HomeMy WebLinkAboutBy-law No. 2013-030 THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO.2013-030 A BY-LAW TO AUTHORIZE THE SALE OF LANDS OWNED BY THE MUNICIPALITY OF BAYHAM WHEREAS Section 8 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that a municipality has the capacity, rights, powers, and privileges of a natural person for the purpose of exercising its authority under this or any other Act. AND WHEREAS Section 268(1) of the said Municipal Act provides in part that every municipality with authority to sell land shall pass a by-law establishing procedures governing the sale of land. AND WHEREAS the Municipality of Bayham passed By-law No. 2002-059 to establish a procedure governing the sale of municipal owned land. AND WHEREAS the Council of the Municipality of Bayham is desirous of selling property owned by the Municipality to the abutting landowners, and has completed procedures pursuant to By-law No. 2002-059 for the sale of the subject lands. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICPALITY OF BAYHAM ENACTS AS FOLLOWS: 1. THAT the Council of the Municipality of Bayham authorizes the Mayor and Clerk to execute such documents as may be necessary to provide for the sale of real property described as Part of Lot 1, R.J. McNaughton Block, West of Plank Road, North of Talbot Road, Registered Plan 205 (Village of Straffordville), former Township of Bayham, now Municipality of Bayham, County of Elgin, designated as Part 1 on Plan 11R-7083, and assigned roll number 34-01-000-004-34100 to John Blondeel and Kathy Blondeel for consideration of$110,000. 2. AND THAT this by-law shall come into full force and effect upon final passing. READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED THIS 4TH DAY OF APRIL, 2013. RAJ e,,, MAYOR CLERK
