HomeMy WebLinkAboutBy-law No. 2006-070 THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO. 2006-070 A BY-LAW TO AUTHORIZE THE EXECUTION OF A MEMORANDUM OF COOPERATION BETWEEN THE MUNICIPALITY OF BAYHAM AND THE VILLAGE OF GRAND RIVER WHEREAS the Municipality o#-Bayham is desirous of entering into a Memorandum Of Cooperation with the Village of Grand River, Ohio. THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS: 1. THAT the Mayor is hereby authorized to execute the Memorandum of Cooperation, attached hereto as Schedule"A" and forming part of this by-law,between the Municipality of Bayham and the Village of Grand River, Ohio. 2. THAT this by-law shall come into full force and effect upon final passing. READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED THIS 13TH DAY OF JULY 2006. fA I ..d;•y")1ACL\P•P\ ` Y CLERK kct1,14e "A " r3y .l�w 9..006 - 0-70 MEMORANDUM OF COOPERATION BETWEEN: THE VILLAGE OF GRAND RIVER (205 Singer Avenue, Grand River, Ohio 44045) - and- MUNICIPALITY OF BAYHAM (9344 Plank Road,Straffordville, Ontario NOJ 1Y0) WHEREAS the Municipal Corporations of the Village of Grand River,Ohio("Grand River")and the Municipality of Bayham,Ontario ("Bayha.na")occupy similar mid lake geographic positions on the south and north shores of Lake Erie,respectively; AND WHEREAS the Municipal Council of each of the Parties has determined that it would be in the public interest for them to work together to promote a Ferry Link between the two municipalities; AND WHEREAS the Parties have determined that it is in their mutual interest for their collaboration and initiatives to proceed on the basis of a written understanding; NOW THEREFORE the Parties affirm their intention to proceed towards their common goal on the following basis: Ferry Link 1. The Ferry Link should be capable of accommodating the needs of persons traveling for business or pleasure and the transportation of goods. -2- Infrastructure 2. To achieve the objectives herein set out,the Parties will each require contributions from other levels of Government for the construction and maintenance of infrastructure including highways,immigration facilities, customs facilities,agricultural inspection facilities, dock facilities and harbor improvements, Business Model 3. The Parties will collaborate on the preparation of a business model using such resources as they consider advisable. Financial Participation of Senior Government 4. Each of the Parties will work diligently to promote approval and participation by their respective senior levels of Government to ensure that financial support is available for the required infrastructure. Consultation 5. The Parties agree to keep each other informed about the initiatives each has taken and responses each has received with regard to senior Government participation to the extent permitted by applicable privacy legislation. Non-Financial Assistance 6. The Parties agree to assist each other to provide such information as may be required by senior levels of Government regarding this proposal. The Parties will also meet with each other as often as necessary to discuss matters of mutual interest and concern. Local Support 7. Each Party represents that to the best of its knowledge,the Ferry Link proposal enjoys significant support by the general public and is generally believed to be in the public interest. No plebiscite would be required as a condition precedent to the pursuit of financial support by senior levels of Government. -3- Applicable Law 8. The Parties intend that these arrangements shall be interpreted in all respects to conform with laws that apply to each of them. Jurisdiction 9. The Parties specifically recognize that the enabling legislation under which each Municipality operates does not authorize international treaties or agreements. The purpose of this Memorandum is not to create a legally enforceable treaty or agreement. It does set out the common resolve of the Parties to work for the common purpose of achieving a Ferry Link which enjoys all necessary Federal, State,Provincial and County support.
