HomeMy WebLinkAboutBy-law No. 2005-103 CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW 2005-103 BEING A BY-LAW TO IMPOSE BUILDING PERMIT RATES AND FEES WHEREAS the Building Code Act, 1992, S.O. 1992, Chap. 23 as amended provides that the Council of a local Municipality may by by-law, impose specific rates and fees to be charged for building code services. AND WHEREAS the Council of the Corporation of the Municipality of Bayham deems it necessary to adopt a schedule of rates and fees for such services. THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS: 1. THAT effective upon final passing of By-law 2005-103, the Schedule of Building Permit Rates and Fees as set out in Schedule"A" attached hereto and forming part of this by-law is hereby adopted and shall remain in effect until amended or rescinded. 2. THAT By-law 2001-049 and any and all amendments thereto enacted by the Municipality of Bayham, setting out any such rates and fees be and are hereby repealed. RESIDENTIAL BUILDINGS a) New Single Family Dwellings $75 flat plus $0.46 per sq ft Multiple Dwellings Additions to Dwellings Living area to include finished areas in basements. Structures in 1(b) will be an additional $0.46 per sq ft b) Garages, carports, indoor swimming pools & accessory $75 flat plus $0.46 per sq ft buildings over 500 sq ft, solariums, and any roofed over decks or porches, etc. c) Decks, ramps, wood stoves $75 flat d) To construct an accessory building up to 500 sq ft $75 flat eg: sheds, garages, carports e) Renovations of accessory buildings & residences $75 flat plus $8.00 per $1000 construction value t) Pools - all types $75 flat 2. AGRICULTURAL BUILDINGS a) Kilns - Tobacco Silo & Manure Tanks $75 flat Bunk Houses b) Corn Cribs $75 flat Steel Granaries c) Renovations to Farm Buildings $75 flat plus $8.00 per $1000 construction value d) Farm Buildings and Additions $75 flat plus $0.46 per sq ft By-Law 2005-103 -2- Schedule A 3. COMMERCIAL INDUSTRIAL, INSTITUTIONAL BUILDINGS a) New or Additions $75 flat plus $0.46 per sq ft b) Renovations of buildings & accessory buildings $75 flat plus $8.00 per $1000 construction value c) Other structures such as wind towers, grain dryers, silos, etc. $75 flat plus $8.00 per $1000 construction value 4. MISCELLANEOUS (a) Mobile Homes - as a second dwelling $75 flat plus $8.00 per $1000 construction value on a farm&trailer park (b) Modular Homes $75 flat plus $0.46 per sq ft (c) Temporary Mobile Homes (for supplementary farm dwelling) $75.00 flat plus any conditions laid out by Council (Renewable every 1-3 years as stipulated by council at a cost of$75.00 for each term.) (d) Temporary Mobile Homes $75.00 flat plus any conditions laid out by Council (used on site while residence is under construction) (e) Existing buildings and houses moved to a new site $75 flat plus $0.46 per sq ft Additions to those moved-in structures at the time of move. $0.46 per sq ft Additions to these moved-in structures at another time. $75 flat plus $0.46 per sq ft f) The Chief Building Official may authorize the transfer of a permit to another contractor if the permit holder gives written permission. DEMOLITION PERMITS a) Any structure other than referred to in section 2.4.1.1.(2) of the building code. b) Agricultural buildings are exempt. c) Partial demolition projects for any part of buildings under the categories of Assembly Occupancy, Industrial and Institutional Buildings shall be reviewed by an architect or professional engineer providing a report with respect to the affects of the demolition on the remaining parts of the structure or structures. d) Permit Schedule for Demolition: 1) Assembly Occupancy $75 flat 2) Institutional $75 flat 3) Industrial $75 flat 4) Mercantile $75 flat 5) Residential & Accessory $75 flat 6. EXCEPTIONS Inspections carried out for construction or installations falling under the Building Code that do not have a building permit in place $75 flat 1. Change of use permit $75 flat 2. Conditional permit as required under subsection 8(3) of the Act, and meeting the requirements of 5.9 to 5.9.5 fees for the complete project are required based on the applicable fee schedule in this by-law. SEPTIC SYSTEMS Class 1 - chemical toilet, incinerating toilet, a recirculating toilet, a self contained portable toilet, all forms of privy inkling portable privy, an earth and pit privy, a vault privy and a composting toilet system all of which receive only human waste. $175 Class 2 -A greywater system, which can only receive greywater waste. $175 Class 3 -A cesspool system, which can only receive waste from a Class 1 system. $175 Class 4 - A leaching bed system, which accepts both human waste and greywater waste. $350 Class 5 - A sanitary sewage system with an on on-site holding tank for sanitary sewage produced on-site prior to removal by a haulage service provider; it can accept both human body waste and greywater. $350 Leaching Beds - can only be used in soils with percolation times greater than 1 minute and less than 125 minutes $350 Absorption Trench - shall have gravity flow up to 500 feet of distribution pipe and beyond that it will require a distribution chamber with a pump to pressurize the system. $350 Filter beds - the total daily design sanitary sewage flow shall not exceed 5000 L, where the treatment unit is a septic tank or 10,000 L, where the treatment unit is another treatment unit described in 8.6.2.2.1 $350 Partial Repairs to: Field beds, tanks and additions to field beds $250 Lot Assessments - to be issued by and to the satisfaction of the Chief Building Official as a condition of lot development $ 75 By-Law 2005-103 -5- Schedule A Sewage Connection Permit $175 8 .
