BY-LAW NO. 2004-065
A BY-LAW TO AUTHORIZE THE EXECUTION
OF A LETTER OF UNDERSTANDING BETWEEN THE
MUNICIPALITY OF BAYHAM
AND
CANADIAN UNION OF PUBLIC EMPLOYEES AND ITS LOCAL 35.4
WHEREAS the Council of the Corporation of the Municipality of Bayham is desirous of
executing a Letter of Understanding with the Canadian Union of Public Employees and its Local
35.4 to establish terms and conditions of employment for Water and Wastewater operations.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE
MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS:
1. THAT the Mayor and Clerk be and are hereby authorized to execute the Letter of
Understanding attached hereto as Schedule"A" and forming part of this by-law between
the Canadian Union of Public Employees and its Local 35.4 and the Municipality of
Bayham.
2. THAT this by-law shall come into full force and effect upon final passing.
READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED THIS 17th DAY
OF JUNE 2004.

LETTER OF UNDERSTANDING
BETWEEN
THE CORPORATIONOF THE MUNICIPALITY OF BAYHAM
AND
THE CANANDIAN UNION OF PUBLIC EMPLOYEES AND ITS LOCAL 35.4
It is mutually agreed and understood between the parties that the employees employed in Water
and Wastewater operation are covered by the terms of the Collective Agreement with the following
exceptions:
Article 2.01(c)
As it relates to contracting out, as this is a trial project,the future of which will be determined by its
feasibility.
Article 16.01
(Hours to be mutually agreed between the Parties)
Article 16.03& 16.08
(On call to be rotated among Water/Wastewater staff) (to be mutually agreed between the Parties)
Article 16.04
(to be mutually agreed between the Parties)
Schedule'A°
Wage rates shall be Water/Wastewater Operator in Training—$17.80, $18.50, $1925(2004 rates)
Water/Wastewater Operator— $20.60,$21.40, $22.30(2004 rates)
The Water/Wastewater Superintendent is deemed a working Supervisor and is therefore not
covered by the Collective Agreement.
It is further understood that the foregoing is on a trial basis and any amendments required mutually
resolved between the Parties and reduced to writing as necessary.
This Letter of Agreement will be deemed part of the Collective Agreement and is subject to the
Grievance and Arbitration procedures as necessary.
