The regular meeting of the Council of the Municipality of Bayham was held beginning at 7:00 p.m. on
Thursday,October 7,2004 in Council Chambers. Present were Mayor Lynn Acre,Deputy Mayor
Mathew Schafer, Councillors Mark Taylor,Paul Ens and Cliff Evanitsld,Administrator Kyle Kruger and
Clerk Lynda Millard.
Planning Co-ordinator Margaret Underhill,Treasurer Suzann Mantel and Water/Wastewater
Superintendent Ed Roloson were in attendance to present their respective reports.
1. CALL TO ORDER Mayor Lynn Acre called the meeting to order at 7:00 p.m.

(c) Request from Councillor Ens to discuss the current status of fencing in the area between Heritage
and Jackson Lines and future use of fully fenced areas.
The Administrator advised that the recent fencing undertaken had been completed. He noted that
quotes for the remainder of the required portions have not yet been received. He added that there
are no permitted public uses except between Port Burwell and Tunnel Line. The option by Aim
for the permitted use as a utility corridor has not yet been exercised.
P Ens questioned whether quotes would be more forthcoming should the brush be removed to
allow easier placement of the fence.
The Administrator responded that could be done,however, one of the company's approached are
willing to remove the brush.
P Ens inquired what steps are required to implement recreational uses by the public. He was
advised that a submission should be made to the Joint Management Board for recommendation to
the Bayham and Tillsonburg Councils for consideration.
M Schafer suggested that once fenced,the corridor should be used.

AND THAT Council accepts the quote for the purchase and installation of an outdoor
municipal office sign in the amount of$4700.00+tax submitted by Par Signs;
AND THAT the supplier be requested to include locks at an additional cost;
AND THAT costs in excess of the current year's budget allocation shall be paid from the
capital stabilization reserve;
AND THAT Staff obtain quotes from qualified electrical contractors to install and complete
the necessary hydro hook-up for inclusion in the 2005 budget."

5. Council Comments and Questions
C.Evanitski questioned whether the application was intended for commercial development in
general.
Mr. Roe responded that the request was for hamlet designation and that there is no request for
rezoning at this time. It was suggested that control would be through the zoning and a site plan
agreement.
C.Evanitski noted cm-rent growth and development under the new Official Plan and would prefer
to delay and revisit next year.
M. Schafer added that the proposed expansion of the boundaries of North Hall had not been
permitted in the new Official Plan. He added that the Ministry of Transportation controls access
within 300'regarding proposed severances and suggested that the application is premature.
Mr.Roe agreed to confirm access with the MTO and revisit next year.

a condition of an earlier severance approval and that the A2 designation restricts further

the property.
The owner,Barry Kinsey responded that the driveway has been installed and approved by the

P.Ens questioned why the rezoning applications had not been submitted prior to expiry.
The Administrator responded that this is due to a turnover of Staff and lack of a tracking process.
He added that the Planning Co-ordinator is addressing this situation and once such a process is in
place expects that further such renewals will come forward to Council prior to expiry.

Staff Report D2004-042 was presented by the Planning Co-ordinator. She noted that,unlike the
previous submissions,this request is to accommodate a year-round use for a family member
rather than seasonal farm workers(eight months maximum). She advised that mobile homes are
not permitted year round in the new Official Plan.

4. Public Comments
Allan Dygos suggested that use of the unit is necessary in regard to year round livestock training
and boarding activities.
The Administrator advised that the provisions of the Official Plan discourage multiple dwellings
on a farm. Help associated with year round farming activities are encouraged to reside on other
properties.
It was noted that,upon justification for year round help,Council could consider support under the
T4 designation.
5. Council Comments and Questions
P Ens questioned whether there were any differences in assessment values between full time and
seasonal dwellings.
The Administrator responded that market value is taken into account.
M Schafer noted that the property for sale listing states that the mobile home provides a source of
income. Seasonal uses are intended for seasonal farm workers not use as a rented dwelling.
He questioned if the property is sold can the designation be withdrawn,and if not can the
approved time period be shortened.
The Administrator advised that there is no mechanism in place to withdraw once approved,
however the approval period can be shortened.

(b) Councillor Evanitski requested discussion regarding the Port Burwell Harbour noting that a
televised interview with Ron Bradfield had been conducted by Guy Goodwin and aired on the
New PL today. He added that it had been suggested that silt removed from the harbour be used as
fill for Bayham road reconstruction by the County of Elgin.
The Administrator advised that arrangements have been made for himself,Bev Hickey and Ron
Bradfield to meet with County Staff Mark MacDonald and Clayton Watters October 25th.
