The regular meeting of the Council of the Municipality of Bayham was held on Thursday,
December 6, 2012 in the Council Chambers. Present were Mayor Paul Ens,Acting Deputy
Mayor Wayne Casier, Councillors Tom Southwick and Ed Ketchabaw, Administrator Kyle
Kruger and Clerk Lynda Millard.
Chief Building Official/Drainage Superintendent Bill Knifton was in attendance to present his
reports.
1. CALL TO ORDER
Mayor Ens called the meeting to order at 7:00 p.m.
2. DISCLOSURE OF PECUNIARY INTEREST & THE GENERAL NATURE
THEREOF
Acting Deputy Mayor Casier declared a conflict regarding item 9(k) as it pertains to the
remuneration he will receive for the appointment as acting Deputy Mayor and vacated his
chair during discussion and voting.
3. APPROVAL OF MINUTES AND ADDITION OF AGENDA ITEMS
(a) Minutes of the regular meeting of Council held November 15, 2012.

4. DELEGATIONS, STATEMENTS AND UPDATES
1. DELEGATIONS
(a) 7:05 p.m. -David Ross regarding zoning by-law.
Mr. David Ross raised concerns regarding the overnight parking of a transport truck
tractor by his neighbour, Shawn Mathews, and having it running very early in the
mornings. He is now living there permanently and suggested the truck sitting there affects
abutting property values. He said that he has the support of his other neighbours and
requested that the no zoning by-law amendment or temporary exemption be considered.
(b) 7:15 p.m. -Robert Vallee regarding the Ojibwa Guarantee.
Mr. Robert Vallee raised concerns regarding the agreement Council made with the Elgin
Military Museum regarding the Ojibwa project. He noted that the Bellchamber report did
not support the action Council took. The cost of the move could well exceed the $6
million,repayment of the loan is next to impossible and the amount of funds raised to
date is unknown. Mr. Vallee reviewed several questions as submitted and staff provided
information in response.
Mr. Vallee expressed his concern regarding the lack of information or mis-information
available to the public and that requested that additional information be forthcoming.
Mayor Ens suggested, and Council agreed that a meeting be arranged with the Elgin
Military Museum Board and that a full report, addressing concerns be made available to
the public.
(c) 7:40 p.m. -Florence Ferris regarding high cost of sewers.
Mrs. Florence Ferris raised her concerns that the flat rate charged for sewer is not fairly
assessed as businesses and large families are being billed the same amount as a one
person household.
It was noted that differing approaches have been examined,however it is difficult to
come up with a solution satisfactory to all users,particularly when Straffordville and
Eden have sewers but not municipal water.
Rates are to be reviewed for 2013 and some options to flat rate versus usage based may
be available.
2. STATEMENTS BY COUNCIL
Mayor Ens noted that the election of the Warden for 2013 will be held at the County building
Tuesday, December 11, 2012 at 7:00 p.m.
He added that the Straffordville Santa Claus parade is Saturday at 10:30 a.m.

The Administrator advised that sampling has been done and results should be back next
week. He added that a report regarding a short-term extension with the MOE is to be
considered later on the agenda.
(b) Acquisition/disposition of land-Port Burwell Harbour
The Administrator noted that the Environmental Site Assessment works are still in
progress.

In response to status of the OMPF grant, the Administrator noted that Bayham can expect
a reduction between$23,000 and$24,000, which is relatively positive to what some other
municipalities are facing.

Staff clarified that the zoning designation that applies to the property is residential. It was
noted that this restriction is not applicable in a commercial zone and there may be
potential for arrangements to be made to park the vehicle on appropriately zoned property
nearby. There was consensus that Mr. Ross and neighbours see if a compromise is
workable.

Extension.

The Administrator confirmed that the deadline of December 31,2012 for the completion
of the Richmond Water project will not be met. The MOE is aware of the progress and it
is expected the works can be completed by July 31,2013.

co Discussion regarding "Vacant Council Position".
Council had lengthy discussion regarding the need for criteria to agree on to appoint
someone to fill the vacant seat,whether there was a need to fill it, concerns regarding
non compliance with the Municipal Act if unable to,previous Bayham history in
regard to same.
A motion to call a by-election failed to have a seconder.
Mayor Ens called for a special meeting to be held on the following Thursday,
December 13th at 7:00 p.m. and again for Monday, December 17, should the 13th be
unfruitful.

(k) Consideration of remuneration for acting Deputy Mayor.
The Administrator noted that the remuneration for a councillor position is different than
that of deputy mayor and staff wanted to clarify if Council intended that the Deputy
Mayor rate would apply to the Acting position, as this was not addressed previously.
