HomeMy WebLinkAboutNovember 20, 2014 - Council COUNCIL MINUTES THE CORPORATION OF THE MUNICIPALITY OF BAYHAM 9344 Plank Road, Straffordville, ON Council Chambers Thursday, November 20, 2014 7:00 p.m. The regular meeting of the Council of the Municipality of Bayham was held on Thursday, November 20, 2014 in the Council Chambers. Present were Mayor Paul Ens, Councillors Wayne Casier, Tom Southwick and Ed Ketchabaw, Administrator Paul Shipway and Clerk Lynda Millard. Deputy Mayor Cliff Evanitski was absent. Chief Building Official I Drainage Superintendent Bill Knifton, Public Works Manager Vance Czerwinski were in attendance to present their respective reports and Public Works Operations Supervisor Ed Bradfield was also present. 1. CALL TO ORDER Mayor Ens called the meeting to order at 7:00 p.m. 2. DISCLOSURE OF PECUNIARY INTEREST & THE GENERAL NATURE THEREOF No disclosures of pecuniary interest were declared. 3. APPROVAL OF MINUTES AND ADDITION OF AGENDA ITEMS (a) Minutes of the regular meeting of Council held November 6, 2014. 2014-533 Moved by: Councillor T Southwick Seconded by: Councillor W Casier "THAT the minutes of the regular meeting held November 6, 2014 be approved as circulated." DELEGATIONS (a) 7:05 p.m. - Lauren Millier from Milker, Dickinson, Blais regarding "Municipality of Bayham Economic Development Opportunities Initiatives Plan". File: D02 Mayor Ens noted this delegation was cancelled due to inclement weather conditions and would be rescheduled in January. 2. STATEMENTS BY COUNCIL Mayor Ens announced that the Volunteer Appreciation night, which recognizes all volunteers in Bayham, will be held at 7:00 p.m. on Thursday, November 27th at the Vienna Community Centre and encouraged everyone to spread the word and attend to support our local volunteers. 5. CARRIED UNANIMOUSLY 7. ROADS, AGRICULTURE & DRAINAGE 8. PROPERTY, BUILDING & PROTECTIVE SERVICES (a) Staff Report F2014-019 regarding "Building By-Law". File: CO1 CBO Bill Knifton identified minor increases to building fees that are proposed, noting that these increases continue to be competitive to fees of neighbouring municipalities. 2014-537 Moved by: Councillor W Casier Seconded by: Councillor E Ketchabaw "THAT Staff Report P2014-019 regarding proposed amendments to the Building By-Law be received; AND THAT Council directs staff to prepare a new rates and fees by-law that includes the amendments to the Building By-Law, as proposed, for Council's consideration." File: C01 Mr. Knifton noted that these heating units are now regulated by legislation and to meet CSA standards and restrictions on placement and setbacks, a permit is necessary. 2014-538 Moved by: Councillor W Casier Seconded by: Councillor E Ketchabaw "THAT Staff Report P2014-020 regarding information on Outdoor Solid Fuel Combustion Appliances be received for information." File: R00 2014-541 Moved by: Councillor E Ketchabaw Seconded by: Councillor W Casier "THAT the correspondence from the Township of Malahide regarding Doors Open East Elgin 2015 be received; THAT the Council of the Municipality of Bayham agrees to participate in the Doors Open East Elgin 2015; THAT Council approves financial support for the 2015 registration fee of $1,695.00 (Bayham's share being $565.00) along with a share of minimal costs for advertising and marketing of the event; AND THAT the funds be drawn from the 2014 tourism operating budget." CARRIED UNANIMOUSLY (d) Correspondence dated November 4, 2014 from County of Elgin regarding "Plank Road Pedestrian Crossing Survey - Straffordville Public School". File: T08 The Administrator confirmed that the County relied on the gap analysis by the Commissionaires rather than have a study conducted. The County is responsible for the establishment of appropriate pedestrian crossing measures when deemed to be necessary. County approval for any actions by the municipality, would be supported by them, at the municipality's full cost. 2014-542 Moved by: Councillor E Ketchabaw Seconded by: Councilor W Casier "WHEREAS pursuant to the correspondence of August 15, 2014 of Peter Dutchak, CET, CRS Deputy Director of Engineering Services Elgin County 'if a pedestrian crossing warrants as identified in the Ontario Traffic Manual (OTM) are met, a pedestrian crossing facility is the County's responsibility to provide'; AND WHEREAS the F.R. Berry & Associates Plank Road Pedestrian Crossing Survey obtained by the County of Elgin determined that `mechanically operated pedestrian crossing facilities are not justified near Straffordville Public School; Page 5 of 9 Council Minutes November 20,2014 AND WHEREAS pursuant to the August 15, 2014 correspondence of Elgin County 'if OTM warrant criteria is not met, the local municipality may install a pedestrian crossing facility on a County road at its cost' NOW THEREFORE, BE IT RESOLVED: THAT the Council of the Corporation of the Municipality of Bayham receive Correspondence Item No. 9(d) for information; THAT no action be taken by the Municipality of Bayham with respect to the school crossing guard request; THAT a copy of this resolution be sent to Straffordville Public School and the Thames Valley District School Board; AND THAT Council request the County investigate signage enhancements to the school zone." CARRIED UNANIMOUSLY (e) Staff Report F2014-033 regarding "The Canadian Radiocommunications Information and Notice Service (CRINS-SINRC)". File: Al2 2014-543 Moved by: Councillor E Ketchabaw Seconded by: Councilor W Casier "THAT Report F2014-033 be received for information; THAT the Council of the Corporation of the Municipality of Bayham participate in CRINS-SINRC and to utilize the services of CRINS-SINRC to manage the processing of all radiocommunications applications within the jurisdiction of the Municipality of Bayham in our capacity as the Land Use Authority as recognized by Industry Canada under Client Procedure Circular (CPC) 2-0-03, Issue 5 (2014); THAT Council of the Corporation of the Municipality of Bayham hereby authorizes CRINS-SINRC and its staff to act as the authorized representative of the Municipality of Bayham pursuant to Section 4 of CPC 2-0-03, Issue 5 for the purpose of receiving and acting upon all radiocommunications applications, reporting to and working with the Deputy Clerk/Planning Coordinator; AND THAT the Council of the Corporation of the Municipality of Bayham direct staff to bring forward a by-law for Council consideration to adopt the CRINS-SINRC Reference Protocol Issue 2, and subsequent amendments as may be approved from time to time, as the municipality's protocol in force for all radiocommunications applications."
