Public Meeting—Planning(Rezoning) 8:00 PM Public Meeting-Drainage The regular meeting of the Council of the Municipality of Bayham was held on Thursday, April 19, 2012 in the Council Chambers. Present were Mayor Paul Ens, Deputy Mayor Mark Taylor, Councillors Tom Southwick, Wayne Casier and Ed Ketchabaw, Administrator Kyle Kruger and Clerk Lynda Millard. Treasurer David Aristone, Planning Coordinator/Deputy Clerk Margaret Underhill, Fire Chief/ By-Law Enforcement Officer Gord Roesch and Chief Building Official/Drainage Superintendent Bill Knifton were in attendance to present their respective reports. 1. CALL TO ORDER Mayor Ens called the meeting to order at 7:03 p.m. 2. DISCLOSURE OF PECUNIARY INTEREST & THE GENERAL NATURE THEREOF None 3. CARRIED UNANIMOUSLY 4. DELEGATIONS, STATEMENTS AND UPDATES 1. DELEGATIONS (a) 7:00 p.m. - Presentation by Pauline Schram, Chairman Straffordville Community Committee to Mayor Ens. Pauline Schram of the Straffordville Community Committee presented Mayor Ens with an FEO Achievement Award from Festivals &Events Ontario recognizing the Straffordville Watermelon Festival and the Municipality of Bayham as a 2012 most innovative partnership. A similar Award was provided to the group who will display it at the Bayham Community Centre. (b) 7:05 p.m. -Erica Arnett, Elgin-St. Thomas Health Unit and Nicole Ooms, Doug Tarry Ltd regarding "Active Transportation Initiative. Nicole Ooms and Erica Arnett identified the goals for the Active Transportation Initiative being: -to develop a connected network of on and off-road(multi-use trails) facilities in both urban and rural settings (trail length will depend on results of the survey); - to increase the rate of active transportation throughout Elgin St. Thomas; and -to create a useful tool to build a network(guidance document). The purpose will include a long-term vision for local active transportation, local polling data,best practices based on route selection criteria,potential routes requiring little investment, an assessment of destinations people may want to access, an implementation plan and signage standards. They asked Council's support to promote the initiative through posting a notice and link to the online survey on the municipal website and offering printed copies of the survey to the public. 2012-177 Moved by Deputy Mayor M Tayor Seconded by Councillor W Casier "THAT the Municipality of Bayham support the Elgin-St. Thomas Active Transportation Initiative by placing a survey notice and a link to the Health Unit website and questionaire on the Bayham website." CARRIED UNANIMOUSLY (c) 7:20 p.m. -Ray Talbot and Bob Lozon regarding Masonic CHIP program. Bob Lozon and Ray Talbot were in attendance to request support for the Masons' ChIP Ontario program of child identification and awareness through fingerprinting, dental bite, DNA swab, video and pictures, conducted with guardian permission. Information collected is given to parents for safekeeping and use in case of an emergency and the Page 2 of 17 Council Minutes April 19, 2012 master destroyed. The program was previously conducted at Watermelon Fest and endeavours to update child information as they grow. Several local service clubs and groups are assisting with support. The program is proposed to be conducted on Canada Day at the old Port Burwell firehall from 2:00 to 5:00 p.m. They requested use of the firehall and that Pitt Street be closed during the conduct of the program. 2012-178 Moved by Councillor W Casier Seconded by Deputy Mayor M Taylor "THAT Council authorizes the Masonic Lodges to utilize the front part of the old firehall in Port Burwell for the CHIP program on Canada Day and includes street closure from 1:00 p.m. until 5:30 p.m." CARRIED UNANIMOUSLY (d) Bonnie Brown and Christopher Shaw regarding a confidential matter. 2. STATEMENTS BY COUNCIL Mayor Ens reminded everyone that the new firehall will be hosting an open house on Saturday April 21st from 11:00 a.m. until 3:00 p.m. 3. UPDATES ON PROJECTS Richmond Community Water System—The Administrator confirmed that the Richmond Water transfer documents are in the hands of the Board's lawyer. Stantec and Hayden will proceed with work when the transfer is complete. New Firehall—The building is generally complete and the final billing for the project should be concluded soon. Harbour Divestiture—It was noted that the Stantec Peer Review is on the agenda to be considered in the closed session. 5. INFORMATION ITEMS (a) Stewardship Ontario correspondence dated March 30, 2012 regarding Industry Funding for Municipal Blue Box Recycling. CARRIED UNANIMOUSLY 6. PLANNING,DEVELOPMENT,RECREATION & TOURISM 1. CORRESPONDENCE AND REPORTS (a) Staff Report D2012-10 regarding Wizniak Development Agreement/By-law. File: L04 The Planning Co-ordinator noted that the Development Agreement is similar to a previous agreement with B & S Crevits for a supplementary farm dwelling. She added that the agreement included clauses regarding the removal of the mobile home after a two-year period for the cessation of occupancy and to cover unforeseen circumstances should the owner cease the farming operation. 2012-180 Moved by Councillor W Casier Seconded by Deputy Mayor M Taylor "THAT By-law No. 2012-047,being a By-law to authorize the execution of a Development Agreement between John Wizniak and the Municipality pertaining to a supplementary farm dwelling, be presented to Council for enactment." CARRIED UNANIMOUSLY (b) Staff Report D2012-12 Teichroeb Consent Applications E19/12 and E20/12 Hamlet of Richmond File: D10 The Planning Co-ordinator presented her report and advised that should Council not support the applications, staff would forward their comments to the Land Division Committee with staff recommended conditions, including rezoning, for their consideration of the applications should they decide to approve them. Deputy Mayor Taylor noted his opposition to decisions made based on assessment mapping not necessarily being correct. 2012-181 Moved by Councillor E Ketchabaw Seconded by Councillor T Southwick "THAT Staff Report D2012-12 regarding Consent Applications E19/12 and E20/12 Teichroeb be received; AND THAT Council recommends to the Elgin County Land Division Committee that severance applications E19/12 and E20/12, submitted by Sara and Cornelius Teichroeb, be refused." CARRIED UNANIMOUSLY PUBLIC MEETING 7:30 p.m. - Teichroeb Rezoning-The purpose of the amendment is to change the zoning from the Agricultural (Al) Zone to the Hamlet Residential(HR)Zone in the Zoning By-law Z456-2003 submitted by Cornelius and Sara Teichroeb. File: D14TEIC DECLARATION OF PECUNIARY INTEREST AND THE GENERAL NATURE THEREOF None STAFF PRESENTATION Staff Report D2012-11 Teichroeb Rezoning Application File: D14 The Planning Coordinator noted the purpose of the amendment would be to rezone the subject lands to a Hamlet Residential zone as a result of the Richmond boundary expansion as adopted through the 5-year Official Plan review and applicable Official Plan amendment approved by the Ministry of Municipal Affairs on January 10, 2012. She added that the effect of the application is to align the zoning of the subject lands to the Hamlet designation in the Official Plan. She explained the property is now within the approved settlement area of the Hamlet of Richmond,the boundary of which was extended on the north side of Heritage Line by the recently Ministry approved OP amendment. The Planning Coordinator also noted this amendment would have been included in the municipal initiated zoning by-law review coming forward later in 2012 in which all related OP amendments will be considered. She continued by saying the owners chose to apply in advance of the zoning by-law review in order to secure the zoning and pursue the related consents from the same parcel. She advised that one letter of concern has been received opposing the rezoning as well as the consent applications due to Minimum Distance Setback requirements from the nearby dairy farming operation. She noted that based on the letter, which states the dairy farm owner presently has 300 cattle,the Chief Building Official calculated the MDS setback requirements and determined the dairy barn is already located closer to the existing hamlet boundary and surrounding dwellings than the MDS calculations require. She added that based on those calculations, the existing hamlet boundary south of Heritage Line restricts the dairy farm owner and the additional zoned area within the recently extended settlement boundary would not further affect the MDS requirements. Page 5of17 Council Minutes April 19, 2012 PUBLIC COMMENTS Linda Milmine spoke on behalf of she and her husband's nearby farming operation. She commented that they have a Nutrient Management Plan however expanding the hamlet boundary closer to the farming operation is detrimental to their livestock facility. The Milmines have had livestock since the 1950s and want to be allowed to farm without infringing on their neighbours. They currently have no room to expand and yet the residential development is being allowed to move closer. Mr. Milmine questioned why houses are being allowed right across from the farm when that is likely to generate more complaints. COUNCIL COMMENTS AND QUESTIONS It was commented that some existing residences may predate the MDS requirements. Mayor Ens questioned whether the existing boundary of Richmond on the north side of Heritage Line further impacts the Milmines. It was responded no, that rezoning is intended to bring the zoning in line with the recent Official Plan Amendment. Councillor Casier stated the Milmines have valid points,that approving the rezoning will create a greater conflict and he could not support the application. Staff advised that Council has the option to approve, reject or defer the application to a later date. Councillor Ketchabaw noted that he agrees with the Milmines and is aware that an appeal could overturn a decision by Council to refuse the application. Page 6 of 17 Council Minutes April 19, 2012 File: E09 The Drainage Superintendent noted that the existing swales will become part of the municipal drain. 2012-185 Moved by Councillor E Ketchabaw Seconded by Councillor T Southwick "THAT Staff Report DR2012-004 regarding the Centre Street Municipal Drain be received; THAT the Council of the Municipality of Bayham acknowledges the receipt of Report#07330MD dated April 2, 2012 for the Centre Street Municipal Drain, as prepared by the Engineer, Cyril J. Demeyere Limited Consulting Engineers, and filed with the Clerk on April 5, 2012; THAT Council set a date for the Public Meeting to be held on May 3,2012 at 8:00 p.m. to consider the Report; AND THAT Staff be directed to mail a Notice of Public Meeting and Report to all persons assessed to this drainage works, and in accordance with the Drainage Act." CARRIED UNANIMOUSLY (b) Staff Report P2012-008 regarding By-law Review Committee Report. File: P01 Gord Roesch, By-law Enforcement Officer advised that the review committee recommends that enforcement of property standards and maintenance by-laws be done on a pro-active basis rather than complaint based. They also recommend defined setbacks in urban areas for natural gardens to ensure unobstructed visibility for vehicle safety. Routine inspections could be a fulltime job and enforcement hours could double if enforced on a pro-active basis. It was recommended that property and animal control by- laws be upgraded to reflect the zoning by-law with existing properties housing animals, grandfathered in. 2012-191 Moved by Councillor T Southwick Seconded by Councillor E Ketchabaw "THAT Council receives report P2012-008 and directs staff to make appropriate changes to existing by-laws to match the intent of the following recommendations: a.Natural Gardens—adopt setback as outlined in the recommendations for safety; b. Update the yard maintenance by-law to reflect the keeping of unlicensed vehicles as recommended by the committee; c.Do not allow the raising of livestock in urban areas with the noted exceptions as outlined in P2010-03; d.Ensure that the zoning by-law reflects the intent of the animal control by-law and the yard maintenance by-law; And furthermore bring back all recommended changes in the form of a new animal control by-law, an updated yard maintenance by-law and an amended zoning by- law for Council to consider." Options for the old fireball property includes listing and selling as is, demolition and developing into a parking lot or use as a farmer's market. Staff was requested to obtain an evaluation as is and report back with options. 9. (e) Email correspondence dated April 13, 2012 from Lori King regarding naming the proposed pavilion "Change Air Corinth Park Pavilion".
