The Council of the Municipality of Bayham met at 7:00 p.m. on Monday, May 26, 2008 in
the Committee Room. Present were Mayor Lynn Acre, Councillors Wayne Casier and Ed
Ketchabaw,Administrator Kyle Kruger and Planning Co-ordinator/Deputy Clerk Margaret
Underhill. Also present was the Municipal Planning Consultant, Derek Dudek of IBI
Group.

1. CALL TO ORDER Mayor Acre called the meeting to order at 7:02 p.m.

1. Official Plan Review Discussions
Derek Dudek referred to our previous meeting of May 15, 2008 regarding soil mapping
discussions and informed Council of his recent discussions with OMAFRA. He prepared a
revised Bayham soil classification map, excluding tobacco lands from the specialty crop
lands classification. He explained that the new mapping shows that half the municipality is
non-prime agricultural lands, which he considered to be quite significant. He mentioned
the LEAR(Land Evaluation and Area Review) Study to OMAFRA and if they confirm that
tobacco lands can be excluded from the specialty crop lands classification, it may not be
advantageous to do a study. D. Dudek is expecting OMAFRA to send confirmed updated
soil classifications to him shortly.
D. Dudek continued with Discussion Paper#2 Growth Study beginning at page 11
Qualitative Analysis 5.8 Port Burwell. He pointed out that there could be some minor
revisions to the number of potential building lots across the whole municipality based upon
the information expected from OMAFRA regarding the soil classifications. He stated that
the Ministry might be supportive of removing some of our undeveloped interior residential
lands from urban boundaries and returning them to agricultural use in exchange for adding
properties along the main roads and streets to extend urban boundaries. D. Dudek
calculated that by exchanging lands the acreage would be added to the agricultural
designation,which is positive in the Ministry's opinion.

K. Kruger circulated to Council an email dated May 25, 2008 received from Paul Hinde,
Consultant for Brian Graydon, regarding the individual Graydon properties that the owner
requested to be included in the OP Review. D. Dudek explained that three of the properties
are included in Discussion Paper#2 and two properties, being industrial/commercial, are
included in Discussion Paper#3, which Mr. Hinde and Mr. Graydon have not seen yet.
D. Dudek recommended that minor revisions be made to Discussion#2 before sending it
to the Ministry for consultation. K. Kruger suggested that before the Study is submitted to
the Ministry that an Open House be scheduled to provide an informal forum for concerned
parties to attend and discuss the changes. He recommended that the individual landowners,
whose lands could be considered for re-designation,be contacted directly and invited to
attend. He added that following the Open House, recommended changes would be made,
discussion papers would be sent to the Ministry for consultation and then a formal Public
Meeting could be scheduled.
D. Dudek continued with Discussion Paper#3 Other Policy Issues. Regarding
supplementary farm dwellings, Derek explained that there are no policies in the OP and
currently Bayham considers them through the zoning by-law with temporary zoning
policies. He pointed out that Oxford County uses a site-specific minor variance through
the Committee of Adjustment to deal with supplementary farm dwelling requests. D.
Dudek will look at Norfolk County's policies, as well, for comparison. Councillor Casier
expressed concern for the farmers with a justifiable need and that those accommodations
are getting harder to secure. He suggested that justification for a supplementary farm
dwelling would be the provision of the farm registration number assigned to a registered
farm operation. He feels that this would help reduce the potential misuse of the
supplementary farm dwelling. D. Dudek suggested that site-specific policies can be
formulated similar to Oxford County and include such items as type, location and permitted
time frame.
The discussion moved on to industrial lands. D. Dudek pointed out that adding more
industrial lands may not be warranted and that the Ministry would not see the benefit to
adding more when the current industrial lands are not fully developed. Mayor Acre asked
about lands in Vienna and the potential to be designated industrial. K. Kruger responded
by saying that past requests moved lands away from industrial to residential use in the
villages.
When asked about renewable resources policies, D. Dudek responded by saying that
Discussion Paper# 1 touched on renewable resources and suggested that more policies
could be added to deal with other energy resources, such as solar.
As per discussion,D. Dudek will make the minor revisions to Discussion#2 and#3 and
plan an Open House for approximately late June, draft the new policies in July and send to
the Ministry for preconsultation and plan a Public Meeting for September.
