of Highways Work Order, D.R. 785 -11
dated June 7th., 1965, the Department has approved of an allot-
ment of X196,780.00 for the above noted work, same to be
carried out by the Township of Bayham under supervision of the
District Engineer..
AND WHEREAS it is estimated that temporary loans of up to
"85,000.00 may be regl�ired to finance the above operations
pending receipt of payments by the Province of Ontario as
the work nrogresses.
AND WHEHtAS the Corporation desires to -borrow money as
temporary advances pending the provision and receipts of funds

Please be advised that the above cited by-law has
received consideration as a charge against the allotment for
Special Capital Projects in the Department's estimates for
the current fiscal year.
The Honourable C. S. MacNaughton, Minister of
Highways, has approved of the proposed expenditure, for sub-
sidy purposes, to a limit of
7,500-00 for Construction,
SUBJECT TO 7H E FOLLOWING CONDITIONS:
1. That the expenditure(s) shall be made only for the
purposes set out in the by-law and supporting; pro-
r*ramme and shall not be diverted, either in whole
or in hart, to any other purpose without the , prior
consent in' writing of the Municipal Engineer.
2. That the individual works of road and bridge con-
struction and the purchase of each unit of equip-
ment and the award of contracts for same shall be
subject to the approval of an engineer of the
Municipal Roads Division.
3. That the District Municipal E'noineer shall be
informed and his consent obtained before tenders
are called for the proposed work or purchase and
before any commitment is made by the Municipality.
NSB. In the event that any portion of the cost of the
proposed work or purchase is to be raised in a
subsequent year or financed by the issue of
debentures, the approval of the Ontario Municipal
Board must be obtained before the work or purchase
is authorized or any commitment made with respect
thereto.
A copy of the by-law as approved is returned herewith.

follows: -
That, provided more persons qualify for election to office than are req-
uired to fill the various offices, an election be held on Dec. 6th. 1965
as according to Township of Bayham By -Law No. 1203, and in accordance with
provisions of the Municipal Election Act. ff
That the election for Sub -Division No. 1 shall be held at the Village Hall
in Port Burwell, and that Howard Chute shall be Deputy Returning
Officer and Percy Clarke Shall be Poll Clerk.

Being a by-law to stop up, close and sell a street in the Hamlet
of Straffordville according to registered Plan No. 205 of the said
Hamlet of Straffordville.
Chap. 249, R.S.O. 1960.
WHEREAS Section x.59, sub -section 1 (c) and (d)� provides that the
council of a municipality may pass a by-law for the purpose of
stopping up and selling any highway or part of a highway;

of Bayham that this street or portion of street be stopped up, closed
and sold; 41
THEREFORE BE IT ENACTED by the i,iunicipal Council of the Toy nship of
Bayham as follows;-

1. That the following portion of street in the Hamlet of Straffordv
ville be stopped up, closed and sold to one or more of the adjacent
owners:
(a) That portion of Otter StrLet extending easterly from Centre
Street to Plank Road or Into. 19 Highway, in accordance with
Registered Plan No. 205 of the Village of Straffordville.
2. That the above portion of street so stopped up and closed may be
sold either in whole or in parts to one or more of the adjacent land
owners.
3. That the Reeve and Clerk are hereby authorized to execute and
deliver conveyance of the said lands when sold, under the Corporate
Seal of the Township of Bayham.
4. That the Purchaser or Purchasers shall be responsible for all
cotts of conveyancing and any survey that may be necessary.
5. That this bylaw shall come into force and effect after being
conf irmi ed by a by-law of the County of Elgin.
