BY-LAW NO. 2004-113
BEING A BY-LAW TO ADOPT A
POLICY FOR THE HIRING OF EMPLOYEES
WHEREAS Section 270 the Municipal Act, S.O. 2001 requires a municipality to have a policy
respecting the hiring of its employees;
AND WHEREAS the Council of the Municipality of Bayharn deems it necessary and expedient
to adopt a policy respecting the hiring of employees in accordance with the said Act;
THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY
OF BAYHAM ENACTS AS FOLLOWS:
1. THAT effective upon passage the Policy for the Hiring of Employees attached hereto as
Schedule"A" and forming part of this By-law is hereby adopted for the Municipality of
Bayham.
2. THAT this Policy for the Hiring of Employees By-law may be amended from time to
time as directed and deemed necessary by the Council of the Corporation of the
Municipality of Bayham.
3. AND THAT this by-law shall come into full force and effect upon final passing.
READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED THIS 16th
DAY OF DECEMBER 2004.

Policy for the Hiring of Municipal Employees
Hiring of Relatives
Relatives of persons currently employed by the Municipality, or relatives of a member of
Council or a local board, may be hired only if they will be employed in a position that does not
directly report to or supervise the relative.
Employees cannot be transferred into such a reporting relationship.
For the purposes of this policy, a relative is defined as a spouse, common-law spouse, same sex
partner, child, common-law spouse's child, mother, father, brother, sister, grandchild, son-in-
law, daughter-in-law, brother-in-law, sister-in-law, mother-in-law, father-in-law, common-law
spouse's mother, common-law spouse's father, grandparent, spouses grandparents, aunt,uncle.
If the relative relationship is established after employment,the individuals concerned will decide
who is to be transferred. If that decision is not made within 30 calendar days, management will
decide.
Notwithstanding this Policy, all employees employed by the Municipality and in this situation at
the time of adoption of this policy will be exempt from this requirement.
All employees are required to report relationships to the Municipality that would place them in
violation of this policy. If the relationship is found to have been deliberately concealed from the
Municipality at the time the relative is hired or thereafter, the employment of one or both of the
relatives may be terminated.
