HomeMy WebLinkAboutFebruary 02, 2006 - Council COUNCIL MINUTES THE CORPORATION OF THE MUNICIPALITY OF BAYHAM 9344 Plank Road,Straffordville Thursday February 2,2006 7:00 p.m. 8:00 p.m.—Court of Revision-Henry Street Drain The regular meeting of the Council of the Municipality of Bayham was held in Council Chambers. Present were Mayor Lynn Acre,Deputy Mayor Mathew Schafer, Councillors Mark Taylor,Paul Ens and Cliff Evanitski,Administrator Kyle Kruger and Clerk Lynda Millard. Chief Building Official/Drainage Superintendent Dwayne Daniel,Fire Chief Paul Groeneveld and Water/Wastewater Superintendent Ed Rolodson were in attendance to present their respective reports. 1. CALL TO ORDER Mayor Acre called the meeting to order at 7:00 p.m. 2. DISCLOSURE OF PECUNIARY INTEREST & THE GENERAL NATURE THEREOF None 3. APPROVAL OF MINUTES Minutes of the Regular Meeting of Council held January 12,2006 2006-038 Moved by M Taylor Seconded by M Schafer "THAT the minutes of the regular meeting of Council held January 12,2006 be approved, as circulated." Disposition: Motion Carried Unanimously 4. DELEGATIONS (a) 7:05 p.m.—Paul Baldwin,Warden introduced himself and brought greetings from the County of Elgin. He informed Council that the County will be seeking ways to better serve all County residents in a pro-active manner. He suggested that all Council in Elgin are facing major economic and social changes: tobacco vs wind, low cash crop prices, countervailing duties,crops vs cattle. He added that strong economies are necessary to pay for needed infrastructure. County Council has re-established a rural initiatives committee and is organizing a visioning exercise with representation invited from all Elgin lower tier municipalities. He added that be wants to build better County/City relations and co-operation and provide services and assistance to local Elgn municipalities. (b) 7:15 p.m.—Wayne Casier,Chairman Bayham Community Health Action Committee was in attendance and requested support for the recommendation provided in the draft minutes. COURT OF REVISION-DRAINAGE 2006-043 Moved by P Ens Seconded by M Schafer "THAT in accordance with the provisions of the Drainage Act, the Council of the Municipality of Bayham appoints Mayor Acre,Deputy Mayor Mathew Schafer,Councillors Mark Taylor,Paul Ens and Cliff Evanitski to sit as members of the Court of Revision; AND THAT Mayor Acre act as Chairman; AND THAT the Council Meeting be adjourned for the purpose of holding a Court of Revision pursuant to the provisions of the Drainage Act." Staff Presentation Staff Report DR2006-003 regarding Court of Revision—Henry Street Drain was presented by the Drainage Inspector. He advised and the Clerk confirmed that there had been no written objections received. He noted that Mr.Bogart wishes to undertake the work with his own contractor. He added that the municipal portions are not a big project and may be undertaken by the Public Works department. 4. Public Comments None S. Disposition of Item 2006-044 Moved by M Schafer Seconded by P Ens "WHEREAS in accordance with Section 58,Chap.D.17 of the Drainage Act,R.S.O. 1990 the appeal period which allows any owner of land assessed for drainage works to appeal that road or land has been assessed too high or too low or that any land or road that should be assessed has not been assessed,or that due consideration has not been given as to type of use of land,may personally,or by agent,appeal to the Court of Revision by giving notice in writing to the Clerk of the Municipality has expired and no appeals have been received; THEREFORE the Court of Revision for the Corinth Drain-Henry Street Branch,hereby confirms the assessments as per the Engineer's Drainage Report No.204237 dated November 25,2005."
