HomeMy WebLinkAboutBy-law No. 2014-087 THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW 2014- 087 BEING A BY-LAW TO STOP UP, CLOSE AND CONVEY PART OF THE UNOPENED ROAD ALLOWANCE KNOWN AS GREEN LINE (SOUTH OF PRESSEY ROAD) AND MUNICIPAL OWNED LAND OF THE MUNICIPALITY OF BAYHAM, FORMERLY TOWNSHIP OF BAYHAM, IN THE COUNTY OF ELGIN, DESIGNATED AS PARTS 1, 2 &3 ON REGISTERED PLAN 11R-6107. WHEREAS Section 11 of the Municipal Act,2001, S.O. 2001, c. 25 as amended provides that a lower tier municipality may pass by-laws respecting Highways,including parking and traffic on highways; AND WHEREAS Section 8 of the said Municipal Act provides that a municipality has the capacity,rights,powers, and privileges of a natural person for the purpose of exercising its authority under this or any other Act; AND WHEREAS notice of intent to pass this By-law has been published once in the Tillsonburg Independent News on July 23,2014, a newspaper of general circulation to the area; AND WHEREAS the Council of the Corporation of the Municipality of Bayham has heard in person, or by counsel, solicitor or agent, all persons claiming that their land will be prejudicially affected by this By-law and who applied to be heard; AND WHEREAS the Council of the Corporation of the Municipality of Bayham deems it expedient to stop up, close and convey that part of the unopened road allowance known as Green Line (south of Pressey Road) and municipal land designated as Parts 1,2 &3 on Registered Plan 11R-6107 of the Municipality of Bayham, formerly Township of Bayham, in the County of Elgin, and to convey such parts to the adjoining land owners. THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS: 1. THAT upon and after the passing of this By-law those portions of the unopened road allowance known as Green Line(south of Pressey Road) according to Registered Plan 11R6107 of the Municipality of Bayham, formerly Township of Bayham, in the County of Elgin,designated as Parts 1 &2 be and are hereby closed and stopped up. 2. THAT upon and after the passing of this By-law the municipal land designated as Part 3 on Registered Plan 11R6107 be conveyed. By-Law 2014-087 2 3. THAT part of the said unopened road allowance described as Green Line designated as Part 1 on Plan 11R6107, shall be conveyed to James Andrew Underhill for nil consideration. 4. THAT part of the said unopened road allowance described as Green Line designated as Part 2 on Plan 11 R-6107,shall be conveyed to Best Line Farms Ltd. for nil consideration. 5. THAT municipal land designated as Part 3 on Plan 11R6107 shall be conveyed to Best Line Farms Ltd. for nil consideration. 6. THAT the Mayor and Clerk of The Corporation of the Municipality of Bayham be and they are hereby authorized and directed to execute such deeds or other documents as may be necessary to effect conveyances of those parts of the said road allowances and municipal Iand described herein and which have been stopped up and closed. 7.
