BY-LAW NO. 2007-059
Being a By-law to appoint Ministry of Natural Resources (Ontario Parks) staff as
Municipality of Bayham By-law Enforcement Officers for the purpose of enforcing
provisions of By-law 2001-111.
WHEREAS Paragraph 45 of Section 207 of the Municipal Act, R.S.O., 1990 Chapter, M.45,
as amended, permits municipalities to pass by-laws appointing officers and employees as
may be necessary for the purposes of the Corporation;
AND WHEREAS the Council of the Corporation of the Municipality of Bayham deems it
appropriate to appoint additional By-law Enforcement Officers for the Municipality.
THEREFORE the Council of The Corporation of the Municipality of Bayham enacts as
follows:
1. THAT Ministry of Natural Resources (Ontario Parks) employees listed in Schedule
"A" of this By-law, are hereby appointed to act in the capacity of By-Law Enforcement
Officer for the Municipality of Bayham for the limited purpose of enforcement of
Municipality of Bayham By-law 2001-111, as amended, on the streets known as
Addison Street, Libbye Avenue, Libbye Street, Chatham Street and Fay Street,
Village of Port Burwell.
2. THAT the Mayor and Clerk be and they are hereby authorized and directed to
execute a Memorandum of Understanding between the Corporation of the
Municipality of Bayham and Ministry of Natural Resources (Ontario Parks) affixed
hereto and forming part of this By-law as Schedule "B".
3. THAT this by-law shall come into force and take effect immediately upon third
and final reading thereof.

Memorandum of Understanding
between
The Corporation of the Municipality of Bayham (the Municipality)

WHEREAS The Corporation of the Municipality or Bayham has designated Ministry of
Natural Resources (Ontario Parks) staff as By-law Enforcement Officers for the purpose
of enforcing provisions of By-law 2001-111, as amended, being a By-law for the
Regulation of Traffic (Parking), on streets known as Addison Street, Village of Port
Burwell.
AND WHEREAS The Ministry of Natural Resources (Ontario Parks) has designated staff
as Provincial Offences Officers under the Provincial Offences Act, and agrees to provide
staff for the purpose of enforcing provisions of By-law 2001-111, as amended, being a
By-law for the Regulation of Traffic (Parking), on streets known as Addison Street, Village
of Port Burwell.
AND WHEREAS The Corporation of the Municipality of Bayham and the Ministry of
Natural Resources (Ontario Parks) are desirous to enter into a Memorandum of
Understanding for enforcement of parking infractions on Addison Street in the Village of
Port Burwell.
THEREFORE the above parties agree as follows:
1. The Municipality agrees to appoint Ministry staff as By-law Enforcement Officers for the
purpose of enforcing provisions of Municipality of Bayham By-law 2001-111, as amended
for streets known as Addison Street, Village of Port Burwell.
2. The Ministry will ensure staffs appointed as Municipality of Bayham By-law Enforcement
Officers are also appointed as Provincial Offences Officers pursuant to the Provincial
Offences Act.
3. The Ministry agrees to provide staff to enforce the provisions of Municipality of Bayham
By-law 2001-111,as amended on streets known as Addison Street, Village of Port Burwell,
at the discretion of the Ministry.
4. The Ministry agrees to conduct all administrative duties related to filing of tickets and or
summons, issued by Ministry staff, with the appropriate Provincial Offences Court office.
5. The Ministry will be responsible to ensure their staff is available to attend court
proceedings/trials as required.
6. The Municipality agrees to provide parking tickets to the Ministry as required.
