HomeMy WebLinkAboutZoning By-law No. Z627-2014 Comprehensive Zoning By-law Review THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO. Z627-2014 BEING A BY-LAW TO AMEND BY-LAW NO.Z456-2003,AS AMENDED WHEREAS the Council of the Corporation of the Municipality of Bayham deems it necessary to amend Zoning By-law No. Z456-2003, as amended; THEREFORE, the Council of the Corporation of the Municipality of Bayham enacts as follows: 1) THAT By-law No. Z456-2003, as amended, is hereby further amended deleting the sentence under Section 1.5, and by adding the following sentence: "In this By-law, the word "shall" is always construed as mandatory. " 2) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting subsection 2.39 in its entirety and replacing it with the following new subsection: "CEMETERY, shall mean land that is set apart or used as a place for the interment of the dead or in which human bodies and/or pets have been buried" 3) THAT By-law No. Z456-2003, as amended, is hereby further amended by adding to the first sentence of Section 2.51 the words "or open deck", after the word pool. 4) THAT By-law No. Z456-2003, as amended, is hereby further amended by adding to the first sentence of Section 2.65—Dwelling, Multi-Unit the words "on a permanent foundation", after the word units. 5) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting subsection 2.100 in its entirety and replacing it with the following new subsection: "GARAGE.PUBLIC,shall mean a building or structure other than a private garage where motor vehicles are kept or stored for remuneration or repair, including the complete repair to automobile bodies, motor cycles,frames, or motors, and the painting, upholstering, washing, and cleaning of such vehicles, and may include an automobile service station. " 6) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting subsection 2.110 in its entirety and replacing it with the following new subsection: "HOME OCCUPATION,shall mean an occupation for gain or support conducted entirely within a dwelling, as a secondary use by persons residing on the premises and which is clearly secondary to the main use of the dwelling unit. " 7) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting subsection 2.112 in its entirety, and renumbering Section 2 in accordance with the deletion. 8) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting Comprehensive Zoning By-law Review subsections 2.254—2.257 in their entirety, being the definitions "wind farm", "wind testing tower", "wind turbine", and"wind turbine, accessory". 9) THAT By-law No. Z456-2003, as amended, is hereby further amended by adding to Section 2 the following new subsection: "2.257 Shipping Container, means a standardized reusable vessel that was originally, specifically or formerly designed for or used in the packing, shipping, movement or transportation offreight, articles, goods or commodities; and/or designed for or capable of being mounted or moved on a rail car, truck trailer/chassis, or ship. " 10) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting the first paragraph under subsection 3.1 in its entirety and replacing it with the following: "For the purposes of this By-law, the maps hereto attached as Schedule "A", Maps 1 to 15 inclusive, Schedule "B", Schedule "C", Schedule "D" Schedule "E", Schedule "F", Schedule "G", Schedule "H", and Schedule "I", shall be referred to as the "Zoning Maps"for the Municipality of Bayham and the zoning maps shall be divided into one or more of the following zones:" 11) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending subsection 3.1,by adding "/AI-A" after the "Al" symbol; and by deleting the OS symbol and replacing it with the "OS 1/OS2" symbol; and by deleting the following rows in their entirety: "Hazard Lands HL Floodway FW Flood Fringe FF" 12) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Section 3.3,by adding the following sentence to the end of the first paragraph: "The purpose of individual holding zones are as follows:" AND by deleting subsections a)—d) and replacing them with the following new subsections: a) "hi Purpose: To ensure public health and safety, an agreement with the Municipality, or the satisfying of conditions of severance, which address impacts of new development to the applicable proposed water supply system and/or sewage treatment and disposal system; and which may include issues relating to water capacity, water quantity, water quality, and financial costs will be required prior to the removal of the "h1"zone symbol. b) h2 Purpose: To ensure orderly development, a subdivision agreement with the Municipality, which addresses financial and servicing impacts of new development to the Municipality, will be required prior to the removal of the "h2"zone symbol. c) h3 Purpose: To ensure the mitigation of impacts to natural heritage features and their ecological functions, an Environmental Impact Study will be required prior to the removal of the "h3"zone symbol. Comprehensive Zoning By-law Review d) h4 Purpose: To ensure parcels of land do not become landlocked, proof of access to a public right-of-way by the proponent will be required prior to the removal of the "h4"zone symbol. " 13) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Section 3, by adding the following new subsection: "3.9 Conservation Authority Regulation Limit 3.9.1 Any zone which is accompanied by the hatch/shading symbol identified as "conservation authority regulation limit", the uses normally permitted by that zone for lands, buildings or structures may only be allowed when written approval is obtained from the Conservation Authority. Permitted uses, when the "conservation authority regulation limit" symbol is applied, are limited to those that existed on the date when the holding by-law was passed 3.9.2 The conservation authority regulation limit does not delimit the extent of all the areas regulated by the Regulation (Ontario Regulation 178/06). Mapping will be periodically updated by the Conservation Authority as more detailed information becomes available. The areas described in the text of the Regulation prevail over the delineated boundary or where a line is absent." 14) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting subsection 4.4.3 in its entirety and replacing it with the following new subsection: "4.4.3 In the case of a dwelling unit permitted as an accessory use in a commercial zone, such dwelling unit shall be contiguous to the main commercial use, and be located above, below or in the rear of the main commercial use. " 15) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting from Section 4.5, the word "and Home Professions" from the title after the word Occupations. 16) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting from subsection 4.51), the words "home profession or home industry" after the word occupation. 17) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending subsection 4.8.1 c) and d)by deleting them in their entirety and adding the following new subsection: "c) The location, storage and use of a single-wide mobile home, a double-wide mobile home, or an expandable mobile home for the purposes of residential, commercial, industrial, or institutional uses. " 18) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting from the first sentence of Section 4.10 c) the "," (comma)notation after the word ceasing and replacing it with the following notation ";" (semi-colon). 19) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting from the first sentence of Section 4.14.4 the words "Ministry of Natural Resources or the", before the word Conservation Authority. 20) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Section 4, by deleting subsection 4.15 in its entirety, and subsequently renumbering the Comprehensive Zoning By-law Review remainder of Section 4 as a result of said deletion. 21) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Section 4.22.1, by deleting subsection a) and b) in their entirety, adding the following new subsections: a) "Provincial Highway:Varies. Subject to the review and approval of the Ministry of Transportation b) County Road: 26.0 metres from the centre line of the right-of-way" 22) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Section 4.26,by deleting the word"handicapped" and adding the word "accessibility"to the table AND by adding the following to the final row of the table: "Open decks Rear and side yard No maximum provided it is no closer than 1.2 metres to any lot line. Front yard 3.0 metres" 23) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending subsection 4.32 by renumbering the first paragraph as "4.31.1", and by adding the following new subsection: "4.32.2 A parking stall is to be a minimum of 5.5 metres x 2.7 metres. A barrier free parking stall is to be a minimum of 5.5 metres x 3.9 metres. " AND by adding the following new use and requirements in the Section 4.32 table: "Agri-Tourism, One (1)parking space per 40 m2 of gross floor Commercial greenhouses, area Market garden operations, Plant nurseries AND by adding"museums and community centres"after Auditoria, theatres, arenas, and halls in the Section 4.32 table. 24) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending subsection 4.39, by adding the words "and concrete" after the word asphalt. 25) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending subsection 4.51, by adding the words "which exceeds 0.5m in depth, and" after the word pool. 26) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Section 4, by adding the following new subsection: Comprehensive Zoning By-law Review "4.57 Conservation Authority Regulation Limit Notwithstanding any other provisions of this By-law, where lands are located within the defined area labelled as "conservation authority regulation limit" on any schedule to this By-law, no development shall be permitted without written approval from the conservation authority. Development shall mean the construction, reconstruction, erection or placing of a building or structure of any kind; any change to a building or structure that would have the effect of altering the use or potential use of the building or structure; increasing the size of the building or structure or increasing the number of dwelling units in the building or structure; site grading; or the temporary or permanent placing, dumping or removal of any material, originating on the site or elsewhere. " 27) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Section 4, by adding the following new subsection: "4.57 Conservation Authority Regulation Limit Notwithstanding any other provisions of this By-law, where lands are located within the defined area labelled as "conservation authority regulation limit" on any schedule to this By-law, no development shall be permitted without written approval from the conservation authority. " 28) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Section 4, by adding the following new subsection: "4.58 Container or Truck Trailer used for Storage Purposes Where a shipping container or truck trailer is used for the purpose of storage accessory to a principal use, the following provisions shall apply: a) A shipping container or truck trailer may not be located in any residential zone; b) A shipping container or truck trailer may not be located on any parcel of land in an agricultural zone that is less than 2ha in area, unless there are no off-site dwellings within 100 metres of the parcel of land; c) A shipping container or truck trailer may only be located in the rear yard and must comply with the regulations of Section 4.2 Accessory Uses" 29) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting subsection 4.57 Accessory Wind Turbines, in its entirety. 30) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting from the list in Section 5.2, "Bed& breakfast" and "One (1) supplementary farm dwelling to the farm operation"AND adding "Bed and Breakfast Lodging or Tourist Home"to the Comprehensive Zoning By-law Review list. 31) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting the following from the table in Section 5.3.1: Supplementary farm dwelling 20.0 ha. (50 acres) 32) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting the following wording under subsection 5.6: "For a mobile home used or intended to be used as a supplementary farm dwelling: 55.0 mz 33) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Section 5.12,by changing the individual references found in the various sections from Schedule A, Maps 1 - 84, to Schedule A, Maps 1- 15, accordingly. 34) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Section 6.12, by changing the individual references found in the various sections from Schedule A, Maps 1 - 84, to Schedule A, Maps 1- 15, accordingly. 35) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending subsection 7.11.1, by deleting the last sentence in its entirety. 36) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Section 7.13, by changing the individual references found in the various sections from Schedule A, Maps 1 - 84, to Schedule A, Maps 1- 15, accordingly. 37) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting from the list in Section 8.1, "Bed and breakfast establishment or tourist home" and adding "Bed and Breakfast Lodging or Tourist Home,"to the list. 38) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Section 8.13, by changing the individual references found in the various sections from Schedule A, Maps 1 - 84, to Schedule A, Maps 1- 15, accordingly. 39) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting from the list in Section 9.1, "Bed and breakfast establishment or tourist home" and adding "Bed and Breakfast Lodging or Tourist Home,"to the list. 40) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting from Section 9.8, the number"6.0" and adding the number"7.0", before the word metres. 41) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Section 9.12, by changing the individual references found in the various sections from Schedule A, Maps 1- 84, D1, and D2, to Schedule D, accordingly. 42) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting from the list in Section 10.1, the words "and home profession" after the word occupation AND deleting "Bed and breakfast establishment or tourist home to a maximum of two (2) rooms for sleeping accommodations" and adding "Bed and Breakfast Lodging or Tourist Home,"to the list. 43) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting Comprehensive Zoning By-law Review Section 10.3 in its entirety and replacing it with following section: "10.3 Minimum Lot Area Vienna, Port Burwell:800 m2, or 1390 m2 where no public water supply or sanitary sewage disposal service are available Straffordville: 900 m2, or 1390 m2 where no public water supply or sanitary sewage disposal service are available 44) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting subsection 10.5 in its entirety. 45) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending subsection 10.9.5 by deleting the words "1.5 metres", and replacing it with the words "1.2 metres". 46) THAT By-law No. Z456-2003, as amended, is hereby further amended by adding to Section 10.9 the following subsection: "10.9.4 On a lot with a semi-detached dwelling, the interior lot line width that forms the party wall shall be 0.0 metres. " 47) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending subsection 10.11 a) Regulations for Accessory Buildings,by deleting the words "Notwithstanding the provisions of paragraph a)". 48) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Section 10.12,by changing the individual references found in the various sections from Schedule F, Maps 1-4, Schedule H, Mapsl - 2, and Schedule I, Maps 1- 6, to Schedule F, H, and I, accordingly. 49) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting from the list in Section 11.1, the words "or home profession" after the word occupation. 50) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting subsection 11.5 in its entirety. 51) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Section 11.12.1,by changing the reference from "Schedule H, Map No. 1", to "Schedule H". 52) THAT By-law No. Z456-2003, as amended, is hereby further amended by adding to the list in Section 12.1, "or modular dwelling" after mobile home AND adding"Accessory Uses"to the list. 53) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting Section 12.9 and replacing it with the following: "12. 9 Minimum Rear Yard Depth Mobile home park: 6.0m Mobile home site: 6.0 metres" Comprehensive Zoning By-law Review 54) THAT By-law No. Z456-2003, as amended, is hereby further amended by adding the following new subsection: "12.11 Regulations for Accessory Buildings Notwithstanding the provisions of Section 4.2, the following shall apply: a) One utility shed permitted to a maximum floor area of 12.0 m2 and maximum height of 3.1 m per mobile home site; b) Open deck permitted to a maximum 3.1 m width not to exceed mobile home length; c) No accessory use shall be located within 1.5 m of mobile home site septic tank; d) Open storage is prohibited on mobile home sites. " 55) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Section 12.11,by changing the individual references found in the various sections from Schedule A, Maps 1 - 84, to Schedule A, Maps 1- 15, accordingly. 56) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Section 14.10, by changing the individual references found in the various sections from Schedule A, Maps 1 - 84, to Schedule A, Maps 1- 15, accordingly. 57) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Section 15.10, by changing the individual references found in the various sections from Schedule A, Maps 1 - 84, to Schedule A, Maps 1- 15, accordingly. 58) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Section 16.9,by deleting the words "Map No. 2" after Schedule D. 59) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting from the list in Section 17.1, "Bed and breakfast establishment or tourist home" and adding "Bed and Breakfast Lodging or Tourist Home,"to the list. 60) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting subsection 17.4 in its entirety. 61) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting from Section 17.7, the text"Front Street" and replacing it with"Plank Road". 62) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting from Section 17.10.1, the text"17.3" and replacing it with"17.2". 63) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting from Section 17.10.2,the numbers "4.45" and replacing it with "4.44 Floor Area", after the word Section. 64) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Section 17.11,by changing the individual references found in the various sections from Schedule F, Maps 1-4, Schedule H, Maps 1-2, to Schedule F and H accordingly. 65) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Section 17, by adding the following new subsection: Comprehensive Zoning By-law Review "17.11.3 17.11.3.1 Defined Area CI-3 as shown on Schedule "H", Map No. 2 to this By-law. 17.11.3.2 Site, Building and Lot Regulations Notwithstanding the underlying regulation limit, nothing shall prevent the construction of buildings or structures accessory thereto subject to compliance with the regulations in Sections 4.2, 4.3 or 4.4 of this By-law. " 66) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting subsection 18.5 in its entirety, and subsequently renumbering subsections 18.6 through 18.13 accordingly. 67) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Section 18.13, by deleting the individual references to "Map 1"in their entirety. 68) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting from the list in Section 19.1, "Bed and breakfast establishment or tourist home" and adding "Bed and Breakfast Lodging or Tourist Home,"to the list. 69) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Section 20.10, by changing the individual references found in the various sections from Schedule A, Maps 1 - 84, to Schedule A, Maps 1- 15, accordingly. 70) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Section 21.10, by changing the individual references found in the various sections from Schedule A, Maps 1 - 84, to Schedule A, Maps 1- 15, accordingly. 71) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending subsection 23.11 b)by deleting the words "Section 4.45" and replacing it with the words "Section 4.46". 72) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Section 23.13, by removing all references to "Map 1"found therein. 73) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Section 24.10,by changing the individual references found in the various sections from Schedule A Maps 1-84, and Schedule F, Map No. 4 to Schedule A, Maps 1-15, and Schedule F, accordingly. 74) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting Section 25 in its entirety and replacing it with a new Section 25 Open Space (OS) Zone Regulations, which is attached as Schedule A to this by-law; 75) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting Section 26, Section 27, and Section 28 in their entirety; 76) THAT By-law No. Z456-2003, as amended, is hereby further amended by renumbering Section 29 as Section 26; 77) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting Section 26.1 in its entirety and replacing it with the following section: Comprehensive Zoning By-law Review "26.1 Permitted Uses The following temporary uses will be permitted subject to a site-specific Zoning By-law amendment for the time period ending as listed in Section 29.4: Tl: One (1) mobile home or one (1) travel trailer to be used as a site office or for accommodation for a caretaker or watchman during a large construction project. T2: A land use activity on a specific parcel of land which is appropriate in the short term, but is otherwise prohibited in the Zoning By-law. " 78) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting from Section 26.3,the word"be", before the word revert. 79) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting from the previously known as Section 29.4, subsections 29.4.1 through to 29.4.8, and 29.4.10 through to 29.4.16, and renumbering subsection 29.4.9 as subsection 29.4.1, and that the new subsection 29.4.1 by further amended by replacing the number 62 with the new number 12. 80) THAT By-law No. Z456-2003, as amended, is hereby further amended by deleting Section 30 in its entirety; 81) THAT By-law Z456-2003, as amended, is hereby further amended by deleting Map Schedules "A", "B", "C", "D", "E", "F", "G", "H", and "I" in their entirety and replacing them with the new Map Schedules "A", "B", "C", "D", "E", "F", "G", "H", and"I" which are found in Schedule B to this by-law, which schedule is attached to and forms part of this By-law; 82) THIS By-law comes into force: a) Where no notice of objection has been filed with the Municipal Clerk within the time prescribed by the Planning Act and regulations pursuant thereto,upon the expiration of the prescribed time; or b) Where notice of objection has been filed with the Municipal Clerk within the time prescribed by the Planning Act and regulations pursuant thereto, upon the approval of the Ontario Municipal Board. READ A THIRD TIME AND FINALLY PASSED THIS 20th DAY OF MARCH 2014. /aid' MAY I R CL RK Comprehensive Zoning B;•-law Review SCHEDULE A (SECTION 25 — OPEN SPACE (OS) ZONE REGULATIONS) The following forms Schedule "A"to By-law Z627-2014,passed the 20th Day of March, 2014 6MA OR CLERK 25-1 SECTION 25 OPEN SPACE (OS) ZONE REGULATIONS 25.1 Permitted Uses 25.1.1 No land shall be used and no buildings or structures shall be erected,used or altered in the Open Space 1 (OS1)Zone except for the following purposes: Agricultural Uses; Boathouses without dwelling units; Conservation area; Forestry use; Marina; Passive recreational uses; Parking area(public); Plant Nurseries; Public or private parks; Public utility facilities and services including bridges and culverts; Water-oriented recreational uses including docks; Accessory uses. 25.1.2 No land shall be used and no buildings or structures shall be erected,used or altered in the Open Space 2(0S2)Zone except for the following purposes: All uses listed in the OS1 Zone; Campground; Fairgrounds; Institutional uses or community centre; Buildings and structures accessory to the above uses; 25.2 OS1 Zone Regulations 25.2.1 In the OS 1 Zone,buildings and structures for the uses outlined in section 25.1 are permitted,provided that they have received written approval by the Conservation Authority, and meet the lot and building regulations outlined for the 0S2 Zone. 25.2.2 In the OS 1 Zone, all habitable buildings and structures are prohibited 25.3 0S2 Zone Regulations 25.3.1 Minimum Lot Area:4000m2 25.3.2 Minimum Lot Frontage: 30.0 metres 25.3.3 Maximum Lot Coverage: 20% 25-2 25.3.4 Maximum Building Height: 12.0 metres 25.3.5 Minimum Yard Depths and Widths: 7.5 metres 25.3.6 Minimum Distance Separation from Livestock Buildings and Structures: 150.0 metres or the distance determined on application of M.D.S.
