Present were Mayor Lynn Acre, Deputy Mayor Cliff Evanitski, Councillors Mark Taylor, Wayne Casier and Ed Ketchabaw, Administrator Kyle Kruger and Clerk Lynda Millard. Planning Co-ordinator Margaret Underhill was also in attendance. 1. CALL TO ORDER Mayor Acre called the meeting to order at 7:00 p. m. 2. DISCLOSURE OF PECUNIARY INTEREST & THE GENERAL NATURE THEREOF None 3. APPROVAL OF MINUTES Minutes of the regular meeting of Council held April 3, 2008. 2008-207 Moved by W Casier Seconded by E Ketchabaw "THAT the minutes of the regular meeting of Council held April 3,2008 be approved as circulated." Disposition: Motion Carried Unanimously 4. DELEGATIONS 7:05 p.m. —Ron Bradfield,representing Port Burwell Harbour user Boaters Group made a presentation regarding improvements/maintenance dredging,possible solutions and funding. He provided history on the harbour, commenting that at the time of transfer from Small Craft Harbours to the Village of Port Burwell in 1975, a minimum draft of 8'was to be maintained within the harbour. He added that did not happen and it is currently so shallow that you could walk across without being wet. He added that for many years Tim Martin and his father have kept the passage open,noting that the harbour would�be accessible without the Charter boats.ri`i n o"E Council Minutes - 103 - April 17,2008 He noted that others are not required to physically maintain highways so they can get to work and the fishermen and charters shouldn't have to either. He raised the concern that with 128 km between Long Point and Port Stanley, the harbour in Port Burwell should be accessible as a port of refuge for boaters in risk of danger. He advised that several boaters annually bend their propellers and suck sand into the motors causing damage. He estimated 10,000 people and boaters come to Port Burwell annually, suggesting that no remedial support from the municipality sends the message that we don't want them here. Mr. Bradfield requested solutions to the silt problem be sought and that some municipal tax dollars be spent on harbour maintenance. He suggested that those requiring access to the harbour for their own commercial operations, such as the gas company,may be convinced to invest in local dredging, rather than take an estimated $100,000 to Port Stanley. Mr. Bradfield submitted a petition containing over 300 signatures stating: "We petition our Municipality of Bayham Council to petition our Federal Government to immediately(ASAP) carry out maintenance dredging of Port Burwell Harbour so we can exit and re-enter Port Burwell Harbour with our boats for our work and pleasure without putting ourselves and our guests in danger of grounding in rough waters." The petition is to be forwarded to Joe Preston, MP. Ian Almond, local businessman, identified both commercial and spot fishing as economic concerns, suggested the LPRCA is not interested and encouraged the municipality to take the lead on a harbour investment initiative for 2009. ,.� Larry Ostrowerchv,Lynn Tremblett and Danielle Thieverge stressed the need to take the necessary actions to maintain harbour safety and access as a viable fishing port. Joe Stephenson,Mike Garry and Honor Wassin2 raised environmental soil erosion concerns and emphasized the need for long-term conservation measures to address silting. Item 9.1(c) 7:30 p.m.—Honor Wassing was in attendance to present her views as outlined in her correspondence regarding Shore-based, Controlled Entry Water Rescue. She suggested a mock rescue from the rock pier training session be conducted and video taped for use as a resource tool. Item 8.1(d) Council Minutes - 104 - April 17, 2008 7:45 p.m.—Brian Crevits was in attendance regarding farm labour accommodations as detailed in his correspondence. He noted that a rezoning application has been submitted, however, stressed the urgency of the matter in order for him to obtain a building permit to undertake strip room renovation to house Off-Shore labour for this year's crop. NOW THEREFORE the Council of the Municipality of Bayham encourages Government of Ontario to the supports the recommendations identified in the Report to develop a comprehensive,long-term,sport and recreation infrastructure provision framework for Ontario that includes: • a sport and recreation infrastructure database to assess needs and priorities; • a sustainable,province-wide, dedicated sport and recreation infrastructure funding program supported at all orders of government; Council Minutes - 106 - April 17, 2008 ■ a Strategy to promote increased physical activity and social engagement for all Ontarians; AND THAT this resolution be forwarded to the Premier of Ontario, the Minister of Finance,the Minister of Public Infrastructure Renewal, the Minister of Municipal Affairs and Housing and Steve Peters,MPP Elgin, Middlesex,London for consideration and support." Disposition: Motion Carried Unanimously Mayor Acre had previously acknowledged a pecuniary interest regarding this item, vacated the chair to Deputy Mayor Evanitski and did not take part in discussion or vote on this matter. Council Minutes - 108 - April 17, 2008 2. COURT OF REVISION—RICHMOND OUTLET DRAIN 1. (a) 8:00 p.m.: Reconvening of Court of Revision regarding the assessment of properties in regard to Drainage Report No. 205207 prepared by Spriet Associates and referred to as the Richmond Outlet Municipal Drain. Public present included Peter Dutchak, representing the County of Elgin and Lew Acre. 2. Declaration of Pecuniary Interest and the General Nature Thereof Mayor Acre as previously noted. 3. Staff Presentation The Administrator confirmed that notice of the change proposed by the Court had been sent to the County of Elgin and the response letter was included in the agenda. He added that Mr. Peter Dutchak, representing the County and Mr. Acre were both in attendance as well as John Spriet, Engineer. Mr. Acre was provided a copy of the correspondence from the County Documentation: Staff Report DR2008-011 regarding Court of Revision Assessment appeals noted were previously received from Max and Sue Ward, Pt Lot 111 Conc.S.T.R. and Lew Acre, Lot 111 N.T.R County of Elgin correspondence dated March 28, 2008,from Peter Dutchak, County of Elgin opposing a proposed change in the $2,000 benefit assessment from property owned by Lew and Lynn Acre to the County of Elgin. 4. Court/Public Questions& Comments E Ketchabaw questioned Mr. Dutchak whether he had discussed the 1979 agreement with Mr. Acre and whether he had visited the Acre property to which he responded, yes. M Taylor questioned whether the outlet was stable and there was no issue at that time. P Dutchak responded that at the time of installation there was no issue, the erosion has occurred beyond the original outlet since then. M Taylor questioned why the extension was not installed at that time. P Dutchak noted that the outlet at that time did provide benefit, and could have been shorter. He noted that the outlet services 43 hectares while only 4.3 or 7% were County owned. Mr. Acre could have petitioned to extend further. M Taylor questioned Mr. Acre how long ago the County had been approached regarding the erosion. Council Minutes - 109 - April 17, 2008 Mr. Acre responded believed it to be about 15 years that he had tried to contact the County Engineer Robert Moore but did not get a response. About 8 years ago he had spoken to Warden Wilson in this regard. M Taylor asked how much land had been swallowed. Mr. Acre responded it was ok until the clay let go;washed out when 3 feet of water in the outlet . He suggested that past engineering practices were responsible. Could have been cured with better practices. He confirmed he was appealing the"Benefit"only nithe"Special Benefit". The meaning of benefit and interpretation in regard to the definition of"Benefit" in the Drainage Act. was discussed. E Ketchabaw questioned Mr. Spriet as to options. Mr. Spriet responded that the court could approve the assessments as presented, or re-allocate to a particular property within the owners assessed or moved to a road authority being the County of Elgin or the Municipality of Bayham or split the difference between properties. Anyone affected property owner dissatisfied with any such re-assessment would have the right to appeal to the Drainage Tribunal. An appeal can be made either in opposition to the assessment"as is"or to any change made. M Taylor confirmed he believes both the"Benefit" and"Special Benefit" assessed to the Acres should be re-allocated to the County. P. Dutchak advised that the County had paid for 100%of the construction costs in 1979. He commented the two reports dealt with separate issues. Ketchabaw questioned whether review by the Tribunal could bring in the 1979 works. J Spriet responded that the Tribunal can call appellants/ratepayers deemed necessary to resolve the matter. He added that the composition of the Tribunal varies and it would be difficult to determine how the consideration would work out. C Evanitski questioned if the Tribunal were to look at the total separate from the 1979 works what is the option if the property owner disagrees? J Spriet agreed with Mr. Acre that the ravine was initially not so deep. The proposed construction takes a good drain, adds fill and extends it an additional 150 feet. He noted another option would be to let someone else make the decision through the Tribunal. The Court adjourned at 8:25 and re-convened at 8:48 p.m. J Spriet responded to court member questions and clarified options. Council Minutes - 110- April 17, 2008 Mr. Acre confirmed his appeal for the"benefit"portion only. 5. Disposition of Item 2008-214 Moved by M Taylor Seconded by E Ketchabaw "WHEREAS,in accordance with Section 58, Chap. D.17 of the Drainage Act,R.S.O. 1990 the appeal period which allows any owner of land assessed for drainage works to appeal: ❑ that road or land has been assessed too high or too low,or ❑ that any land or road that should be assessed has not been assessed, or ❑ that due consideration has not been given as to type of use of land,has expired and the Court of Revision has determined the assessment appeal for property owned by Max and Sue Ward,being Pt Lot 111 Conc. STR, Roll# 007-100-00)to be denied; ❑ and the Court of Revision has determined the assessment appeal for property owned by Lew and Lynn Acre being Pt Lot 111 Conc.NTR,Roll # 007-081-00 be approved, and the$2,000 Benefit assessment reallocated as follows: $2,000.00 to the County of Elgin; THEREFORE the Court of Revision for the Richmond Road Outlet Drain hereby directs the Clerk,pursuant to the provisions of the Drainage Act,to: ❑ alter the assessments and other parts of the schedule contained in the Engineer's Report#205207 dated December 31, 2007 to comply therewith; and ❑ send notice thereof to the owners affected; and ❑ amend the provisional by-law, before the passing thereof,to carry out any changes so made by the Court of Revision."
