HomeMy WebLinkAboutBy-law No. 2012-102 THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO. 2012-102 A BY-LAW TO AUTHORIZE THE PURCHASE OF REAL PROPERTY IN THE MUNICIPALITY OF BAYHAM DESCRIBED AS PART OF LOT 13,CONCESSION 5,IN THE MUNICIPALITY OF BAYHAM,DESIGNATED AS PART 1 ON PLAN 11R-9419. WHEREAS Section 8 of the Municipal Act,2001, SD. 2001, c. 25, as amended,provides that a municipality has the capacity,rights,powers, and privileges of a natural person for the purpose of exercising its authority under this or any other Act. WHEREAS Subsection 81 (2)of the Cemeteries Act(Revised),R.S.O. 1990,c. C.4 as amended, provides in part that the council of a municipality may pass by-laws authorizing the acquisition of land within the municipality or in an adjacent township or unorganized territory for a cemetery or for the enlargement of an existing cemetery owned by the municipality; AND WHEREAS the Council of the Municipality of Bayham is desirous of acquiring property from Dan Froese Farms Inc. for the purpose of expansion for the Smuck Cemetery; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICPALITY OF BAYHAM ENACTS AS FOLLOWS: 1. THAT the Council of the Municipality of Bayham hereby authorizes and directs the Mayor and Clerk to execute such documents as may be necessary to provide for the purchase of real property from Dan Froese Farms Inc., being part of Lot 13, Concession 5, in the geographic Township of Bayham, now Municipality of Bayham, County of Elgin, being Part 1 on Plan 11R-9419, for consideration in the amount of$1,180. 2.
