HomeMy WebLinkAboutDecember 13, 2012 - Special Council COUNCIL MINUTES SPECIAL MEETING THE CORPORATION OF THE MUNICIPALITY OF BAYHAM 9344 Plank Road,Straffordville Thursday,December 13, 2012 7:00 p.m. Council Chambers The special meeting of Council of the Municipality of Bayham was held on Thursday, December 13, 2012 in the Council Chambers. Present were Mayor Paul Ens, Acting Deputy Mayor Wayne Casier, Councilors Tom Southwick and Ed Ketchabaw, Administrator Kyle Kruger and Clerk Lynda Millard. Several members of the public were present. 1. CALL TO ORDER Mayor Ens called the meeting to order at 7:00 p.m. 2. DECLARATION OF PECUNIARY INTEREST AND THE GENERAL NATURE THEREOF None. 3. ADMINISTRATION (a) Discussion regarding "Vacant Council Position". Mayor Ens requested the Clerk to provide a summary of actions taken by Bayham Councils to fill previous vacancies in 1998, 1999 and 2003. The first was filled by a by- election, with the others being filled by appointments. Mayor Ens inquired of Council members what criteria beyond the Municipal Elections Act requirements they would propose to determine and appoint the successful candidate. Members could not agree on any other requirements, or whether any were necessary in order to solicit qualified candidates. They acknowledged that they were concerned with their inability to reach a consensus and that the public wants the issue resolved. Acting Deputy Mayor Casier confirmed his preference to settle by appointment,but due to the stalemate, felt that a by-election is the only resolve. Councillor Ketchabaw asked staff when a by-election could be scheduled should a motion be passed to hold one. Following a short break staff advised that a by-election could be scheduled for late March or early April if a resolution was passed at this meeting. A By-law could then be passed to authorize a by-election at the December 20th regular meeting. Councillor Southwick noted that the process had been too lengthy. Page 1 of 3 Council Special Meeting Minutes December 13, 2012 Councillor Ketchabaw voiced concern that Council members had not been approached individually to facilitate a solution. Concerns were raised regarding the holding of the by-election during the winter months. Members suggested April 1 or April 2, 2013. Councillor Southwick requested a recorded vote on the following resolution: 2012-603 Moved by Councillor Southwick Seconded by Acting Deputy Mayor Casier "THAT the vacant position of Deputy Mayor be filled by holding a by-election; AND THAT a by-law be prepared to authorize the holding of a by-election to fill the position of Deputy Mayor for consideration at the next regular meeting of Council."
