BY-LAW NO. 2012-078
A BY-LAW TO AUTHORIZE THE SALE OF LANDS OWNED BY THE
MUNICIPALITY OF BAYHAM
WHEREAS Section 8 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that a
municipality has the capacity, rights, powers, and privileges of a natural person for the purpose of
exercising its authority under this or any other Act.
AND WHEREAS Section 268(1) of the said Municipal Act provides in part that every
municipality with authority to sell land shall pass a by-law establishing procedures governing the
sale of land.
AND WHEREAS the Municipality of Bayham passed By-law No. 2002-059 to establish a
procedure governing the sale of municipal owned land.
AND WHEREAS the Council of the Municipality of Bayham is desirous of selling property
owned by the Municipality to the abutting landowners, and has completed procedures pursuant to
By-law No. 2002-059 for the sale of the subject lands.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE
MUNICPALITY OF BAYHAM ENACTS AS FOLLOWS:
1. THAT the Council of the Municipality of Bayham authorizes the Mayor and Clerk to
execute such documents as may be necessary to provide for the sale of real property
described as Concession 7, NTR Pt Lot 126, former Township of Bayham, designated as
Part 1, RP11R-3950, and assigned roll number 34-01-000-004-27506 to James Fuller for
consideration of$11,500.
2. THAT the Council of the Municipality of Bayham authorizes the Mayor and Clerk to
execute such documents as may be necessary to provide for the sale of real property
described as Plan 12, Pt. Lot 23, former Village of Port Burwell, and assigned roll number
34-01-002-001-16900 to France Marie Caroline Boucher for consideration of$4,900.
3. THAT the Council of the Municipality of Bayham authorizes the Mayor and Clerk to
execute such documents as may be necessary to provide for the sale of real property
described as Plan 12, Pt. Lot 23, former Village of Port Burwell, and assigned roll number
34-01-002-001-24205 to776497 ti Ontario Limited for consideration of$14,900.
READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED THIS 5TH DAY
OF JULY,2012.
