Present were Mayor Paul Ens, Deputy Mayor Mark Taylor, Councillors Tom Southwick,Wayne Casier and Ed Ketchabaw,Administrator Kyle Kruger and Clerk Lynda Millard. 1. CALL TO ORDER Mayor Ens called the meeting to order at 7:00 p.m. 2. DISCLOSURE OF PECUNIARY INTEREST& THE GENERAL NATURE THEREOF None 3. File: T09 2011-529 Moved by Councillor T Southwick Seconded by Councillor E Ketchabaw "THAT the Council of the Municipality of Bayham approves the request by the Ottervalley Port Burwell Optimist Club to use streets within Port Burwell for the Santa Claus Parade to be held Saturday,December 3,2011 at 6:30 p.m., subject to the provision of proof of liability insurance coverage; THAT the County of Elgin be requested for permission to use Wellington Street and Robinson Street between 6:30pm and 8:00 p.m. for the parade; AND THAT the Bayham Public Works Manager be directed to provide the necessary provisions for traffic control and safety." CARRIED UNANIMOUSLY 8. PROPERTY,BUILDING& PROTECTIVE SERVICES (a) Staff Report PR2011-11 regarding Municipal Beach and Concession Operations 2012. Deferred from the November 3, 2011 meeting. File: F18 The report was discussed at length. Building maintenance options including garbage collection and installation of hand dryers is to be considered at budget time. It was agreed that the cleaning of the washrooms be separated from the food concession operation. Council agreed that the RFP be extended to include the opportunity for a second vendor, open to food or other beach related amenities. Staff will assess needs, including the need for an additional electricity consumption meter, once proposals are received. 2011-530 Moved by Councillor W Casier Seconded by Councillor E Ketchabaw "THAT staff proceed with arrangements for Municipal Beach and Concession Operations as outlined in report PR2011-11,with the inclusion of a call for proposals for additional beach vendors and obtaining quotations for weekly beach maintenance and garbage collection." File: F05 Council discussed whether there were significant benefits related to asset management. Staff noted this is a relatively small cost for future rather than immediate benefit. 2011-532 Moved by Councillor E Ketchabaw Seconded by Councillor W Casier "THAT Staff be authorized to proceed with the Data Loading Contract with the estimate submitted by Infrastructure Solutions in the amount of$3,390.00." DEFEATED (c) Correspondence dated November 1, 2011 from the Ontario Heritage Trust inviting participation in"Doors Open 2012". File: R00 2011-533 Moved by Councillor E Ketchabaw Seconded by Councillor W Casier "THAT the Municipality of Bayham take a lead role in the "2012 Doors Open" activities subject to participation confirmation by the Township of Malahide and the Town of Aylmer; AND THAT Bayham staff be directed to take the necessary steps to organize the event." CARRIED UNANIMOUSLY (d) Staff Report C2011-010 regarding the Reappointment of Closed Meeting Investigator File: L04 Page 4 of 9 Council Minutes November 17,2011 2011-534 Moved by Councillor E Ketchabaw Seconded by Councillor T Southwick "THAT Mr.John Maddox (JGM Consulting)be reappointed as Closed Meeting Investigator for the Municipality of Bayham for a further four-year term commencing January 1, 2012; AND THAT draft By-law No. 2011-093 be presented to Council for enactment." CARRIED UNANIMOUSLY (e) Discussion regarding forming a committee to explore "Business/Municipality encouragement/discouragement". (Councillor Southwick request) Councillor Southwick noted that it has come to his attention that some persons feel municipal by-laws may be outdated or irrelevant and are perceived to hinder progress by local businesses and entrepreneurs. It was suggested that interested persons approach the Otter Valley Chamber of Commerce to draw on their expertise and have them approach Council for assistance once shortcomings and potential solutions have been identified. (f) Staff Report PR2011-09 regarding Potential Surplus Properties. Deferred from June 6, 2011. File: L07 The list of potential properties for disposition was discussed. The Administrator advised that excess properties must be deemed surplus by Council and an assessed market value obtained prior to sale. It was suggested that local realtors be approached to submit a request for proposal. Staff is to send letters to the current users of the medical building advising of Council's intent to list that property for sale. 2011-535 Moved by Councillor W Casier Seconded by Councillor E Ketchabaw "THAT staff be authorized and directed to proceed with procedures for the disposal of properties as outlined on Attachment#2 to report PR2011-07 subject to deletion of Old Town Hall and vacant lot south of museum and addition of medical building." CARRIED UNANIMOUSLY (h) Request from the Straffordville Community Committee to support an application to Festivals&Events Ontario Top 100 Festivals &Events contest on behalf of Watermelon Fest. Mayor Ens advised that the Straffordville Community Committee is desirous of submitting an application to Festivals &Events Ontario for the Top 100 events on behalf of Watermelon Fest and needs the Municipality's support. 2011-537 Moved by Councillor W Casier Seconded by Deputy Mayor M Taylor "THAT the Municipality of Bayham supports the Straffordville Community Committee submission to Festivals& Events Ontario Top 100 Festivals Contest on behalf of the Straffordville Watermelon Fest held August 27,2011." CARRIED UNANIMOUSLY 10. ENVIRONMENT (a) Staff Report E2011-07 regarding "Waste Management Master Plan/Recycling Strategy". Deferred from November 3, 2011 meeting. File: E07 The Administrator advised that the proposed contract would be based on a per household basis,plus tonnage. The RFP will provide flexibility for each municipality separately, with basic similarities and a variation in initial bag limit tags. The Report recommends a goal of 30%waste diversion by January 2014 as a first stage of implementation, and a goal for a second stage of 40%by January 1, 2016. Council was not, at this time, supportive of a mandatory recycling by-law that would penalize residents who do not maximize waste diversion and recycling endeavours. No changes are proposed to the large item drop off and household hazardous waste practices in Bayham. Additional recycling boxes will be provided and composting encouraged. 2011-538 Moved by Councillor E Ketchabaw Seconded by Councillor W Casier "THAT the Waste Management Master Plan/Waste Recycling Strategy Final Report October 2011,as prepared by 2cg Waste Management Consulting Services, be adopted; Page 6 of 9 Council Minutes November 17, 2011 AND THAT staff be directed to initiate implementation of the report recommendations excluding the mandatory recycling by-law."
