HomeMy WebLinkAboutBy-law No. 2013-053 THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NUMBER 2013-053 BEING A BY-LAW TO AMEND BY-LAW NO. 2012-066 Being a by-law to provide for the maintenance, management and control of Cemeteries under the jurisdiction of the Municipality of Bayham in accordance with the Funeral, Burial and Cremation Services Act, 2002 and Ontario Regulation 30111. Whereas the Council of the Corporation of the Municipality of Bayham passed By-law No. 2012-066 on June 7, 2012 for the provision for maintenance, management and control of cemeteries under the jurisdiction of the municipality, and subsequently approved by the Ministry of Government Services, Cemeteries Regulation on August 17, 2012; And Whereas the Council of the Corporation of the Municipality of Bayham deems it necessary and expedient to amend said by-law 2012- 066; Now therefore the Council of the Corporation of the Municipality of Bayham hereby enacts as follows: 1. That By-law 2012-066, Section F: Interment, sub-section 5 be amended to read: "No more than three interments may be made in the same lot, and the first interment must be in a concrete vault, and the remaining two interments must be cremation burials for which proper authorization has been documented and approved by the cemetery representative. (Installation of a concrete vault for all casket type burials is recommended for safety precautions.); 2. That Section F: Interment, subsection 6 be amended to read: "A full body casket or casket in a vault interment must be to a depth that will ensure at least two feet of earth coverage over the case at the surrounding ground level; 3. That under Section H: Markers the following be added as subsection 3: One flat marker only, at a maximum size of 24" x 14", or less, be permitted on a cremation lot, placed flush with the ground on top of a 12" diameter post hole filled with a minimum depth of 3 feet of concrete; 5. That Schedules "A"to "F"attached to By-law 2012-066 be amended to reflect the above items 1 through 4, as applicable; 6. That this By-law shall be in full force and effect upon final passage and approval of the Ministry of Consumer Services Consumer Protection Branch Cemetery and Crematorium Regulation Unit.
