The LDU number is 24101. A.4 PROPERTY DESCRIPTION, PRESENT USE AND ZONING OF PROPERTY The property is used by local residents and tourists to access Lake Erie. The property is 122.134 ha in size and consists of the following structures: a) a channel entrance(200 m by 34 m); b) a basin(55,000 sq.m); c) a rock breakwater-west(486 m by 3 n);. d) a concrete wharf(365 m by 9 in); e) a steel harbour wall-west(815 m by 9 in); f) a timber wharf(295 in by 9 m); g) a concrete pier approach wall(102 m by 7 m); h) a timber wharf ferry slip(13 m by 1 m); i) a steel harbour wall-east side(250 m by 10 m); j) a timber fisherman's wharf(55 m by 4 m); and k) rock shore protection(488 m long); A site plan and aerial photographs are attached in Appendix A and B, respectively. No information regarding the current property zoning was found during the course of this assessment. The future use will be the continued use of the facility as it is presently used for a period of 15 years. A small fishing wharf was first established in Port Burwell around 1833 and by 1849 the harbour was growing rapidly and shipping large quantities of lumber, shingles, staves and other commodities to Buffalo and Cleveland. However, by 1860, most of the valuable lumber was exhausted and the bustle of the harbour gradually declined until 1872. The lumber industry was replaced by commercial fishing and coal shipping near the turn of the century. By the 1910s, up to 600,000 tons of coal a year were landing at Port Burwell. It is worth noting that in the 1950s there was a fire of an 8,000 ton pile of coal that lasted for several days. In 1948, Graham Oil established a large oil tank near the harbour capable of holding 600,000 gallons of fuel. Shortly afterwards, the tank farm was expanded and tankers arrived regularly. The shipping of coal declined after World War II. It is evident that the harbour was used extensively for commercial purposes. (please elaborate briefly) a) dredging X b) infilling X c) redirection or diversion of any watercourse X d) wharf or dock construction X e) other(specify) X Heavy siltation of the harbour has been an ongoing problem at the harbour since the mid 1800s. The SCH files indicate continual dredging at the site almost every year. Currently, there is a proposal by Pembina Resources to re-dredge the entrance channel between the federal piers and within Big Otter Creek. The project is proposed to be undertaken in two phases: Phase I relates to the outer harbour and Phase II relates to the inner harbour(within Big Otter Creek). An environmental assessment (CEAA) was completed by SCH for Phase I and it was determined that adverse environmental effects were unlikely or mitigable and the project is to proceed this summer once the project details have been finalized. Phase 2, the dredging of the inner harbour, is still undergoing review and has not received regulatory approval to date. Correspondence from the MOEE (1994) indicated that analysis of the inner harbour sediments showed a large percentage of silts and clays, as well as chromium concentrations above the PSQG LEL. The MOEE and MNR are concerned that the high turbidity levels associated with the dredging of silts and clays, together with the elevated chromium levels has the potential to impact fish and fish habitat. Ifyes,please describe the results, if available. The Long Point Region Conservation Authority conducted sediment testing in the federal harbour in June, 1995. The ten sampling locations are marked on the site plan in Appendix D. The sediment samples were submitted to MDS Environmental Services Limited for analysis (refer to Appendix D for a copy). The laboratory results are summarized in Table 4.1 in Appendix D). The results indicated that only two sediment samples (PB 1, PB2) slightly exceed the "Lowest Effect Level" criterion for TKN under the MOEE Provincial Sediment Quality Guidelines . There was no evidence from the 1995 laboratory analysis to support the MOEE correspondence (1994) that chromium levels were elevated in the vicinity of the harbour. b) Is there any indication that past or present land uses or activities on or in the vicinity of the subject property may have impaired sediment quality? The subject property is part of a migratory corridor for rainbow trout, white suckers and Moxostoma species which spawn in Big Otter Creek (MNR, 1996). Additional information requested from MNR. The site is relatively flat with a gentle slope towards Lake Erie (MNR, 1984). Water table is expected to be approximately at Lake Erie level. DECISION RECORD Based on the review of available information in Small Craft Harbours' files and contacts with those knowledgeable about the site, no significant environmental concerns were identified in connection with the subject property. Ten sediment samples were collected by the Long Point Region Conservation Authority and submitted to MDS Environmental for analysis in 1995. Only marginal exceedances of TKN in two sediment samples with respect to the "Lowest Effect Level"under the MOEE Provincial Sediment Quality Guidelines were measured. A fuelling facility was identified"partially on the subject property". The presence of the fuelling facility may have impaired the quality of the soil and water on the subject property. Review of SCH files did not identify the presence of the fuelling facility as an environmental concern. Regardless, compliance with the Gasoline Handling Code should be investigated. Review of SCH documents also revealed information regarding the coal stockpiling more likely in the immediate vicinity of the subject property. A narrow strip land area is part of this property and underlying soils may have been impacted. Although we do not anticipate the presence of major environmental issues at the subject property, this can only be confirmed by subsurface sampling and chemical analysis. Page 1 of 2 (8b/97303 09007) Environmental Screening Form ENVIRONMENTAL ASSESSMENT OF THE PROJECT The proposed project is a Program Transfer in accordance with Treasury Board directives. No physical activities (dredging, construction or otherwise) or change in operation are planned as part of the transfer. Transfer covenants stipulate the recipient is to continue operating the facility at essentially its current level of operation for fifteen years. Small Craft Harbours is not aware of any concerns related to the past operation of the facility. In the event of future physical activities and/or changes in the operation of the harbour, the recipient would be subject to all local zoning, municipal by-laws, and provincial/federal legislations and regulations. Environmental and social impacts are not anticipated to arise from the proposed project -- no mitigation measures are required. Small Craft Harbours is not aware of any public concern or opposition to the project --environmental issues have not been identified.
