HomeMy WebLinkAboutZoning By-law No. Z556-2008 THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO.Z556-2008 (Housekeeping 2007) BEING A BY-LAW TO AMEND BY-LAW No.Z456-2003,AS AMENDED WHEREAS the Council of the Corporation of the Municipality of Bayham deems it necessary to amend Zoning By- law No. Z456-2003, as amended; THEREFORE,the Council of the Corporation of the Municipality of Bayham enacts as follows: 1) THAT By-law No.Z456-2003,as amended,is hereby further amended by adding the following subsection to Section 2.0—Definitions: "2.258 Water-Related Commercial and Recreational Use, shall mean the use of land, water and/or building for the purpose of commercial and/or recreational uses which require proximity to water for their existence,and shall include but not be limited to,a commercial fishing operation,charter fishing operation,boat rentals,and ancillary facilities" 2) THAT By-law No.Z456-2003, as amended, is hereby further amended by modifying subsection 2.21 and 2.114 as follows: "2.21 BED AND BREAKFAST LODGING or TOURIST HOME,shall mean a dwelling unit or part of a dwelling unit used for the purpose of catering to the needs of the traveling public,by supplying food and furnishing sleeping accommodations to a maximum of four (4)separate guest rooms,and a maximum of eight(8)individual guests." "2.114 HOTEL,shall mean any hotel,tavern,inn,lounge,or public house in one main building or in two or more buildings used mainly for the purposes of catering to the needs of the traveling public by supplying food and furnishing sleeping accommodation of not less than five (5) guest rooms, which guest rooms contain no provisions for cooking, and shall include all such buildings operating under the Liquor License Act, and the Tourist Establishments Act,as amended from time to time." 3) THAT By-law No. Z456-2003, as amended, is hereby further amended by modifying the following subsection of Section 4.32—Parking Requirements as shown in bold: Tourist homes, bed and breakfast One(1)parking space per guest room, plus establishments,boarding and rooming house one(1) space for an owner/operator 4) THAT By-law No.Z456-2003,as amended,is hereby further amended by deleting subsection 10.11 a)in its entirety. 5) THAT By-law No.Z456-2003,as amended,is hereby further amended by deleting subsection 11.11 a)in its entirety. 6) THAT By-law No.Z456-2003,as amended,is hereby further amended by replacing subsection 4.2 h)with the following new subsection: "h) Shall not be built within two (2.0) metres of the main building or another accessory building;" 7) THAT By-law No. Z456-2003, as amended, is hereby further amended by adding the following new subsection to Section 4.12—Temporary Uses as follows: "c) Where a building is being used as temporary living quarters, it is used only as long as necessary for work in progress, or a period of 2 years, whichever is less, and that such building is removed within 60 days of issuance of an occupancy permit by the Chief Building Official." 8) THAT By-law No.Z456-2003,as amended,is hereby further amended by deleting subsection 4.14.1 d)in its entirety and replacing it with the following new subsection: "d) Closer than four and one-half(4.5)metres from the centre line of a municipal tile drain;" 9) THAT By-law No. Z456-2003, as amended, is hereby further amended by modifying Section 4.26 — Permitted Encroachments in Yards, for the cantilevered wall row as outlined in bold below: Cantilevered wall Any yard 0.7 metres,provided it is no closer than 1.2 metres to any lot line 10) THAT By-law No.Z456-2003,as amended,is hereby further amended by amending Section 5.1 by deleting the following wording for a permitted use: "Single detached dwellings lawfully in existence as of the date of the passing of this By-law or on lots existing as of the date of the passing of this By-law;" And replacing it with the following wording: "Single detached dwellings lawfully in existence as of the date of the passing of this By-law or one new single detached dwelling on a vacant lot subject to all other applicable regulations of this By-Iaw;" 11) THAT By-law No.Z456-2003,as amended, is hereby further amended by deleting subsection 9.5.1 in its entirety and replacing it with the following new subsection: 9.5.1 Maximum Accessory Building Height 4.5 metres" 12) THAT By-law No. Z456-2003, as amended, is hereby further amended by adding "motor vehicle sales establishment"in Section 17.1 —Permitted Uses of the Central Business District(C1)Zone Regulations. 13) THAT By-law No.Z456-2003,as amended,is hereby further amended by amending Schedule"A",Map No. 5, by deleting from the Agricultural-A(Al-A)Zone and adding to the site-specific Agricultural(Al-2-A) Zone,those lands outlined in heavy solid lines and marked A1-2-A on Schedule"A"to this By-law,which schedule is attached to and forms part of this By-law. 14) THAT By-law No.Z456-2003,as amended,is hereby further amended by amending Schedule"A",Map No. 29, by deleting from the site-specific Estate Residential(ER-9)Zone and adding to the Estate Residential (ER)Zone,those lands outlined in heavy solid lines and marked ER on Schedule"B"to this By-law,which schedule is attached to and forms part of this By-law. 15) THAT By-law No.Z456-2003,as amended,is hereby further amended by amending Schedule"A",Map No. 43,by deleting from the site-specific Rural Residential(RR-11)Zone and adding to the Special Agricultural (A2)Zone and deleting from the Agricultural (Al)Zone and adding to the Rural Residential (RR)Zone, those lands outlined in heavy solid lines and marked A2 and RR on Schedule"C"to this By-law, which schedule is attached to and forms part of this By-law 16) THIS By-law comes into force: a) Where no notice of objection has been filed with the Municipal Clerk within the time prescribed by the Planning Act and regulations pursuant thereto,upon the expiration of the prescribed time; or b) Where notice of objection has been filed with the Municipal Clerk within the time prescribed by the Planning Act and regulations pursuant thereto,upon the approval of the Ontario Municipal Board.
