HomeMy WebLinkAboutJanuary 26, 2012 - Council COUNCIL MINUTES THE CORPORATION OF THE MUNICIPALITY OF BAYHAM 9344 Plank Road, Straffordville January 26, 2012 7:00 PM 7:30 PM Public Meeting—Planning(Zoning) The regular meeting of the Council of the Municipality of Bayham was held on Thursday, January 26, 2011 in the Council Chambers. Present were Mayor Paul Ens, Deputy Mayor Mark Taylor, Councillors Tom Southwick, Wayne Casier and Ed Ketchabaw,Administrator Kyle Kruger and Clerk Lynda Millard. Planning Coordinator/Deputy Clerk Margaret Underhill, Fire Chief/By-Law Enforcement Officer Gord Roesch and Water Wastewater Superintendent Ed Roloson were in attendance to present their respective reports. 1. CALL TO ORDER Mayor Ens called the meeting to order at 7:00 p.m. 2. DISCLOSURE OF PECUNIARY INTEREST & THE GENERAL NATURE THEREOF None. 3. APPROVAL OF MINUTES AND ADDITION OF AGENDA ITEMS (a) Minutes of the regular meeting of Council held January 12, 2012. 2012-025 Moved by Councillor E Ketchabaw Seconded by Councillor W Casier "THAT the minutes of the regular meeting held January 12,2012 be approved as circulated." CARRIED UNANIMOUSLY (b) Added Item(s) There were no items added to the agenda. 4. DELEGATIONS (a) 7:05 p.m. David Roe and John Peters regarding value added agriculture. File: D14 Mr. David Roe, on behalf of John and Debra Peters,had provided a report regarding value added agricultural products in support of the processing of corn and wheat grown on the Peters farm to make tortillas within their barn. Mr. Roe commented that on-farm sales of crops produced on the farm can include pick your own operations,processing on site, events and attractions,winery tours, sales and restaurants, farm vacations/bed and Page 1 of 9 Council Minutes January 26, 2012 breakfast operations. He suggested that the Provincial Policy Statements - 2005 and the Bayham Official Plan and Zoning By-law can permit such defined uses. Mr. Roe referred to experiences and examples in other Municipalities such as the Niagara Region and Haldimand and Norfolk Counties who have or are supporting the farming sector by incorporating small scale value-added processing as a permitted use in their Official Plans and zoning by-laws. Larger operations can continue to be considered by a site specific zoning by-law amendment. Mr. Roe also noted that in the draft County of Elgin Official Plan steps to support value added processing, culinary tours and agri- tourism are being taken. He encouraged Council to support the efforts by the Peters' to develop on-farm processing and sale of agricultural based products. 2012-026 Moved by Councillor E Ketchabaw Seconded by Councillor T Southwick "THAT Council deems the bakery operation proposed by Mr.John Peters at 54940 Light Line, as presented by Mr. Peters and his agent Mr.David Roe, to be in compliance with the Municipal Official Plan and comprehensive zoning by-law." CARRIED UNANIMOUSLY (b) 7:15 p.m. Pat Vann regarding value added agriculture. File: D14 Pat Vann provided a copy of the presentation prepared by Sean Hurley to Council. Ms. Vann spoke in support of the Peters' processing and value-added processed products. It was noted that the Province of Ontario is reviewing the Provincial Policy Statements and are considering allowing on-farm businesses of any kind provided they are secondary to the agricultural operation and meet certain criteria. It is important to permit secondary uses such as value-added processed products on farms creating another stream of revenue that enables farmers to stay on the farm. 5. CARRIED UNANIMOUSLY PUBLIC MEETING 7:30 p.m. Friesen Rezoning-to change the zoning from the Agricultural (Al)Zone to a site-specific Special Agricultural (A2-7)Zone and a site-specific Rural Residential (RR-19)Zone in the Zoning By-law submitted by Mark and Myra Friesen. DECLARATION OF PECUNIARY INTEREST AND THE GENERAL NATURE THEREOF None. STAFF PRESENTATION Staff Report D2012-01 regarding Friesen Rezoning. File: D14FRIE The Planning Co-ordinator presented her report. She advised that rezoning is a required condition of the applicants' recent consent. The effect of the amendment will be to rezone the severed surplus dwelling unit for residential use, for a reduced front yard depth of an existing barn,to rezone the retained agricultural lands to permit a reduced lot frontage and to prohibit further dwelling unit development in accordance with the Agriculture land designation policies regarding Surplus Farm Dwellings in the Official Plan. The Planning Co-ordinator added that no written comments or concerns from the public have been received. Page 3 of 9 Council Minutes January 26, 2012 PUBLIC COMMENTS Mr. Roe, agent for the applicant, commented that the applicant has already made improvements to the property by cleaning up the land and restoring the barn. COUNCIL COMMENTS AND QUESTIONS Councillor Ketchabaw questioned whether Mr. Friessen was satisfied with the conditions to which Mr. Roe confirmed that he is.
